INTRODUCTION Under the provisions of Public Resolution No. 96, 76th Congress, approved August 27, 1940, National Defense Act, as amended, and Army Regulations No. 130- 10, the personnel of the Colorado National Guard was inducted into Active Military Service of the United States for a period of twelve consecutive months, unless sooner relieved, as follows: September 16, 1940: 45th Division (less 45th Tank Company), which included the 157th Infantry, Headquarters 89th Infantry Brigade, and Company "C", 120th Quartermaster Regiment. September 21, 1940, September 24, 1940, October 1, 1940, July 7, 1941: State Staff and State Detachment. January 6, 1941: Company "D", 193rd Tank Battalion (formerly 45th Tank Co.), 120th Observation Squadron, Air Corps. February 24, 1941: 168th Field Artillery. At the time of the Presidential Order for induction of the first contingent, the authorized strength of the Colorado National Guard was 196 officers, 2 Warrant Officers and 2292 enlisted men, a total of 2490. Of this authorized strength, 174 officers and 2250 enlisted men, a total of 2424, were inducted, and their names, grades, serial numbers and organizations are shown by General Orders, Special Orders and Rosters attached hereto, as follows: Officers En. With reference to the induction of the Colorado National Guard into active military service of the United States, the following letter from the Secretary of War to Governor Ralph L. Carr, dated September 5, 1940, and the Executive Order of the President of the United States are quoted for the information, guidance and compliance by each and every person concerned: WAR DEPARTMENT "WD 325 Washington (8-31-40) M-C September 5, 1940. Honorable Ralph L. Carr, Governor of Colorado, Denver, Colorado. Dear Governor Carr: In order to strengthen the common defense, the President has thought it proper at this time to exercise in part the authority vested in him by Public Resolution Number 96, 76th Congress, approved August 27, 1940, to order from time to time any or all members and units of all reserve components of the Army of the United States into active Federal service. He has, accordingly, given his signature to Executive Order Number 8530, August 31, 1940, a copy of which is inclosed. In accordance therewith and as indicated in my telegram of September 3, 1940, all active elements of the following units of the National Guard of the United States of the State of Colorado, and all personnel of both the active and inactive National Guard assigned to such units, are ordered into the active service of the United States as of, and from the sixteenth day of September, nineteen hundred and forty. (Extract) "EXECUTIVE ORDER ORDERING CERTAIN UNITS AND MEMBERS OF THE NATIONAL GUARD OF THE UNITED STATES INTO THE ACTIVE MILITARY SERVICE OF THE UNITED STATES By virtue of the authority conferred upon me by Public Resolution No. 96, 76th Congress, approved August 27, 1940, and the National Defense Act of June 3, 1916, as amended (39 Stat. 166), and as Commander-in-Chief of the Army and Navy of the United States, I hereby order into .the active military service of the United States, effective September 16, 1940, the following units and members of the National Guard of the United States to serve in the active military service of the United States for a period of twelve consecutive months, unless sooner relieved: "UNITS All active elements of: 45th Division, less 45th Tank Company "MEMBERS All members, both active and inactive, of the units listed above. All persons so ordered into the active military service of the United States are, from the, effective date of this order, relieved from duty in the National Guard of their respective States so long as they shall remain in the active military service of the United States, and during such time shall be subject to such laws and regulations for the government of the Army of the United States as may be applicable to members of the Army whose permanent retention in the active military service is not contemplated by law. Commissioned officers and warrant officers appointed in the National Guard of the United States and commissioned or holding warrants in the Army of the United States, and affected by this order, are hereby ordered to active duty under such appointments and commissions or warrants. All officers and warrant officers of the National Guard appointed in the National Guard, federally recognized or examined and found qualified for Federal recognition, and assigned to units ordered to active duty under this order prior to the effective date hereof, who do not hold appointments in the National Guard of the United States and commissions or warrants in the Army of the United States, are hereby tendered such appointments in the same grade and arm or service which they respectfully hold in the National Guard.
