Towner of Boulder in the County of Boulder and Territory of Colorado being of sound disposing mind and memory do make and publish this my Will and Testament. First My possessary right to all and singlular hereditaments and improvements, lands and tenements in and to a certain claim of one hundred and sixty acres of land situated on Brummers Glutch in Sugar Loaf District Boulder County where I now reside with my family, I give and bequeath to my beloved wife Lucinda Towner for a homestead. Second I give and bequeath to my son Elijah Edward Towner and Celia Towner my daughter, all my Stock such as cows, calves, heifer steers, bulls, Horses, mares and colts, after the paying of all my just debts out of said property with this exception to wit: I give and bequeth to Lucinda Towner my beloved wife the right to possession to such personal property and the use and enjoyment of the profits arrising there from. There in on use there after to go to said Elijah E. Towner and Celia Towner but my desire should either of said executors die or remove from this county or any other disability ensue them either of said executors may act alone. In testimony where of I have hereunto set my hand and seal and publish and declare this to be my last will and Testament in the presence of the witnesses named below this 17 day of March 1875. Reuben E. Towner (seal) Signed sealed published and declared by the said Reuben E. Towner as and for his last Will and Testament in presence of us. Who in his presence and in the presence of each other, and at his request have hereunto subscribed our names as witnesses Alphus Wright E. A. Groesbeck John B. Groesbeck (This part written on margin and disignated * was written before signing indicated by the testator) I assent and fully accept the provisions of this Will. Lucinda Towner Witness {A. Wright Whereas by my last will and testmanet as above written I did not mention any time for a division of said personal property among said children. I do hereby, by this present writing which I declare to be a codicil to my said will and hereby do make and declare this change in said will or attend by this codicil. In testimony whereof I have hereunto set my hand seal and publish and declare this to be my last Will and Testament in presence of the Witnesses named below this 17 Day of March A.D. 1875. Reuben E. Groesheck I accept the provisions of the above codicil this 17 day of March 1875 Lucinda Towner witness A.Wright Additional Comments: Reuben Towner was born in 1824 in Greene Co., New York to Loammi and Amy Butt Towner. Loammi Towner left the family and moved "West" where it is believed he died in California early 1850's. Reuben married Lucinda Howard and they left New York in 1855 and moved to Iowa. Reuben left his wife and children in Iowa temporarily and along with his brother Marcus went to Colorado then in Nebraska Territory where they worked a mining claim. Marcus and Reuben Towner joined the Colorado Militia and were part of the Sand Creek Massacre. Marcus became a member of the Boulder Town Company which laid the ground work for the City of Boulder. Reuben Towner was living on a 160 acre homestead Ranch in Boulder County, Colorado Territory when he wrote his Will. He named only two children but he had four living. A son Mansfield and daughter Romelia were left out of his Will. Reuben died 29 March 1875.
