D. 1853 In Chancery To the Honerable Judge of the circuit Court of Clark County in Chancery Sitting Your petitioner William Maynard of the County of Clark in the State of Arkansas would respectfully represent that sometime in the year Eighteen hundred and fifty one Gibson Maynard was possessed in fee simple of the Southwest quarter of the North East quarter of section ten in Township nine south of Range nineteen west containing forty acres. Your Horator would further represent that sometime in the year Eighteen hundred fifty one he purchased said tract or parcel of land for which he gave seventy seven dollars in hand but the conveyance of the same was not made through neglect of both parties. Your petitioner would further represent that the parties being so closely connected by consanguinity as father and son to be he supposes the cause of the neglect. Your petitioner would further represent that said Gibson Maynard state to him that he would go to the northern portion of this county and would return the week following and make him a deed at any time he wished to said land. Your Horator would further represent that said Gibson Maynard did go to said portion of this county and was there taken sick and departed this life in September or the month of August or September Eighteen hundred and fifty one about one week from the time he left having no opportunity to comply with the promise made to your Horater. Your petitioner would further represent that since the death of said deceased letters of Administration have been granted to one John Y. Greene by the Probate Court of Clark County where the said Gibson Maynard resided at the time of his death. And your Horater would further represent that the said Gibson Maynard left heirs or children whose names are Elizabeth Epperson the wife of Thomas Epperson, Jesse Maynard, James Maynard, John Maynard, and William Maynard your Horater. Your Horater would further represent that all of the above named persons residences are unknown to your petitioner but believes they live in the States of North Carolina, Georgia & Mississippi except John Maynard who lives in Montgomery County in the State of Arkansas and your Horater in the County and State aforesaid. In tender consideration where of and for that your Horater is made remitless in the strict rules of common law and relievable only by this court of Equity where matters of this nature are strictly cognizable. To the end thereof that said defendant may respectively full true direct and perfect answers make upon their respective corporeal oaths to the best of their respective knowledge information and belief to all and singularly the charges and matters aforesaid as fully in every respect as if the same were here enjoyed reprobated and they thereunto particularly interigated and they may be compelled to convey the tract or parcel of land aforesaid to your Horater and that your Horater may have such other and further relief as to your Honer shall seem just and your Horater will in duty bound ever pray.
