All rights reserved. http://www.usgwarchives.net/copyright.htm *********************************************************** John Elkins, the Welshman, came to North Carolina from Wales when quite young, and with his family removed to Tennessee, and from there to Johnson County, Illinois, making the latter trip with a yoke of oxen hitched to a sled. He settled on the Sam Glassford farm west of West Vienna. He arrived in this country sometimes prior to 1800, and after remaining here a few years with his daughter, Mrs Mansfield, and her husband and his youngest son, Joshua, went to Little Rock Arkansas, where he lived to be 94. Mrs Mansfield a her husband had trouble and he killed her with a hoe. . . 1810 Randolph Co., Ill Census - Clear Creek - Census Place 1 male to 10 -Whit 3 males to 16 - Joshua, William, Richard 1 male 45 & over -Old John 3 females to 10 - Mary, Elizabeth, Amy 1 female to 26-45 - Elizabeth Styles Elkins The age, number, and sex of children are correct to be John Whitney Elkins HISTORY OF JOHNSON CO., IL by Mary Ellen Mount p 6 James Bain. . . John Elkins. . . were a few of the names which were early appear in the court records HISTORY OF JOHNSON COUNTY ILL by Mrs. J. T. Chapman John Elkins, tradition says, was Welch and came originally from Wales, settled in North Carolina and removed to Tennessee, and finally Illinois about 1809, settling somewhere near the Samuel Glassford home. His family consisted of a wife, Elizabeth Styles whom he married in 1798, and seven children, one son stopped in Kentucky of whom there is no history. The children coming to this county were William (2), Richard (2), Whit (2), Amy (2), Fanny (2), and Joshua (2). John Elkins lived in this county several years and moved to Little Rock, Ark and his daughter, Fannie (2) who had married John Mansfield and his youngest son Joshua (2) accompanied him. He died there at the age of ninety-four. GOODSPEED HISTORY OF JOHNSON CO., IL p 556 Joshua Elkins, one of the most successful citizens of Johnson Co., Ill., was born on a farm two and a-half miles from his present abode June 1, 1818. His father William Elkins, was born in Georgia, and his father, John Elkins, was born in Wales. U emigrating to the United States he at first located in Georgia, but in 1809 he removed to what was then the Territory of Illinois, and thus became one of the first settlers in Johnson Co. He secured quite a large tract of Government Land upon which resided a few years, and then removed to Arkansas, settled near Little Rock, and lived there the remainder of his days. William William Elkins was a boy in his teens when his parents removed to Illinois. A number of families came to this Terriot at the same time. Two years later earthquake shocks were felt here, and a number of these families becoming alarmed, left for other parts of the county. At that time Illinois was for the most part uninhabited except by Indians, and all the land was owned by the Government. In 1812 there was a massive earthquake in KY, IL, MO. Reports say that the Mississippi River ran backwards for two days. This earthquake created Reelfoot Lake in western TN, but this earthquake is not the reason for John Elkins moving to AR. John Elkins did not move to AR until 1824 or 1825. Both he and his son Joshua are listed in the Johnson Co., Court Records in this time period. COMMISSIONER'S RECORDS JOHNSON COUNTY, ILLINOIS, JULY 15, 1813-1817: VOLUME A by Ruth Ann Sistler p 15 , 1 Jan 1814 - Ordered that the suit Elizabeth Elkins against John Elkins be continued until the May Term - This probably started in Randolph Co. before it split into Johnson p 130 : March 19, 1814 Elizabeth Elkins vs John Elkins It is ordered by the court that the overseers of the poor for the township of Centre do divide the property signed and taken formerly by them (agreeably to a warrant from two magistrates and returned into this court) into three equal shares - and the Sd Elizabeth Planitiff have choice of one share or third part so divided - and that the sd overseers dispose of the other two shares or third parts at public vendue on a credit of nine months taking bond and sufficient security for payment which to be retained in their hands or their successors for the benefit of the children of the sd John and Elizabeth Elkins - and to be applied for that use from time to time as the court of common pleas may think proper to direct it is ordered that retur of sales & cn. be make to our next court of common pleas. The above transaction is shown as a probate, but I believe that it was a continuation of the above suit -- Elizabeth Elkins vs John Elkins which eventally ended in divorce. PROBATE --- HISTORY OF JOHNSON COUNTY, ILLINOIS BY MARY ELLEN MOUNT p 65 Chapter XI One of the first records regarding an estate was recorded May 10, 1814, as Owen Evans Exhibited in court a list of property of the state of John Elkins sold by Evans as an Overseer of the Poor. The sale amounted to $955.76 1/2. At the same time a list of debts due the Elkins estate was drawn up. This amounted to a total of $135.00. The amount of the