I, Thomas Cane of Kent County, Mispellon Hundred being in low state of health in bodie Calling to mind the uncertainty of life and mortality of my body that knowing that it is appointed for flesh once to Die Doe make and ordane this my last will and testament that is to principally and first of all I give and recommend my soul into the hands of Allmighty God that gave it and my body I recommend to the Earth to be Buried in a decent Christian Burial at the Discretion of my Executor nothing doubting but at the general resurection that receive the same again by the might power of god and as touching such world by estate wherewith it hath pleased god to bless me with in this life I give and dispose of the same in the following manner and first of all I Desire after my death ---- I give and bequeath unto my well beloved Sones Dannel Cane and John Cane my well beloved sones all the Land that I shall be proset (possessed?) at my Death only my well beloved wife anney (unncy?) Cain her _______ During her Le (? Life) then to be Equally Divided between My tow Sones to tham? those Heirs as assigned forever before men had I give and bequeath my well beloved son Dannel Cain one horse bridle and saddle wone bead and furniture to him his heirs forever -- I give my well beloved son John Cane won horse bridle won bed and furniture. I give my well beloved wife unice Cane the third of movable estate. I give unto my granson tilghman brown won cowe and yearling wone bed and furniture that lent my Daughter Nance brown I give and bequeath unto my Daughter Rody Cane wone cow and yearling wone bed furniture. I Desire that the Rest of my estate after my juste Detes are paid to be Equally Divided between my fore children nancy brown Dannel Cane Rody Cane John Cane. I leve My well beloved wife unncy Cane and Dannel Cane the sole execess of this my last will testement and ____ hereby ______ revoke and _______ all and every other testament will legacies bequests and Executers by me in any ways before named willed and bequeathed relating and conferring this and noe other to be my last will and testament in witness whereof I have here unto set my hand and sole this twentheth Day of october one thousand seven hundred and ninety nine ----1799. signed Thomas Cain X in the presents of us Major ____ Nimrod Morris On Novemer 15, 1799, in court: Know all Men by these Presents, That We, Unicy Cain, Daniel Cain, & Ralph Colscott of Mispellon Hundred of the County of Kent, are held and firmly bound unto the State of Delaware, in the Sum of Three Hundred Pounds current Money of the said State, we bind ourselves, our Heirs, Executors and Administrators, jointly and severally, firmly by these Presents. Sealed with our Seals, and dated at Dover in Kent, aforesaid, this fifteenth Day of November in the Year of our Lord One Thousand Seven Hundred and Ninety Nine. The Condition of this Obligation is such, That if the above bounden Mary Cain and Daniel Cain of the Hundred and County afsd Executors in the Testement and last Will of Thomas Cain late of the County aforesaid ---farmer---- deceased, do make, or cause to be made, a true and perfect inventory of all and singular the Goods and Chattels, Rights and Credits of the said deceased, which have or shall come to the Hands, Possession or Knowledge of the said Unicy Cain & Daniel Cain or unto the hands or Possession of any Person or Persons, for their use and the same so made do exhibit, or cause to be exhibited, into the Register's Office of the County of Kent, aforesaid, at or before the Fifteenth Day of May next ensuing the Date hereof, and the same Goods and Chattels, Rights and Credits, of the said Deceased, at the Time of his Death; or which at any Time after shall come to the Hands or Possession of the aforesaid Unicy Cain & Daniel Cain or into the Hands or Possession of any other Person or Persons, for them do well and truly administer, according to Law, and further do make, or cause to be made, a true and just Account of their Executorship, at or before the fifteenth day of May next which shall fall in the Year of our Lord One Thousand Eight Hundred and all the rest and Residue of the said Goods and Chattels, Rights and Credits, which shall be found remaining upon the said Executors Account, the same being first inspected and allowed of by the Register for the Probate of Wills and granting Letters of Administration of Kent County aforesaid, shall deliver and pay unto such Person or Persons, respectively, as the said Register, by his Decree or Sentence, pursuant to the true Intent and Meaning of the last Will and Testament of the said Deceased shall limit and appoint, then this Obligation to be void and of none Effect, or else to remain in full Force and Virtue.
