Eddins Will I, Simeon J. Eddins, of the county and city of Tuskaloosa and State of Alabama, being in good health, lest of sound and disposing mind and memory, do make public and declare this my writing to be my last will and testament is ______ and from following to wit. On this 29th day of November in the year 1853, John S. Bealle the father of my beloved wife Martha J. Eddins, executed his deed and conveyance setting on and seeing to my said wife during his life a large amount of real and personal property as well more fully appears by reference to said deed of record in the Probate office of said County book A.A. pages 496, 497,498, and in view of this ample provisions for_______ and comfort of my said wife. I deem it not ____ to her and due to my children to______ them equally all my estate both real and personal excepting the small amount of money herein after bequeathed to my sister Elizabeth Eddins. Item1st: It is my wish and direction that as soon as practicable after my decease, my executors hereinafter named pay all my just debts out of the first monies received or concerning my estate. Item 2nd: I will and bequeath to my sister Elizabeth Eddins the sum of two hundred dollars in cash to be paid to her by my executors out of _______ first monies occurring to my estate after the payment of my first debts and it is my request and desire that she appropriate some money to the purchase of a fine watch and chain, or such other desirable memorial of mutual love and affection she may select. Item 3rd: I give and bequeath to my said wife during her life my negro man Lewis, remainder to my children this ____ ____. Item 4th: If my wife survives me, it is my will and directive that after my decease, she shall ____ retain the ____ management and ____ of my entire estate both real and personal and the proceeds thereof until the ____ or ______ of distribution occur as hereinafter set forth, and that my farming or planting interest be conducted and managed by him in all respects as I have directed and managed the same in my lifetime that my said wife have the custody and control of my children during their minority or celibacy _______ the change my estate with the cost of educating them as thoroughly in respects as can be done by this schools, colleges, or institutions of learning of the Country and that during this ____ of my said wife and _____ _____ of my children, she shall ____ her changeable with any use or appropriation of the proceeds of my estate. She may prudently and in good faith make for the benefit of herself and our children, nor shall my children during their minority or celibacy be changeable with the costs of this main____ and educations, except that there was many _____ while _____ shall be changeable with ____ ___ to items after marriage. Item 5th: It is my will and direction that my children Ann Ella, Jane McAlpin, Martha Elizabeth, Annie Bealle, and John S. Bealle at their marriage or obtaining respectively this age of twenty one years each have and receive an equal share of my negroes and their increase to be ascertained and set apart to them respectively by a fair valuation of all my slaves and this increase not including my said negro man Lewis hereinafter disposed of and that my said children have ____ and enjoy the said slaves and their increase herein devised to them respectively to themselves. This being and ____ forever. And it is my will and desire that the remainder of my personal estate other than slaves be equally divided among my said children at the decease or second marriage of my said wife. Item 6th: It is my will and direction that at the decease or second marriage of my said wife my real estate to be equally divided among my said children to have hold and enjoy the same to them this being and ____ forever, and that if ___ to a fair and equal ____ of the same my executors hereinafter ___ be and they are hereby fully authorized, empowered and directed to sell and convey ____ at private sale real estate the proceeds of sale to be equally divided among my said children aforesaid, provided however that at the decease of my said wife of my said children or anyone or more of them are still minors and unmarried my said executors may in their sound discretion if deemed just had my real estate undistributed until my children have all married or attained the age of twenty one years. Item 7th: I do hereby constitute and appoint my brother Patrick H. Eddins and William L. Bealle (cousin to my said wife) my executors with full power and authority to execute and carry out in every respect my last will and testament and thereby authorize my said executors to sell anyone or more of my slaves that my acquire habits or exhibit _____ detrimental to the interest of my estate and invest the proceeds of sale in other slaves for my children. Item 8th: I hereby revoke and annul all other and former wills by me and declare this writing to be my true and only will and testament. Given under my hand and seal this 5th day of April 1859.
