And further it is my will and desire that after the death of Elizabeth my wife that all of my estate which she may die in possession of both real and personal be equally divided between my daughter Eliza Ann and my son John Wesley share and share alike ___ on condition that they pay out of my estate the sum of one dollar to each of my children, that is to my daughter Mary [?] the sum of one dollar, to my to my daughter Sally Ann the sum of one dollar, to my son William Henry, the sum of one dollar, and to my daughter Elizabeth the sum of one dollar. And ____ I do constitute to my daughter Eliza Ann and my son John Wesley my Aom__? __. In witness whereof I have hereunto set my hand and affixed my seal on this 12th day of November in the year of our Lord one thousand eight hundred and fifty two. John ANDERSON, Nehemiah DRAPER Thomas CAHALL December 7th 1852 I do hereby renounce my right of Administrator to the estate of my deceased husband Henry COLESCOTT, dec’d and desire that letters may be issued to James Green. Elizabeth COLESCOTT 1852 December 7 The undersigned John W. COALSCOTT and Eliza Ann COALSCOTT children of Henry COALSCOTT dec’d and appointed Executors of the last will and testament of said deceased, do hereby renounce our right to take out letters testamentary under said will in favor of James GREEN and request that the Registar will present the said James GREEN letters of Administration and ______. Eliza Ann ______ ___[the rest lost in black space at bottom of page] _______________________________ State of Delaware John ANDERSON one of the subscribing witnesses to the Kent County SC foregoing instrument professing to be the last will of Henry COLESCOTT dec’d comes before John RAUGHLEY Register of the probate of wills and granting letters of administration of and for the said county and being solemnly sworn in the Holy Evangelists of Almighty God, deposeth and saith that he saw the said Henry COLESCOTT sign and seal the same. That at the time of his so doing he was of sound disposing mind and memory and understanding and upwards of twenty one years of age. That this deponent attested and subscribed his name to the same at the instance and in the presence of Henry COLESCOTT and in the presence of the other witnesses. Subscribed and sworn the 9th day of December 1852 before John RAUGHLEY, Regr. Signed John ANDERSON State of Delaware Nehemiah DRAPER one of the subscribing witnesses to Kent County SC the foregoing instrument perporting to be the last will of Henry COLESCOTT dec’d comes before John RAUGHLEY, Register for the probate of wills and granting letters of Administration in and for the said County and being solemnly sworn on the Holy Evangelists of Almighty God deposeth and saith that he saw the said Henry COLESCOTT sign and seal the same. That at the time of him so doing he was of sound disposing mind memory and understanding and upwards of twenty one years of age. That this deponent attested and subscribed his name to the same at the instance and in the presence of the said Henry Colescott and in the presence of the other witnesses. Subscribed and sworn the 9th day of December 1852 Before John RAUGHLEY, Regr signed Nehemiah DRAPER State of Delaware Thomas CAHALL one of the subscribing witnesses to the foregoing Kent County Sc instrument perporting to be the last will of Henry COLESCOTT, dec’d comes before John RAUGHLEY, Register for the probate of wills and granting letters of Administration in and for Kent County and being solemnly sworn on the Holy Evangelists of Almighty God deposeth and saith that he saw the said Henry COLESCOTT sign and seal the same and heard him publish pronounce and declare the same as and for his last will. That at the time of his so doing he was of sound deposing mind memory and understanding and upwards of twenty one years of age. That this deponent attested and subscribed the same at the instance and in the presence of the testator and in the presence of the other witnesses. Subscribed and sworn the 9th of December 1852 Before John RAUGHLEY, Regr. Signed Thomas CAHALL Henry COLESCOTT Be it remembered that on the 9th day of December 1852 was proved the last will of Henry COLESCOTT, dec’d of which the foregoing is a true copy, being proved as aforesaid by the subscribing of whose affidavits the above are true copies, the same were allowed by the Register and letters of Administration C t a were granted to James GREEN who was sworn and gave Bond with Garrett LUFF as his surety in the final sum of Two thousand dollars.
