All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/de/defiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Molly Majesty mydesire@gulftel.com September 6, 2008, 6:52 pm Source: Orphan Court Sussex County Written: April 6, 1826 Recorded: April 6, 1826 To Nicholas Ridgely Chancellor of the State of Delaware, composing the Orphans' Court for the County of Sussex: The petition of Frances Culleny, humbly sheweth; That John Culleny late of Sussex county aforesaid, deceased being at the time of his death, owner of a certain tract or parcel of Land situated in Broad Creek hundred containing about three hundred and fifty acres with buildings and improvements there on, adjoining land of Covington Missick and others duly made his last will and testament in writing bearing date the twenty...th day of June one thousand and eighteen hundred seventeen and...in...ly signed, (there is small writing but I think I will list just the main pre printed message) That the said John Culleney left to survive him a widow named Frances Culleney and five children; to wit: Southy Culleny, Betsy now the wife of John Tinsdal, Sally now the wife of Dolby, James Cullney and Hetty Messich now the widow of Burton Messick. That it belongs to the said Frances Cullney widow of the said testator to have one third part of said lands, tenenmens and hereditaments, during her natural life, and of the residue of said deceased's real estate, it belongs to Southy Cullney and James Culleney to have each one third part of said testertor real estate. Your petitioner terefore prays the court to appoint five sufficient freeholders of the county aforesaid, to go upon and view the lands, tenements and hereditaments of the said John Cullney, deceased and assign one-third part of sid lands, tenements, and hereditaments, to the said rances Cullney widow as aforesaid, during her natural life, according to the directioins, true intent and meaning of the acts of the General Assemble in such case made and provided. Frances made her mark. Additional Comments: The small print stated George Culleny died without heir and no Will. She also makes a bond for $1,000. to the County of Sussex 6 Sept 1825 as administratix of John Culleny, decease's goods, chattles, righs and credits. There is a list of sales of goods 17 Sept 1825. Expenses include burial expense $18.00 in 1825. Then 5 Sept 1826 Sothy and James sign for a $1,000 bond for John Culleny's good,s chattles, rights and credits???? Those accounts are paid 4 Sept 1827.
