Bettencourt David 940215 p1 Vernalis Death Accidental; Stanislaus County authorities are saying that the shooting death last Sunday of David Bettencourt, 19, was accidental. Bettencourt, who was originally from Canada, and had been living in his car in the Modesto area, died from a self-inflicted gunshot wound, according to Sgt. Tom Hardin of the Stanislaus county Sheriff's Department. According to the sheriffs office, Bettencourt had been caught burglarizing the barn of Vernalis almond rancher Charles Morris Jr. last week. Morris said he confronted the suspect with his own loaded weapon, a .300-caliber Magnum deer rifle. When he came upon Bettencourt, Morris said he kept telling Bettencourt to wait for deputies to arrive. Instead, Morris said Bettencourt kept telling him that he was going to be apprehended. Hardin said Bettencourt had been in the United States illegally. He had served some jail time in Canada for burglary, and had come to the area to visit some friends. While In the area. Bettencourt also burglarized two other residences in Turlock and Ripon, Hardin said. Hardin said that when Bettencourt was confronted by Morris, he went into the barn, and later attempted to escape. by squeezing through the. barnyard doors. As he tried to squeeze through the doors, Hardin said Bcttencourt's gun went off, hitting him in the chest and killing him. Morris said all Bettencourt had to do was to undo the door. which was not locked, and he could have made it without shooting himself. Morris said he had been burglarized four times in the past. I was just fed up, Morris said. But given the outcome of the confrontation, Morris said he would not do it again. I wouldn't do it again, if I had to do it over again, Morris said. "I feel dumb, very dumb in what I did." "At his age, it was a waste of life. He was at a place he didn't belong, "Morris said, "I feel bad that the accident happened." At the same time, Morris said he feels lucky to have the situation turn it out the way it did for him. "I don't understand his thinking," Morris aid. "I kept telling him that the sheriff was on the way. I kept telling him to stay still, but he said didn't want to be taken in the worst way," Morris said. Morris said Bettencourt had laid everything out in a neat manner as to what items he wanted to take. Bettencourt started to take off, but Morris said he shot at the car's tires, flattening one of them. Even then, Bettencourt still tried to leave, eventually ramming his car into the barn. Morris, believing Bettencourt had been shot, went to get a drink of water for the 19-year-old, but when he returned, he said he was starting down the barrel of Bettencourt's gun. It was at this point that Morris' son-in-law, Karl Herger, came upon the confrontation, startling Bettencourt. He gave Morris enough time to remove himself from the confrontation, and pushed Bettencourt to seek shelter in the barn, where he accidentally shot himself while trying to escape. Morris said that if there is a next time, he's going to call the sheriff and wait in the shadows." "It's not anything to involve yourself with as a citizen," he said. Georgia. chased and led police through city streets before "purposely" crashing his semi truck cab into a pickup truck driven by Manuel Nunes, 43, of Tracy, Monday night. Ellinger was killed instantly in the 11 p.m. head-on collision at Las Palmas and Poplar avenues with a pickup truck towing a cattle trailer. Ellinger's left arm was severed in the crash. Nunes was airlifted by helicopter to Memorial Medical Center in Modesto. where he was treated for minor injuries and released. Two of Nunes' four cows were killed in the accident, while the other two were felled by a California Highway Patrol offier. Police are still trying to reconstruct all the details leading up to the chase and fatal crash. Two women said they met Ellinger at the Frontier Club, and said he made advances toward one of them and became angry when he was rejected. According to one woman, who asked her name he withheld, EllInger met the two women outside the bar where he put his arm around her. "He was drunk and belligerent, " she said. When she removed his arm from around her waist, he started to swear at her and stormed off to his truck. That was around 10:30 p,m. Ellinger got in his truck and headed in an easterly direction on Las Patinas Avenue. Helen Whitman, 69, said she heard a crash in front of her house on Las Palmas and saw Ellinger's truck struck in the center divider at South Hartley and Las Palmas. Whitman said she watched as Ellinger finally freed his truck, and then turned on HartIey into the California Palms subdivision. He then came back out and parked across the street waiting for a few minutes before driving down Las Palmas. At that point. Sgt. Louis Bonacich, driving his persona] car, and heading back into town on Las Palmas, said he noticed the red Freightliner, three-axle truck driving east on Las Palmas without lights. Bonacich said he thought the truck might be stolen, so he radioed the license number in. Bonacich said he made a u-turn to confront the driver. When he did, Ellinger also made a u-turn crashing into a palm tree just at the city limits sign. With Ellinger inside the cab of his truck, Bonacich said he was going to ask the driver to step out when. instead of stopping. the truck pulled into reverse and came after Bonacich who was parked across the street. The off-duty police officer put his car in reverse and Ellinger followed him west on Las Palmas and into the California Palms tract. Bonacich said he called for help, and was assisted by two patrol cars, who then