Clelland Receiver Preemption Oct 1838 Receivers Office St. Augustine October 22 1838 Received from James Burnett of Alachua County E.F., the sum of Ninety Nine Dollars 37/100 being in full for East half of the South East quarter of Section thirteen Township Eight Range eighteen south & East, Containing seventy nine Acres & fifty hundreds of an Acre at the rate of a Dollar and twenty five Cents per Acre John C. Between James Burnett of the County of Alachua and Territory of Florida and his Wife Marcy of the first part, and John S. Taylor of the said County and Territory of the second part, Witnesseth, That the said party of the first part, for and in consideration of the sum of Two hundred Dollars, to them in hand well and truly paid, at and before the ensealing & delivery of these presents, the receipt whereof is hereby Acknowledged, have granted, bargained, sold, and conveyed, and by these presents Do grant bargain, sell, and convey, unto the said party of the second part his heirs and assigns All these certain tracts or parcels of Land Situated lying and being, in the County and Territory aforesaid and known and discribed in the Official Plats of the survey returned to the General Land Office, as the east half of the South East quarter of section Number Thirteen Township Number eight Range Number eighteen, South and east And the West half of the South West quarter of section eighteen Township eight Range Nineteen South and East, _ Together with all and singular the tenements, hereditaments and Appurtenances, whatsoever to the same belonging or in any wise appertaining., and the reversion and reversions remainder and remainders, rents issues and profits thereof, and all the Estate, Right, title interest, Dower and right of Dower, property, claim and demand in Law or equity whatsoever of the said party of the first part, of and in, to the said premises and every part thereof with the Appurtenances, unto the said party of the second part his heirs and assigns, to the only proper use and behoof of the said party of the second part, his heirs and assigns forever And the said party of the first part for themselves and their heirs, the said premises and every part thereof, against themselves their heirs, and against all and every other person or persons whatsoever to the said party of the second part his heirs and assigns, shall and will Warrant and forever defend by these presents ___ In Witness whereof the said parties of the first part, have hereunto set their hands & Seals the day and year first above written __ Signed Sealed & delivered his in presence of James X Burnett (seal) Stephen Fagan J.P. mark James McNeill Clk her Alachua County Court Marcy X Burnett (seal) mark Know all men by these presents that I Marcy Burnett Wife of James Burnett, the Grantor in the foregoing Deed, do hereby Acknowledge, that I, Signed, Sealed & executed with the intent thereby to renounce, relinquish and forever quit claim to my Dower and right of Dower to all and singular the Lands and premises in the said Deed mentioned, and that the said renunciation and relinquishment, was made freely & voluntarily and without any compulsion, Constraint, Apprehension or fear for from my said Husband __ In Witness whereof I have hereunto set my hand & seal, this thirtieth day of June One thousand eight hundred & forty her Marsey X Burnett (seal) mark Territory of Florida Alachua County Be it remembered that on this thirtieth day of June in the year of our Lord One thousand eight hundred and forty before me Stephen Fagan One the Justices of the peace of and for said County personally came before me the above named Wife of James Burnett and separately and apart from her said Husband, made and executed the above Acknowledgment ___ In Testimony whereof I have hereunto subscribed my name and affixed my seal the above day & date Stephen Fagan JP (seal) Recorded this 15th July AD 1840 James McNeill Clk Alachua County Court
