McDonell of Black Creek in the County of Duvall of the second part Witnesseth That whereas the said party of the first part, are jointly and Severally indebted unto the said party of the Second part in the just and full sum of Two hundred and fifty Dollars, lawful Money of the United States, for which said sum and the interest whereof at and after the rate of eight per Centum, they the said parties of the first part, have made and Signed their certain promissory note of even date herewith payable to the said party of the second part eight days from the date thereof.__ Now therefore the better to secure the payment of the said sum of Money in the said Note mentioned unto the said party of the second part, his heirs and assigns, and on further consideration of One Dollar to him in hand paid, by the said party of the first part, the receipt whereof is hereby confesses and Acknowledged, the said partys of the first part have granted, bargained and do hereby grant, bargain Sell release and confirm, unto the said party of the second part, his heirs and assigns, All their Estate Right Title interest and claim, in and to all that certain Lot piece or parcel of Land Situate lying and being in the Village of Newnansville and County of Alachua known and particularly in a Map of the Subdivision thereof, now on file in the Office of the Clerk of said County as Lot Number One in Block Number two of the first Range of said Village, together with all and Singular, the Tenements, Hereditaments and Appurtenances Situate thereon, and also all and Singular the Furniture of whatsoever description in the said Tenements and on the said hereby granted Tenements premises and particularly a Certain Billiard Table, now therein for the purchase money of which the said Promissory Note above mentioned is this day given ___ To have and to hold the said real and personal property above described and hereby granted and each and every of them, with the Appurtenances unto the said party of the second part his heirs and assigns, to the sole and only proper use benefit and behoof of him the said party of the second part his heirs and assigns forever _ __ Provided always, and these presents are upon the express Condition Nevertheless, That if the said parties of the first part their heirs Executors or Administrators, shall well and truly pay or cause to be paid unto the said party of the second part his executors Administrators or assigns, the said sum of money in the said Promissory Note specified with the interest thereof According to the Tenor and Effect of the said Note, then these presents and every thing therein Contained shall be null and void ___ But in case default shall be made in the payment of said sum of Two hundred and fifty Dollars or of the interest thereof or any part thereof on the day and place and in the manner specified in the said Promissory Note, then and in that case it shall and may be lawful for the said party of the second part and the said party of the first part for themselves their heirs executors and Administrators, do hereby expressly Authorize and empower the said party of the second part, to grant Bargain, Sell and convey the hereby Mortgaged Premises and every part and parcel thereof at Public Auction or Vendore, And by himself or his Attorney, to enter upon the said premises, and therefrom to carry away the said Billiard Table and other Articles of personal property and the same also to expose to public Sale, and out of the monies arising therefrom to retain to his and their own use, the said sum of Two hundred & fifty Dollars and Interest According to the Tenor and Effect of said Notes together with all the cost and charges, attending such entry Seizure and sale of the property hereby Mortgaged , rendering the overplus if any there be unto the said parties of the first part, their heirs, Executors, Administrators and Assigns __ In Witness whereof the parties to these presents of the first part have hereunto set their hands and seals, the day and year first above written Signed, Sealed & delivered Thomas Chave (Seal) in presence of William Scott (Seal) John Ricord Alachua County Personally appeared before me the fifth day of Sept'r 1840 John Ricord to me well known, who being duly sworn did depose and Say that he saw Thomas Chave and William Scott whose name are Subscribed to the foregoing Mortgage as Grantors Sign the same and that they there upon Acknowledged the same to be their respective Acts & Deeds for the uses and purposes therein contained, Whereupon he the said John Ricord Sign his name thereto as Witness at their request Sworn to before me this 5th day of September 1840 James McNeill Clk C.C.
