Grimes, of the town of Pine Apple, County of Wilcox, and State of Alabama, do herby make publish and declare this my last will and testament in manner and form following: 1st I direct that all of my just debts and funeral expenses be paid as soon after my decease as can conveniently be done. 2nd I give and bequeath to my wife Jodie Grimes and her and my three (3) children by her, that is Lois Lewis, Harold Grimes and Gladys Grimes, the homestead where we now reside and the lot of about fifty-three (53) acres connected with same to be my wife’s during her life and the said children at her death, or of such of them as are then living, and if any have died, their share and also their share in any other bequeath to them to their heirs if they have any issue at the time of their death. 3rd, I also bequeath to my son Harold, my gold watch and chain and to Gladys my stock of one thousand ($1,000.00) dollars in the Bank of Pine Apple. 4th The bequeath of house and lot to my wife Jodie Grimes also includes the furniture, family stores and feed stuff on said place, the horse and buggy and the individual cows, eight or ten in number which I own exclusive of the cattle that I own in co-partnership with my sons Roy and Herman. 5th I also bequeath unto my wife and her and my three (3) children, Lois Lewis, Harold Grimes, and Gladys Grimes, the two policies for $5,000.00 each in the Mutual Life Insurance Co. of New York. Share and share alike, my wife to act as guardian for the two minor children, Harold and Gladys. And manage it for them until they are of age without bond and without taking out letters of guardianship. 6th I also leave and bequeath to my wife Jodie Grimes and our three children the same named in paragraph 5 the land know as the Turkey Creek place. Said tract containing 343 acres more or less, said lands jointly, but under the management of my wife Jodie Grimes during minority of the minor children and when they become of age, to be disposed of as they think best. But if my wife as Guardian of the minors deems it best at any time to sell the lands, she is at liberty to do so under this will and hold the money of the minor or minors as guardian of same until they are of age, paying the interest of those who are of age to thereof. 7th Unto my three children by first marriage, now living and the children of my son Willsie Grimes, deceased, I leave the cotton that I have on hand at the time of my death to be sold when the three, any pay administrators think best the proceeds of said sale to be divided into four (4) parts, one part each to Roy and Herman Grimes and one part to Sheba Malone and one share to the three children of Willsie Grimes, my deceased son. I also leave and bequeath unto the said four heirs equally the house and lot known as the Melton Hotel and the Bennett place now occupied by Herman Grimes, to be disposed of as they deem best. 8th Finally, I will and bequeath unto all my heirs, eight in number, including my wife and the three children of my deceased son, Willsie Grimes, all the remainder of my estate, real, personal or mixed, consisting of the Breast Work Creek plantation, my one-half interest in the cattle and mules and any and all other property which I may die and cease and possessed of to be divided as above, share and share alike. Where they deem best, to sell or otherwise divide. 9th I appoint as the guardian of the three Willsie Grimes children, J. T. Adams, without bond or security. 10th I also appoint as executors of my Will, my friend, J. A. Matheson, and my son L. B. Grimes, without bond or security. In witness whereof I have hereunto subscribed my name and affixed my seal this the 21st day of March 1917. In the presence of Louie P. Cone and Sam N. Stanford, who I have requested to become attesting witnesses hereto. Attest W. H. Grimes The foregoing instrument was subscribed, sealed and published and declared by William H. Grimes, as and for his last will and testament, in our presence and in the presence of each of us, and we at the same time, at his request, in his presence, and in the presence of each other, hereunto subscribed our names as attesting witnesses, on this the 21st day of March 1917. L. P. Cone Sam N. Stanford I, W. H. Grimes being of sound and disposing mind and memory do hereby make this as a codicil to the will heretofore made by me on the 21st day of March 1917, and witnessed by L. P. Cone and Sam N. Stanford. Cotton having advanced to an unexpected price, and the cotton I now own being at this time in value considerably more than the ten thousand dollars Life Insurance left to my wife and her three children, I do by this codicil to my will, direct and will that when the cotton is sold that the said heirs of mine by my first wife that is, Roy Grimes, Herman Grimes, Sheba Malone and the children of Willsie Grimes, my deceased son, receive from the sale of said cotton, when sold $2,500.00 each, if said cotton brings this amount and the excess over this, if any, to be divided the same as in paragraph eight of my will, that is eight shares amount the eight heirs, but if cotton should decline in price, so that it did not bring $10,000.00 then there shall be added to that a sufficient amount from the part of my estate not specifically willed and disposed of in said paragraph, eight to equal ten thousand dollars for said for heirs above named. In witness whereof, I have here unto subscribed my name and affixed my seal this the 12th day of July 1917 in the presence of Louie P. Cone and Sam N. Stanford The State of Alabama :: Wilcox County :: In the Probate Court August 31st, 1917 In the matter of the petition to probate the last will and testament and codicil thereto, of W. H. Grimes, deceased. Comes unto open court Sam N. Stanford, who on oath duly administered to him, deposes and says: My name is Sam N. Stanford, I am 40 years of age and reside at Pine Apple, Wilcox County, Alabama. I knew W. H. Grimes for many years prior to his death: he died on or about the 1st day of August 1917. He was an inhabitant of Wilcox County, Alabama at the time of his death. On the 21st day of March, 1917, in said County and State, the said W. H. Grimes, in the presence of myself and one Louie P. Cone, did sign his name in writing to the instrument in writing now shown to me, purporting to be the last will and testament of the said W. H. Grimes and declared the same to be his last will and testament in writing. The said W. H. Grimes was over the age of twenty one years and upwards and was of sound mind: he signed the said instrument as and for his last will and testament: at the same time and place. I the said Sam N. Stanford and the said Louie P. Cone did sign our names to the said instrument as witnesses thereto at the request of the said W. H. Grimes in his presence and in the presence of each other. And affidavit deposeth and saith further on his oath: on July 12th 1917, the said W. H. Grimes in the presence of myself and said Louie P. Cone did sign his name in writing to the instrument in writing now shown to me which purports to be a codicil to his last will and testament, and declared the same to be his codicil to his last will and testament and at the time of signing said codicil the said W. H. Grimes was over the age of twenty-one years and upwards, and was of sound mind and deposing memory. He signed said instrument as a codicil to his last will and testament and at the same time and place I, Sam N. Stanford and the said Louie P. Cone did sign our names to the said instrument as witnesses thereto at the request of the said W. H. Grimes and in his presence and in the presence of each other. Sam N. Stanford Sworn and inscribed before me this the 31st day of August, 1917. Pat M. Dannelly Judge of Probate State of Alabama :: Wilcox County :: I, Pat M. Dannelly, Judge of the Court of Probate, in and for said county, do hereby certify that the within instruments of writing have this day, in said court and before me as the Judge thereof, been duly proven to be the genuine last will and testament and codicil of W. H. Grimes, deceased: and that said will and codicil together with the proof thereof, have been recorded in my office in Book of Wills, No 7, Page 306.