sale plus the debts owed the estate brought the total to $1091. The widow of Elkins was to get one-third of the estate sale which amounted to $363.77. However, Elizabeth Elkins, the widow, had purchased merchandise worth $632.58 1/2 and also owed $55.00, making a total of $687.00 which was $323.23 more than her appointed share of the estate. It was the decision of the court that Mrs. Elkins give bond with security payable to the Overseer of the Poor. This bond was to be made in the amount of $323.23. If she should fail to do so, the court decreed that the Overseer of the Poor would be ordered to sell property to come to the prescribed amount. p 130 p140: July 13, 1814 The United States vs E. West foreman p 149: 15 Nov. 1814 : The United States vs Elisha Spivy & Eliza Elkins -Adultery or Fornication The parties being called the defendants appeared in court and also the atto. General - the plea of not guilty being plead. An issue joined - a Jury was then ordered - wereupon came a Jury towit. . . the arguments being gone thro. the Jury retired to consult of their verdict. The court then adjourned until tomorrow morning 9 o'clock. att. J. Finney Clk. p 150 Wednesday, November 16 (1814) The U States vs E. Spivy and E Elkins: adultery & cn. The jury sworn in this case yesterday came into court and on their oaths do say we of the Jury find Elisha Spivy and Elizabeth Elkins guilty of the charge of adultery as laid in the indictmt. Tho. Giles. It was then moved by the attoryn for the Defendants that a new trail be granted in this case - motion postponed. It was then ordered that the Defendants be recognized in the sum of one hundred and fifty dollars each. p 151 - The United States vs E. Smith may have taught the first Sunday School in Okalona and Clark County in 1833. Writing a few years later, Smith recalled that people of all ages attended. Among those families were McLaughin, Crow, Caruthers, Cornelius, Gentry, Gibbins, Thornton, Elkins, Lisenby, Pierce, Rieves, Keath, Lewis, Wood, and Stewart. Y Barlow (grandaughter of John Whitney) and Mrs. Nell Elkins Pearce McCallister dated Jan 18, 1937 "My father, Ralph Anslon Elkins, came to Texarkana from Clark Co., AR in October 1865. He possibly left a brother John in Clark Co. Before 1865 two of my father's brothers (Joshua and ? went to California during the Gold Rush. My Father's mother City, and she was French. City was my grandfather's second wife. Fifty years ago I had a nephew Tom and a niece Maranda in Prescott, AR. . . . My father, Ralph Anslon Elkins was born Jan 8, 1831 in either Clayborn Parish, La or Clark Co., AR. My grandfather's name was John Elkins, and I think that he was born in VA. My Father's brother David died in Clark Co., AR after 1865. I do not know for whom my father was named. EXTRACTED FROM LETTER BETWEEN Joan Rose (descendant Richard Elkins CA 1850 IL) and Nora Carter Descendant - great grand father David Elkins d. 1895 CA) July 1985 John (Whitney) Elkins was born in SC in Camden District probably Fairfield Co. There were several Elkins in this area in this time they were all related. William and Joshua (Oldest) Elkins went from IL to Ark with John. John Elkins married Felicity 1830 Clark Co., AR, and had Raphael (Ralph) in 1831 and David in 1833. John died in 1838 David Elkins married Elizabeth Ann Gibbins in 1852 Clark Co., first child Rachel Elanora Aug 1853. In 1854, David and "Betsy" along with most of the Gibbins family crossed the plains in covered wagons, stopping in Utah on the Great Salt Lake where a child was born to one of the Gibbins couples, and they all spent the winter there. The spring or perhaps summer they went on to California by way of the "Emigrant Trail" through Emigrant Gap. As far as I can see no other Elkins came with them. They were at Auburn, Placer Co. in 1860. The men did some mining on "Rattlesnake" Bar and then moved to different places, in other words, scattered but settled. Betsy and David settled in Mendocino Co. between Yorksville and Boonville. (David died in Mendocino buried in Yorkville Cemetery) Most of them were in Mendocino and Sanoma Co., but some stayed in Placer Co. When David left Ark his mother went to live with a brother of Betsy -- -Isaac Walter Gibbins and she must have died there after 1860. Later Issac and his wife came to California and raised a family of 15 children Our ancestor John (Whitney) purchased land in 1798 in Franklin Co., GA for $200 which is why your Richard was born there. Perhaps, John stayed there until after 1800. The "History of Johnson Co., ILL" by Mrs. Chapman is certainly far from accurate. The Elkins family was in Colonial America back in the 1600s and South Carolina issued indents to several of the family Ann Elkins and David Elkins, also Dury, John, Johnston, Etc. I believe those men to be uncles of our John, but no proof. I haven't found John in the DAR index, but did find a John served in SC Sumters Regiment. The National Archives had nothing on that so, I will have to write to SC archives. The early 1600's Elkins families were in New England-- Virginia. The names John, William, Richard, David, and Ralph have been used in almost every generation. John Elkins married three times. William Elkins appointed administrator. 