pursued Ellinger through the area while Ellinger was chasing Bonacich. During the pursuit, Ellinger smashed into flood lights at the corner of Hartley and Chesterfield, hitting a parked Honda Accord belonging to Dianna Horne, on Palmaritta Avenue, and then hit the Whitmans' 1985 Chey Celebrity on Las Palmas. The chase continued east on Las Palmas at speeds approaching 80 mph. At one point, just before Sycamore Avenue, Ellinger tried to take out another car, Bonacich said. Finally, just after Poplar Avenue, Ellinger crossed the center line and slammed into Nunes' pickup head on. According to the highway patrol, which is investigating the accident, the trailer carrying the cows was propelled into Ellinger's cab, tearing away the top of the cab and propelling Ellinger's body to the back of the cab. Patterson Police Crndr. Tyrone Spencer said Ellinger had left his freight at the Westley truck stop, before he was reportedly seen drinking at the Westley Hotel. Roberts, who turned 15 on Oct. 25, was accompanied by two 17-year- old youths, both from Patterson They said Robert Ruiz had a handgun in his possession when they arrived. He later told police the knew his grandfather kept a pistol in the grandfather's locked bedroom, and that he had crawled through a broken bathroom window from outside the house after first removing some tape and unlocking the window. Took Pistol He said he had taken the pistol from where it was kept between the mattress and box springs on three or four previous occasions in recent weeks. He said he had used it to shoot an estimated 25 rounds in a nearby orchard across Ward Avenue. A .32-caliber Colt semi-automatic pistol was later found in the bedroom, returned to its holster. The grandfather told officers he kept the bedroom door locked because of the gun. The youth said he took the clip containing four cartridges and removed it from the pistol, then replaced the bullets with eight of a different type he found in a dresser. He said it was his intention to go outside and shoot the gun in the orchard. When the other three youths arrived, they apparently watched television. Ruiz showed them the pistol and the gun was passed around. The other two boys said a knife was used to pick a lock to a barroom, and that the two 17-year olds drank some sherry after Ruiz opened the bottle. One of the boys also said the four smoked three marijuana cigarettes, with the two 17-year olds consuming most of them. Boys Leave At about 10:15 p.m., both boys said they left the residence and walked to one of their Patterson homes. A father there then gave the other youth a ride to his rural residence. One of the boys said Ruiz was talking on the telephone when they left. He also told officers that when the four of them were in the barroom, he removed the clip and a bullet from the chamber of the pistol and refused to hand them over when asked to do so by Ruiz. He said he then left the magazine and the single bullet on a counter in the barroom before he and the other youth left the home. He said Ruiz and Roberts had both been "playing around" with the unloaded handgun, each saying "bang, bang, bang" when pointing the weapon. Wanted to Shoot After the two were gone, Ruiz discussed shooting the gun in the nearby orchard with Roberts. She had already begun to prepare tortilla chips on the stove in the kitchen while he sat at a table in the adjacent dining room. Ruiz said he made a telephone call to a cousin, and that it was about this time that he reinserted the magazine into the pistol, popping a round into the chamber. He said he then put the gun on safety and went to the bathroom. When Ruiz returned, he again asked about going outside to shoot the gun. He said Roberts said "no," that she was making chips. "I'll hurt you," Ruiz said he joked in a friendly manner. "I wouldn't even care if you shot me," he said she replied. At that point, Ruiz told officers, he picked up the pistol from the table, removed the clip with the bullets, clicked off the safety, and walked into the kitchen area intending to scare Roberts. He said he pointed the hand-gun at her head, and she commented, "I don't care." He said he pulled the trigger, not realizing a round remained in the chamber. Ruiz said he again crawled through the bathroom window and returned the pistol to its holster in the bed, first partially inserting the clip. He did not replace the magazine with the original four cartridges. Called 911 Running back into the house, he called 911. PPD officer Joe Camarda was the first on the scene. Others arrived momentarily and Ruiz showed one of them where he had put the gun. Roberts was found on the floor of the kitchen with a single wound over her left eye. She had been shot at point-blank range. A stove burner was on, and a shell casing was found on the floor near the body. Blood Tested The girl was air-flighted to Doctors Medical Center in Modesto while Ruiz was taken to the police station for questioning. Shortly after 2 a.m. the youth was transported to Del Puerto Hospital where a blood sample was taken. While he was there, officers learned that Michelle Roberts had died but would be kept on support systems pending organ transplants. Ruiz was booked into juvenile hail about 4:30 a.m. Friday on a murder charge. The two had a dating relationship a year or more ago, and since had been friends. A test by police later discovered that the handgun cannot be fired without having the magazine inserted. When found in the bedroom, the magazine was partially inserted and a cartridge was in the chamber. Services Set Final rites have been scheduled here for Michelle Rose Roberts.
