I, Robert Duncan, being of sound mind and disposing memory, do publish and declare the following to be my last will and testament, declaring null and void all former wills. First, I give and bequeath all my real estate in the City and County of San Francisco and the State of Calif. To my wife Isabella Duncan, and to my children, Isabella and Annie Duncan, to be equally divided among them. Second, I give and bequeath to my son by my first marriage Sampson Duncan, eight acres of land in the County of Santa Clara and State of Californina, being the one-half of 160 acres purchased by me of James Enright in the Garcis Grant. Third, I give and bequeath to my daughter, Christina Nash, wife of Patrick Nash of San Joaquin County, aforesaid state, the other half of the aforesaid tract purchased by me of James Enright. Fourthly, I appoint my wife, Isabella Duncan, my sole executrix of this my last will and testament without giving bond for the performance of such trust. Fiftly [sic], I appoint my dear wife, Isabella Duncan, Guardian of the persons and property of my said children, Isabella and Annie Duncan, without giving any bond for the performance of such trust. Witness, my hand at the County of Santa Clara, State of California, this seventh day of January, 1857. Words of “and County and State aforesaid” underlined before signing. Witnesses: Robert Duncan.
