Eaves and his wife Emily J. Eaves to Hypasia P. Curlen [Hypasia P. Curlin, second? wife of Jesse J.J. Curlin] for the sum of $250. Land description is the East 1/2 of the Northeast 1/4 of Section 25, Township 5, Range 12 West and the Northwest 1/4 and the Northeast 1/4 and the East 1/2 of the Southeast quarter of Section 25 in Township 5 South, Range 12 West in Grant County, Arkansas. Note that Benj. & Emily Eaves were sworn in Pulaski County which is north of Grant County. Note also that the land was conveyed in 1870 but the deed was recorded 1902, some 38 years after the deed was written - could this be due to Hypasia's death where someone had to settle her estate???? She was married to Jesse J.J. Curlin December 1869 in Pine Bluff, Jefferson County, Arkansas - why, after a year of marriage, was she buying this land by herself, as a married woman, without any mention of Jesse J.J. ??? They resided in Jefferson County at that time. L. Eaves and Wife to Hypasia P. Curlen [Curlin] Warranty Deed - Husband's Lands ($.50 Rev Stamp here) Benj. L Eaves & wife To Hypasia P. Curlen. Know all men by these presents: That I Benj. L. Eaves for and in consideration of the sum of Two Hundred and Fifty dollars to me paid in hand paid by Mrs. Hypasia P. Curlen, I do hereby grant bargain and sell unto the said Hypasia P. Curlen and unto "her" heirs and assigns forever the following Lands lying in the County of Grant and State of Arkansas, to wit: The East half of the North East fourth of Section Twenty-five township five [which direction?] of Range 12 W Range twelve West [duplicate] and the North West fourth and the North East fourth and the East half of the South East quarter of Section twenty-five in Township five South "fie?" Range twelve west containing two hundred acres. To have and to hold the same unto the said Hypasia P. Curlin and unto her heirs and assigns forever with all appurtenances thereunto belonging. And I hereby covenant with the said H.P. Curlen that I will forever warrant and defend the title to said lands against all claims whatsoever. And I Emily J. Eaves wife of the said Benj. L. Eaves for and in consideration of the said sum of money do hereby release and relinquish unto the said H.P. Curlen all my right of dower in and to the said lands. L. Eaves and Emily J. Eaves to me well known as the grantor in the foregoing Deed and stated that he had executed the same for the consideration and purposes therein mentioned and set forth. And on the same day, also voluntarily appeared before me, the said Emily J. Eaves wife of the said Benj. L. Eaves to me well known and in the absence of her said husband declared that she had of her own free will signed and sealed the relinquishment of Dower in the foregoing Deed for the purposes therein contained and set forth without compulsion or under influence of her said husband.
