He is survived by four brothers, Roberto of Patterson, Nicholas of Stockton, Jessie of Santa Clara, and Francisco of Mexico; and five sisters, all of Mexico. A rosary was recited Wednesday evening at the Evans Funeral Chapel. The final report being prepared by the Stanislaus County Sheriffs Department had not been received by Patterson Police Chief Donald Braunton as of mid-day Wednesday. Braunton said he was concerned about the "abundance of misinformation" that has circulated around the community since the fatal shooting early Sunday evening. He said he was particularly concerned about misleading information in a daily newspaper account of the incident. The police chief released the following information based on his original discussions with the two police officers involved. Both were given administrative leave, which Braunton said was a customary procedure in such circumstances, and one was to be back on duty Wednesday evening. The other is scheduled to return to duty Friday. Officer Tyrone Spencer responded to a disturbing the peace call at, 7:22 p.m. Sunday. He was directed by radio to go to an apartment unit behind La Tapatia, a Mexican bakery on East. Las Palmas Avenue. There he found Plascencia arguing with Gloria Salido over dog droppings that had been shoveled back and forth over a fence between their two apartment units. Salido s 18 year old daughter Leticia had called the police in an effort to quell the argument. Sgt. Richard Bull, who had been on duty only a few minutes, heard the radio call and arrived at the scene in a second police car. Two young neighbors - 15 and 19 year old brothers - reportedly were present and served as translators. Sgt: Bull had been talking with Leticia Salido and allegedly felt the tempers had calmed down. He started to walk toward his police car preparing to leave. At that moment Plascencia reportedly reached inside his jacket and pulled out a pistol, sticking it into Spencer s face. In doing so, a holster and ammunition clip went flying to the ground. The officer then asked Bull to return to the scene and grabbed Plascencia s arm. The pistol ended up on the ground as the two men struggled, and Sgt. Bull - who by now was only 10-12 feet away with his weapon drawn - cautioned Plascencia not to pick it up. However, according to Chief Braunton, the victim did pick up the .32 caliber, pistol and again Spencer grabbed him. They grappled, and the gun was bent around toward the officer. Spencer then slipped to his knees, and Plascencia stood over him - the pistol pointed at his head. It was then that Bull fired his weapon, a .45 caliber. The victim turned around toward him, still holding the pistol. The sergeant then emptied his weapon, firing eight shots in all. He then ran behind a vehicle to reload as Plascencia finally dropped his gun and fell. He had been hit in the chest, both shoulders, and legs. Officer Spencer had not had time to draw his weapon, the police chief noted. The fatally wounded man was taken by ambulance to the Del Puerto Hospital, then transferred by Medi-Flight helicopter to a Modesto hospital where he died in surgery. City police had been requested to go to the scene last Saturday when Larry Buehner, who owns the apartment units, served Plascencia with an eviction notice. Plascencia reportedly had shown several people the gun he was carrying. The deceased had been employed at Patterson Frozen Foods until earlier this year. but reportedly had used physical violence against a supervisor and was fired. The utilities in his apartment unit had been turned off, apparently for lack of payment. Bull, who himself was shot several times from ambush behind city hall in January, 1979, returned to the local department as a sergeant on March 1. He had been with the county sheriff s department as a deputy for about a year and a half. The injuries suffered in the 1979 attack left, him off duty for 11 months.
