D. 1920 in said City and State. Make and publish this my last Will and Testament in manner and form following to wit: First, My will is: That all my just debts, expenses of my last sickness and funeral charges shall by my Executor herein-after named, be paid out of any funds available therefor. Also procure and pay for a single granite monument and erect the same over the graves of my Mother and Father who are interred in the Cemetery at Baraboo, Wisconsin, Cost of same not to exceed $300.00, same to be properly inscribed with names, date or birth and death. Also procure and erect over my grave a suitable granite monument, inscribed thereon: "Captain Mair Pointon; Born December 30, 1843. Died --------. He served his country 1861-5. Second. I give, grant and bequeath to my wife Maria Pointon, all my household goods, stoves, kitchen and other utensils, table ware and linen, beds and bedding rugs and furniture to hold the same to her, her heirs and assigns forever. I also give, grant and bequeath to my said wife Maria Pointon, for her sole use and benefit for and during the term of her natural life: All the interest, income or increment derived from all moneys, stocks and bonds, that I may own at my demise, after paying therefrom all my debts and liabilities herein mentioned; and yearly taxes out of said moneys or the interest derived therefrom. Said moneys and funds to be under the control of and to be invested by my Executor hereinafter named, and the interest or income therefrom - less sufficient to pay taxes levied upon said funds - be paid to my said wife Maria Pointon during her life time for her sole use, benefit, maintenance and support. Third: Mair and Maria Pointon own Lot 8 of Block 4 of Lindaraxa Tract in the City of Alhambra, State of Cal. The title to which, in case of the demise of either of us, passes to the survivor. Should it pass to me (which God in his mercy forbid) Then and in that case: I give, grant and devise said Lot and house together with all and singular the hereditaments and appurtenances thereunto belonging to my daughter Maud M. Wing and my son Philip Theron Pointon to have and hold the same equally to them, their heirs and assigns forever. Fourth: I give, grant and bequeath to my son-in-law Frank S. Wing and to my daughter-in-law Mrs. Hilma R. Pointon, each the sum of One thousand dollars ($1000.00) To have and to hold the same to them and their heirs and assigns forever. Subject, however, to the prior rights of my wife Maria Pointon as provided herein, said legacies are not to be paid until after the demise of Maria Pointon. Fifth: I give, grant and bequeath to my daughter Mrs. Maud M. Wing and my son Philip Theron Pointon all the residue and remainder of my estate of whatsoever Kind of nature, they to share the same equally between them after the demise of their Mother and the payment of the legacies and charges against my estate as herein provided and made, to have and to hold the same to them, their heirs and assigns forever. Sixth: I give my son Philip Theron Pointon, as Executor, the sum of Five hundred dollars in cash, from money on deposit, to pay his personal expenses while caring for the property and executing the provisions of this Will, the same to be paid to him at my demise, and not to be considered as part of his legacy granted herein. Lastly: I do nominate and appoint my son Philip T. Pointon, now of Fresno, California, Without bonds, the Executor of this my last Will and Testament. Hereby revoking all former Wills by me made.
