They were seen together near Alamo, each having a horse, though dismounted, and just previous to the attack deceased was observed to be reclining on the ground, holding his animal by the bridle. Ruiz now suddenly rushed upon him with a knife, inflicting a terrible wound in the abdomen, from the effects of which he died in a few hours. The murderer was arrested, but at his trial which took place January 16, 1861, he was discharged, the jury disagreeing, there being eleven in favor of his conviction of murder in the first degree, and one for manslaughter.
