Alabama Probate & Estate Settlement Written: November 18, 1833 Wilcox County, Alabama-- Probate Minutes Book 2 Estate of Peter BLACK p. 263 Application of Samuel W. FRAZIER for letters of administration on the estate of Peter BLACK. Mary Ann BLACK, widow of said Peter BLACK, relinquished her right of administration. Samuel Frazier was appointed administrator and paid a bond of $1200 with Thomas Y. DICKSON and Calvin C. SELLERS as security. Court ordered that Richard LANCASTER, Dempsey BRAZIL, and Jesse MEREDITH be appointed appraisers of Peter BLACK's property. [undated--closest date was Nov. 18, 1833] --------- p. 272 Samuel W. FRAZIER presented to court inventory of personal property of Peter BLACK; property insufficient to pay debts. Frazier applied to sell a tract of land--the SE quarter of Section 26, Township 15N Range 6E. Court ordered Sell of Property notice as required by law be given and terms of land sale on a credit of not less than six months. FRAZIER paid bond of $1000 with Benton B. PARHAM as security. Jan. 20. 1834 Term of Orphans Court -------- p. 516 Estate of Peter BLACK, dec'd. Upon application of Thomas C. BLACK for letters of administration de bonis non on the estate of Peter BLACK, deceased. Court ordered Thomas C. BLACK administrator give bond of twenty dollars and that Theodore C. SHIELDS be accepted as his security. Minor heirs of Peter BLACK, deceased. Ordered by court that Theodore C. SHIELDS be appointed guardian for William BLACK, Henry BLACK, Joseph BLACK, Elizabeth BLACK, Ann BLACK, Malinda BLACK, and Lucinda BLACK, minors of the estate of Peter BLACK, dec'd. Court ordered that Theodore C. Shields guardian of minor heirs give bond and security for the faithful performance of his duties in the sum of $1000 and that Benjamin GLOVER be accepted as his security. This day came Thomas C. BLACK, administrator of the estate of Peter BLACK, deceased, praying for order to sell real estate of said deceased, alleging that personal property is insufficient to pay debts. Theodore SHIELDS, guardian of minor children of deceased, came forth and denied the allegations set forth. Motion was made by Thomas C. BLACK that a commission take testimony of Elihu LOCKWOOD; testimony was read in open court; court sustained facts set forth in testimony and petition. Theodore C. SHIELDS as guardian for minor heirs and Mary Ann BLACK, widow of Peter BLACK came forth and waived the right of notice and consented to land sale. Court ordered Drury R. MALONE, Chauncey WILKINSON, and Philemon B. WATERS be appointed commissioners to sell land, to wit: SE quarter of Section 36 in Township 15 Range 6, 160 acres in Wilcox Co.; court allowed the following terms: on a credit of three months for one third the purchase money and twelve months credit for the remaining two-thirds. Court ordered they give 40 days notice of place and time for sale of land and to report to May term of court. [Note: After this estate record was the estate of Samuel W. FRAZIER. He obviously died while serving as administrator of Peter BLACK's estate.] Feb. term of 1836 ------------ Probate Minutes Record Book 3 Peter BLACK estate Feb. 27, 1836 Term of Court p. 4-- The commissioners who were appointed to sell Peter BLACK's land had failed to do so.; new commissioners were appointed: Samuel BARRON, Chauncey WILKINSON, and John A. GAMBLE [same terms and same land as above]. Ordered to report to June term of court. p. 13-- Terms of land sale were changed as follows: on a credit until the first day of January next for 1/2 the purchase money and first of Jan. 1838 for the balance. This change in terms of land sale was done for the benefit and interest of the heirs. Notice to be given by advertisement in public places in Wilcox County. p. 27-- Orphans Court Regular Term 3rd Monday in June, 1836 Commissioners reported to court on sale of land of Peter BLACK estate which had been sold June 4th at public auction, bid off by Samuel S. GAMBLE at $5.68 per acre for total of $910. Note taken with David BOYD as security dated June 4th last, payable $455 Jan. 1st 1837 and remainder payable first day of Jan. 1838. (Signed and sealed by commissioners named above) p. 217 Thomas C. BLACK requested final settlement of Peter BLACK estate. Court ordered 3rd Monday in February next as day of final settlement; ordered it to be advertised in at least three public places p. 233 Final settlement continued until next term of court p. 245 Final settlement continued (again) until next term of court p. 266 Final settlement: Balance of $263.53 to be divided among heirs of the estate.
