But being old and knowing that I must shortly go to the way of all flesh I make and ordain this my Last will and testament and being of a perfect mind and sound memory and takeing into concideration my worldly Concerns I leave them in the way and maner as followes, first of all I give my Soul to God, who gave it in hopes that he will Raise it to Everlasting life and my body to be buryed by my Exctor,, hereafter named in Som Decent bural manor -and as to my worldly Estate I give and Dispose in the way and manor as followes, to wit, 1st. I give and bequeath to my Daughter Lovey Day the Sum of one Dollar to be paid to heir by my Extor,, and no more of my Estate, 2nd. I give and bequeath to my son Robert M. Smith the Sum of one Dollar and no more of my Estate, 3rd. I give and bequeath to my daugher Nancey E. Messick the Sum of one Dollar and no more of my Estate, 4th I give and bequeath to my daughter Elizabeth McCalley the sum of two Dollars and no more of my Estate, 5th. I give and bequeath to Daughter Meriah H. Prettyman one black girl by the name of Casander Pettajohn, and also my black boy by the name of Alfred Pettajohn to be Sold to Some good man by my Exetor,, and the money arising from the Sail of Said Boy to be Eaquely Divided between my two Sons Josiah S. Smith and Henery H Smith and also all the Residue of my personal property in any wise one third part. I give and bequeath to my wife Mary Smith, and the other two thirds to be Eaquely Divided between my son Josiah S. Smith and Daughter Mary A. Dolby and my son Henery H. Smith and my Daughter Meriah H. Prettyman in eaquel perportion, and I give and bequeath all my Land whereon I now live situate Sussex County and State of Delaware and in Broadkiln Hundred adjoining lands to Aron Marshal and Company and David E. Woods, and others Containing one hundred and fifty acres more or less unto my wife Mary Smith so long as she lives; and then I give and bequeath to my Son Chalton Smith a peace or parcel of my afsd Describe Lands butted and bounded as followes, Beginning at a Stake Standing in the third line of my Land turning westly from a gum bounder near the end of a Short line that Runs N 10 yr C. 16 there from said Stake on a north direction to a large persimmon tree Standing in the pine old field but, thence with the Same Corse to a Ditch and thence with said Ditch westly til it Entersects the outline of my Land and thence with the same outline on a Southly Corse adjoining to Cahlton Smith Land home to the first mentioned Stake the same containing thirty acres of land be the same more or less to him and his heirs forever, and I give and bequeath to my Son Henery H. Smith all the remainder of my land with all the houses orchards and Privilages there unto belonging [the words "containing one hundred & twenty" is crossed out] in any wise unto him and to his heois for Ever, and Lastly I leave my Son Chalton Smith the Soul Execotor of this my last will and testament giving him fill power to adjust and manage all my Concerns in any wise Disanulling all other Powers, and I William Smith Sea.
