R. ROSE, ADMINISTRATOR COURT ORDER On this day is presented to the Court the petition of W. R. Rose, for Letters of Administration on the Estate of Bose Rose, deceased. Upon examination, the Court finds that said Bose Rose died on the 21 day of August, 1944 and at the time of his death, that he was a resident and citizen of Benton County, Arkansas, and was possessed of an estate in the State and County aforesaid upon which there is need of administration being had in order that the said estate may not be lost or destroyed. The Court finds that said petitioner is a fit and proper person to receive Letters of Administration herein and that the said petitioner is not disqualified by law from receiving such Letters of Administration and that Unites States Fidelity and Guaranty Co. has executed bond in this cause for the faithful performance of his duties, and that said bond is sufficient in sum and is good as to sureties thereon and is by the Court on this day approved. It is, therefor, considered, ordered and adjudged by the Court that the petition be granted and that the Clerk of this Court is hereby authorized and directed to issue Letters of Administarion on the estate of Bose Rose to the petitioner herein. R. ROSE, ADMINISTRATOR. FINAL SETTLEMENT Now on this 7th day of February, 1946, is presented in the Courth the Final Settlement of W. R. Rose, Administrator of the Estate of Bose Rose, Deceased. Same is by the Court examined and continued for publication and further orders of the Court. John K. Butt Probate Judge Benton County Probate Court Record March Term, 1946, 4th April 1946 Pages 186-187 IN THE MATTER OF THE ESTATE OF BOSE ROSE, DECEASED, W. R. ROSE, ADMINISTRATOR ORDER APPROVING FINAL SETTLEMENT On the 4th day of April, 1946, the final settlement of the estate of Bose Rose,deceased, is approved in this court. The court finds that Bose Rose died intestate in Benton County, Arkansas, August 21, 1944, W. R. Rose was appointed adminstrator of his estate and entered into bond with the United States Fidelity & Guaranty Co., as surety, filed his inventory and has administered said estate. The court finds that said final settlement was filed in this court on the 1st, day of February, 1946 and that same has been advertised as required by law in the Benton County Democratic weekly newspaper, printed and published in Benton County, Arkansas and having a _________ and _____ ________ circulation therein and proof of said publication is filed herein. The court finds that W. R. Rose, administrator has received the following money and personal property belonging to the estate of the intestate, to wit: 1-Bentonville School District Bond $1000.00 1-U.S. Savings Bond, No-M-198115_ Matures on June 1st, 1946 750.00 7 adjusted service bonds of 1945, Nos 36925 661 to 67 inclusive 350.00 Cash in Bentonville Bank 448.14 ------------- $2548.14 The court finds that the administrator has paid claims against said estate and cost of administration, the following amounts, Callison & McKinney, $57.50 Foster Monuments Works, 50.00 R. S. Whitlock, Bond Premium 35.00 Clerk of the Court, 6.55 --------- Total $149.05 The court finds that the deceased left him surviving W. R. Rose, a brother, Bentonville, Arkansas, Mary Ann Gregg, A sister, Bentonville, Arkansas and Julia Saykelley, a sister, Joplin, Mo., his sole and only heirs at law and each inherit one-third of said estate. The court finds that W. R. Rose is entitled to the sum of $175.00 as his commission as administrator of said estate. The court finds that the administrator retained Sam Beasley attorney of this bar to assist him in preparing his final settlement and that he is entitled to a fee in the sum of $50.00 and that after paying said commissions aforesaid the administrator will have for distribution among the heirs at law the sum of $2174.09. The court finds that a greater portion of said estate is invested in bonds and by agreement of said heirs, W. R. Rose agrees to take said bonds at face value and pay the other two heirs their portion of said estate in cash and said agreement is approved by this court. It is therefore considered, ordered and adjudged by the court that the administrator pay to the said Mary Ann Gregg the sum of $724.67 and pay to Julia Saykelley the sum of $724.67 and that said administrator assign to W. R. Rose the Bentonville School District Bond of $1000.00 and the seven adjusted service bonds of $750.00 and after complying with this order, the administrator together with his bondsmen be discharged from further liability.
