His Will has been kept with his Granddaughter, Sarah Elizabeth Bolin Garner's Family Bible. Kelly Bialk has transcribed it below. It is dated12/31/1895 and is typewritten. Page 1 Know all men by these presents, that I, William C. Hale of the county of Newton and State of Arkansas being of ill health but of sound and disposing mind and memory do make and publish this my last Will and Testament, hereby revoking all former wills and testaments by me at any time heretofore made. First, I comend my Spirit to God who gave it. And as to my worldly estate ad all the property,real and personal, or mixed of which I shall die seized or possessed or to which I shall be entitled at the time of my deceased I devise and bequeath and dispose of in the manner following to wit: All my just debts and funeral expenses shall first by my executor be paid out of my estate and soon after my decease as shall by him. I give devise and bequeath to my children by my beloved wife Matilda Jane Hale that part of my land situation in the County of Newton and State of Arkansas described as follows to wit: The North West fourth of the North East fourth also the East half of the North West fourth and the South West fourth of the North West fourth of section one (1) in Township fifteen North Range Nineteen West. Also the West half of the South East fourth, the East half of the South West fourth and all that part of the West half of the South West fourth lying and being on the East side of Buffalo from the middle of the main channel, all in section Thirty Six Township Sixteen North Range Nineteen West. Hale Page3 To have and to hold the same unto my said children of my said wife Matilda Jane Hale and unto their heirs and assigns forever, provided that neither of my said children shall sell or dispose of any of him or her interest in said lands until each shall have attained the age of twenty years, and should any one of my said children sell or dispose of any of his or her or their interest in said lands before all shall have attained the age of twenty on yers then in that event the part so sold or disposed of shall revert to and be the property of such of my said children as shall not have disposed of his or her interest in said lands, and unto his her or their heirs and assigns forever. Provided further that my beloved wife Matilda Jane Hale shall share equally with each of my said children William C. Hale Page 4 in the rents issues and profits and possession of said lands for and during her natural life. And I further give devise and bequeath unto my said children of my said wife equally all my house hold and kitchen articles and all my farming tools and utencils, and I further give devise and bequeath unto my said children of my said wife Matilda Jane Hale enough food or provisions for their necessary use for one year, all of my live hogs and six head of milch cows. I give devise and bequeath unto the heirs of my deceased daughter Narcissie Salmon the following lands lying in the county of Searcy and State of Arkansas to wit: The North half of the North West quarter of Section William C. Hale Page 5 Six Township fifteen North Range Eighteen West, the South fractional half of the South West fractional quarter, and the South West quarter of the South East quarter of Section Thirty one (1) in Township Sixteen (16) North Range Eighteen West. To have and to hold unto the said heirs of my said deceased daughter Narcissie Adaline Salmon and unto their heirs and assigns forever. Provided that neither of the said children of my said deceased daughter Narcissie Adaline Salmon shall sell or dispose of any of his or her interest in said lands until all shall have attained the age of twenty one years, and should either them or dispose of any of his or her interest in said lands before all shall have attained the age of twenty one years then William C. Hale Page 6 that event the part so sold or disposed of shall revert to and be the property of the said children of my deceased daughter Narcissie Adaline Salmon as shall not have disposed of or sold his or her interest in said lands, to his,her or their use, heirs and assigns forever. I give devise and bequeath unto the children of my daughter, Malissie P. Garner, and unto their heirs and assigns forever the following lands lying in the county of Boone and State of Arkansas to wit: the South East quarter of the South West quarter of Section two, and the North East quarter of the North West quarter of Section eleven also fourteen (14) acres more or less bounded by a conditional line in the South East corner of the North West of the North west quarter William C. Hale Page 7 of Section Eleven. All of said lands lying and being in Township Seventeen North Range Nineteen West. Provided that neither of the said children of my said daughter Malissie P. Garner shall sell or dispose of any of his, her or their interest in said lands until all have attained the age of twenty one years, and should any or either of said children dispose of any of his, her or their interest in said lands until all shall have attained the age of twenty one years, then in that event the part so sold or disposed of shall revert to and be the property of such of said children as shall not have disposed of or sold his, her interest in said lands, to his,her or their heirs and assigns forever, and provided further that my said daughter Malissie P. William C. Hale Page 8 Garner shall share equally with each of her said children in the rent issues, profits and possession of said lands for and during her natural life. I give devise and bequeath to each of my children of my wife Matilda Jane Hale one horse, bridle and saddle or the equivalent thereto in cash. I direct that after the reservation of the personal property herein specified that the remainder be sold by my executor at private sale in a manner as shall by him be deemed most advantageous to my estate. And that after all my just debts and demands are paid that the remainder be distributed among my heirs in the manner in which would descend at law. I direct that any lans which I may die seized of or possessed, that the same be (except such as is herein disposed of) divided William C. Hale Page 9 by my Executor among my heirs, and in case the same can not be satisfactorily among them, I direct that my Executor sell and dispose of the same in the manner as he may think best, and divide the proceeds there among my heirs the same as it would descend at law. I direct that my Executor during his administration of my estate shall deposit in some safe bank or other safe secureity such money belonging to my estate as shall not be necessary to carry on the legitimate business of my estate. And lastly, I do nominate and appoint my esteemed friend William P. Spears to be the executor of this my last will and testament; and in case of his refusal or failure to action or qualify I do nominate and appoint my esteemed friend Curtis L. William C. Hale Page 10 Gray to be the Executor of this my last weill and testament. In testamony whereof I the said William C. Hale have to this my last will and testament contained on ten pages of legal-cap paper and to each pagetherof subscribed my anme, and to this the last page thereof I have subscribed my name and affixed my seal on this the Thirty first (31) day of December A.D. 1895.
