All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/de/ ************************************************ File contributed for use in USGenWeb Archives by: Jacquelyn Chirico jaciec@comcast.net November 27, 2005, 12:43 pm Source: Delaware Archive Written: October 16, 1832 Recorded: November 1, 1832 Will drawn October 16, 1832--probated before November 1, 1832 TEXT OF MARY POYNTER DAVIS' WILL In the name of God, I Mary Davis of Cedar Creek Hundred, Sussex County, State of Delaware, now being sick and weak in Body, but of sound disposing mind and memory do hereby make and ordain this to be my last will and Testament in form and Manner as follows..viz First---I give and Bequeath to my son Peter Davis my home farm on where I now dwell or live with the improvements there to Belonging to him his heirs and assignees forever Supposed to contain one hundred and ten acres to the same more or less. Second--I give and Bequeath to my Daughter Elizabeth Hatfield wife of William Hatfield my farm where Obediah Hand now lives known by the name of Pleasant Old Field said to contain two hundred and twenty acres be the same more or less to her and her heirs and assignees forever. Third--It is my will and desire that my Daughter Jane, wife of Lofland Griffith, shall have all the Proffit arising from the farm where Lofland Griffith now lives, and on account of Lofland Griffith's misconduct heretofore. I do hereby appoint my trusted friends, Beniah Watson and Pemberton Carlisle in trust for my daughter Jane in their good judgement to take charge of said farm, and the profits arising therefrom to pay over to my daughter, Jane and if my daughter Jane should live longer than Lofland Griffith then in that case Jane shall have full possession of the premises to act and do as she may think best either to rent, sell or otherwise. Fourth-It is my will and desire that all my personal property be sold and from the amount of sales there of all my just debts be paid. Fifth-I hereby nominate and appoint my son Peter Davis and my son in law William Hatfield,, my whole and sold Executors of this my last will and testament. Revoking all other and former Wills by me made. October 16, 1832 Signed and sealed in the presence of: Mary X Davis Beniah Watson, Pemberton Carlisle, and Obadiah Hand John Shaver? Witnesses: Joseph Walton and Obediah Hand ESTATE INVENTORY Samuel Ratcliff and Beniah Watson were authorized to inventory the Goods and Chattels of Mary Davis as of October 23rd day of 1832. The will was drawn on her death bed, she signed it on October 16, 1832 and was dead before October 23, 1832. In obedience to the within warrant I do certify that Samuel Radcliff and myself did appraise the property of Mary Davis, decd and made an inventory of the property according to the best of our Judgement but since the death of said Radcliff the Inventory cannot be found. June 11th 1834 Beniah Watson Additional Comments: Mary Poynter Davis was the daughter of Ratcliff Poynter and Jane Griffith. She was the the wife of Dr. Peter Davis. All lived in Cedar Creek Hundred.