1 Aug, 1854 HEMPSTEAD CO., AR - PROBATE Cornelius, William 1852-Will Book BC p 35 The will of William Cornelius dated 2 Feb 1852, Filed 12 April 1852 (William died the night of the day the will was written, so his date of death will be 2nd, or early morning of the 3rd of Feb. Cornelius spelled Cornelias throughout the will, a single page.) To Elizabeth my lawful and beloved wife, 1/2 of my estate and Henryetta my only begotten daughter the other 1/2 of my estate. Jester Cornelius to take the guardianship of Henryetta Cornelius my daughter. Nominate and appoint Jester Cornelius my brother and Elizabeth Cornelius lawful and beloved wife to be my Executor and Executrix to this my last will and testament. Signed in Hempstead Couny on this date above written Wm (his mark) Cornelius. Signed in the presents of each other date first written. Witnesses: J. H. Nelson, G. W. Matthews William seems to have died of some sort of fever. According to the testimony, he asked William Elkins to write his will for him, the morning of the day he died. This was done, William elkins signed it, and William Cornelius put his "X". Jester Cornelius went into court within a few days and gave an oral will to the clerk and got himself appointed executor. William Elkins filed the above will 12 April 1852. July Term 1852 of Hempstead Probate Court. Jester files his exceptions to the will and gives a statement. In part he says, "the widow of said William Cornelius departed this life about the 10th or 11th day of February 1852. She having survived the said William only eight or nine days, and that there is only one heir to the estate of who is a minor of tender years - - a girl about 6 years old and is Named Elizabeth H Cornelius. Goes on to list property and that it is owned by himself and the sd William, dec'd. Talks about ownership of this years crop, land and improvements, and the need to sell the perishable property. A statement at the end by Reubin R. Cornelius that Jester's statement is true in the matters and facts set forth. Attested to in open court July 14, 1852. Will was upheld in Hempstead, carried to the State court and upheld. One of the wittnesses (Matthews) did not sign in the presence of William Cornelius, talks about William Elkins writing the will. Smith, Clerk In the Clark Circuit Court March term AD 1854 Jester Cornelius as administrator of the estate of William Cornelious, deceased brings into court his letters of administation of the estate granted him by the probate court of the county of Hempstead in the state of Arkansas, and by attorney complains of William Elkins William Janes and Milton G. Hill defendants having a plea of covenant broken. Snellgrove Indian Territory, Southern Judicial District, Before me, a Notary Public in and for said District, on this day personally appeared J.S. Snellgrove, who after being by me duly sworn on his oath states and says: that he resides in the Chickasaw Nation and Indian Territory and has so resided for a period of 13 years. That he is personally acquainted with Dr. S.G. Bittick who resides at Ryan in the Chickasaw Nation in said Territory. That he was personally acquainted with the late Mary A. Bittick who was mother of S.G. Bittick and who departed this life Nov. 15th 1898. That the said Mary A. Bittick during the latter part of her life and at the time of her death resided at the town of Ryan in the Chickasaw Nation Indian Territory. That upon her death she left surviving her as one of her heirs at law, a son, the said Dr. S.G. Bittick who from all appearance is now of the age of 51 years. Affiant further states that he knows that the said Mary A. Bittick was the identical person she claimed and represented herself to be during her lifetime, and that the said S.G. Bittick is the same person whom he represents himself to be in his application for citizenship in the Choctaw Nation. Affiant furthers says that the said Mary A. Bittick at the time of her death was a very old woman. That she was from all appearances above the age of 80 years. That she was a very large woman with coarse straight black hair and black eyes. That she was of a dark copper color and that she had the appearance of being of Indian blood. Affiant further says that the said Mary A. Bittick's maiden name was Mary A. Melson and that affiant was personally acquainted her brother Sol Melson when he resided in the state of Arkansas where affiant knew him. Affiant further says that he became acquainted with the said Sol Melson about the year 1862 and that he lived nearby him in the same neighborhood from about 1862 to 1877 and during this time he was well acquainted with Solomon Melson and with his relatives and family residing in said neighborhood. That the said Sol Melson was of a dark copper color with coarse straight black hair, black eyes, and high prominent cheek bones. That he showed from his appearance that he was of Indian blood. That he was, when affiant