Smart for the sum of $886.40, he being the highest bidder at public auction for the Curlins' land. This land is described as the North half of the Southeast quarter of Section 7 and 60 acres off the North half of Southwest quarter of Section 8 in Township 4 South, Range 9 West 140 acres. Albert R. Sherrill was the plaintiff in a lawsuit against Jesse J. Curlin, his oldest son James A.V. Curlin, and William D. Ramey, defendants. There was a decree made by the Jefferson Circuit Court in Chancery at the Fall Term 1873 that Jesse J. and James A.V. Curlin were to pay Albert R. Sherrill $697 with interest from 8 August 1871 at the rate of 10 percent on or before January 1874 and a lien was placed on the above mentioned property. If they defaulted, the land was to be sold at public auction to the highest bidder. They did not pay Albert R. Sherrill and therefore the land was auctioned, thus satisfying the Curlins' debt. Felix G. Smart later sells part of this land back to the Curlins in 1879 for $1 [why is this??] Land involved: [N 1/2 of SE 1/4 of Sec. 7, Twp. 4 S, Rng. 9 W] [N 1/2 of SW 1/4 of Sec. 8, Twp. 4 S, Rng. 9 W] JEFFERSON COUNTY, AR CIRCUIT CLERK'S OFFICE DEED BOOK P-2, PAGE 386 - 387 2 FEB 1874 / REC. 4 FEB 1874 D.W. Carroll to Felix G. Smart Deed (Sale of land owned by Jesse J. and James A.V. Curlin due to 1873 decree with Herbert R. Sherrill) D.W. Carroll Commr. To Felix G. Smart This deed of Conveyance executed this 2nd day of February 1874 by and between David W. Carroll as Special Commissioner and Felix G. Smart. Witnesseth that whereas by a certain decree ??dered by the Jefferson Circuit Court in Chancery at the Fall Term thereof 1873 in a certain suit? there pending wherein Albert R. Sherrill was plaintiff and Jesse J. Curlin and James A.V. Curlin and William D. Ramey were Defendants. it was decreed that said Jesse J. and James A.V. Curlin should pay to the said Albert R. Sherrill on or before the first day of January 1874 the sum of Six hundred and ninety seven dollars with interest from August 8th 1871 at the rate of ten percent per annum and declaring a lien to exist on the North half of South East quarter of Section 7 [N 1/2 of SE 1/4 of Sec. 7, Twp. 4 S, Rng. 9 W] and 60 acres off the North half of South West quarter of Section 8 in Township 4 South Range 9 West [N 1/2 of SW 1/4 of Sec. 8, Twp. 4 S, Rng. 9 W] 140 acres and ordering the said land to be sold in default of payment as aforesaid and appointing the undersigned a Special Commissioner to execute the said decree and Whereas default was made in the payment of said money and the interest and the undersigned did advertise for sale the lands above described as required by said decree and at sale Felix G. Smart bid for all of said land the sum of eight hundred and eighty six dollars and forty cents which being the highest bid offered at said sale the said lands were struck off to him as the purchaser thereof. And whereas it was agreed and understood by and between the said Albert R. Sherrill, Jesse J. Curlin, James A.V. Curlin, Felix G. Smart and David W. Carroll as Special Commissioner that the whole purchase money should be paid on the day of sale in consideration that said Special Commissioner would charge a commission for his services as such Commissioner and whereas pursuance of that agreement and understanding the said Felix G. Smart did pay the full amount of his bid less the commissions allowed by said decree to the said Special Commissioner. Now therefore in consideration of the sum of Eight hundred and Eighty six dollars & forty cents to wit in hand paid by G. Smart the receipt of which is hereby acknowledged. I have this day bargained and sold aliened and conveyed to Felix G. Smart the North half of North East quarter of Section 7 and 60 acres off the North half of South West quarter of Section 8 in Township 4 South Range 9 West 140 acres situated in Jefferson County. Some of the paragraphs were inserted by me - Kim Curlin Wettroth Summary: Conveyance of 70 acres of land from Jesse J. Curlin, his wife Hypasia P. Curlin, his youngest son George G. Curlin and George's wife Mary V. Curlin to Jesse J. Curlin's oldest son James A.V. Curlin for the price of $1500. The land, located in Jefferson County, Arkansas, is described as the Southeast quarter of Northeast quarter of Section 7, Township 4 South, Range 9 West less 2 acres surveyed off the center part (38 acres) and the North part of Northwest quarter of Southwest quarter of Section 8, Township 4 South, Range 9 West (32 acres). A sum of $100 was initially paid in cash to the Grantors and the remaining moneys were to be paid in installments of $500 each (plus interest of 10 per cent annually) on the first of December 1881, 1882, and 1883. Addendum notes on the side of this document attests that the loan was finally paid in 1899 and the lien was released. M.E. Curlin, then widow of James A.V. Curlin, signed for it. It appears that the installments were only paid in 1881 and 1882 - what about 1883? Was this loan forgiven by H.P. Curlin in 1899? Both Jesse J. Curlin and James A.V. Curlin died in 1888; therefore the finalization was 11 years after their deaths. Hypasia had remarried W.A. Glasscock of Randolph County, Arkansas in 1890 after J.J. Curlin's death and was therefore remarried at the time of the satisfaction of this loan. Also note that though the land lay in and was conveyed in Jefferson County, Arkansas on 1 September 1881, Jesse J. Curlin et al were living in Burleson County, Texas at the time of the transaction. Their sworn affidavits were conducted at Deanville, Burleson, Texas on 13 September 1881.