last knew him, about 65 years of age. That the said Sol Melson and Mary A. Bittick, nee Melson, resembled each other very much and that all the other members of said family with whom affiant was acquainted, and he knew several of them, had the same general appearance. Affiant further says that the said Melson was generally known and recognized in the neighborhood in which he lived and among the people he was most intimately acquainted to be of Choctaw Indian origin and that it was generally understood in that neighborhood among the people that said Melson was of Choctaw Indian blood. Affiant further says that he was acquainted with such reputation at the time last above named and that such was their general reputation in that neighborhood at that time. Affiant further says that said Sol Melson is now dead. That the said Mary A. Bittick in her lifetime also claimed to be of Choctaw Indian blood. Affiant further says that the complexion, physical appearance, language and manners of the said Mary A. Bittick and the said Sol Melson indicated that they were of Indian origin. That from the facts and circumstances and from the statements above made out affiant says that he has every reason to believe that the said Mary A. Bittick and Sol Melson and said S.G. Bittick are of Choctaw Indian blood. That the said Sol Melson and the said Mary A. Bittick claimed to have emigrated to the state of Arkansas from the state of Mississippi a great many years ago and that it was generally understood in the neighborhood where they lived that they came originally from Mississippi to Arkansas. Affiant further says that he has no interest in the prosecution of the claim made by the said Mary A. Bittick and now being prosecuted by her son S.G. Cornelius spelled Cornelias throughout the will, a single page.) To Elizabeth my lawful and beloved wife, 1/2 of my estate and Henryetta my only begotten daughter the other 1/2 of my estate. Jester Cornelius to take the guardianship of Henryetta Cornelius my daughter. Nominate and appoint Jester Cornelius my brother and Elizabeth Cornelius lawful and beloved wife to be my Executor and Executrix to this my last will and testament. Signed in Hempstead Couny on this date above written Wm (his mark) Cornelius. Signed in the presents of each other date first written. Witnesses: J. H. Nelson, G. W. Matthews William seems to have died of some sort of fever. According to the testimony, he asked William Elkins to write his will for him, the morning of the day he died. This was done, William elkins signed it, and William Cornelius put his "X". Jester Cornelius went into court within a few days and gave an oral will to the clerk and got himself appointed executor. William Elkins filed the above will 12 April 1852. July Term 1852 of Hempstead Probate Court. Jester files his exceptions to the will and gives a statement. In part he says, "the widow of said William Cornelius departed this life about the 10th or 11th day of February 1852. She having survived the said William only eight or nine days, and that there is only one heir to the estate of who is a minor of tender years - - a girl about 6 years old and is Named Elizabeth H Cornelius. Goes on to list property and that it is owned by himself and the sd William, dec'd. Talks about ownership of this years crop, land and improvements, and the need to sell the perishable property. A statement at the end by Reubin R. Cornelius that Jester's statement is true in the matters and facts set forth. Attested to in open court July 14, 1852. Will was upheld in Hempstead, carried to the State court and upheld. One of the wittnesses (Matthews) did not sign in the presence of William Cornelius, talks about William Elkins writing the will. Elkins fired three shots at Nash, when about fifty yards distant, each shot taking effect; the last one entering the back and lodging in the heart, producing instant death. Elkins escaped arrest. Nash was a resident of Clark Co., and was said to be sort of bragadocio, trouble making character. Joshua D. had moved back to Arkansas by 1878 when his daughter Cora was born. McGruder is living with Thomas Epting The decendants of Mc Gruder have family traditions about M. C. (Mc Gruder) being raised by the Epting family and spending much time with them through out his life. Joshua D. Elkins was in Pike Co near his mother's family (Wingfield) by 1880 (Census) lists daughter as being born in AR. Therefore Joshua D. Elkins left Hill Co., Tx before 1878. Logan of Calistoga Napa Co., Ca for his share of William Elkins' estate due him through his dead daughter Leona was alive in 1860 (11 years old) and living in Montgomery Frier's household with Elen Elkins. She should have been alive in 1863 when John Elkins gave power of attorney to Isaac W. Smith before moving to Texas. But She was not listed on the 1870 Hill Co., Census with John Elkins. And she definitely was dead by the time her father William C. Logan requested his share of the William E. Elkins estate in 1870. It is quite possible that Leona married after moving to Texas with John Elkins.
