Between Bennet M. Dell of the Town of Newnansville in the County of Alachua and Elira D. Dell of Alachua Aforesaid, wife of the said Bennet M. Dell of the first part and Isaac June and Henry H. Holden of the same place of the second part Witnesseth, that the said party of the first part, for and in consideration of the sum of three hundred Dollars, lawful money of the United States of America the receipt whereof is hereby Acknowledged, Have granted bargained sold, Aliened, remised, released, Conveyed and confirmed, And by these presents Do grant, bargain, sell, Alien, remise, release convey and Confirm unto the said parties of the second part, and to their heirs and assigns forever All that certain Lot of Land and buildings thereon, situate in the Town of Newnansville in the County of Alachua Territory of Florida, known on a certain map or plot of said Town as Lot number two (No.2) on Block number Range Number Together with all and Singular the tenements hereditaments and Appurtenances, thereunto belonging or in any wise Appertaining and the reversion and reversions, remainder and remainders, rents, issue and profits thereof , and all of the Estate right title interest Dower and right of Dower, property, possessions, claim and demand whatsoever as well in Law as in equity of the said parties of the first part of in and to the same and every part and parcel thereof with the Appurtenances___ To have and to hold the above granted, bargained and described premises with the Appurtenances unto the said parties of the second part, their heirs and Assigns, and to their own proper use benefit and behoove forever, And the said Bennet M. Dell for himself his heirs executors and Administrators doth Covenant grant and agree to and with the said parties of the second part, their heirs and Assigns, that the said Bennet M. dell, at the time of ensealing and delivery of these presents, was lawfully seized in his own right of a good Absolute and indefeasible estate of inheritance in fee simple of and in all and Singular the above granted and described premises with the Appurtenances and has good right and full power and lawful Authority to grant bargain sell and Convey the same in manner aforesaid And that the said parties of the second part, their heirs and assigns, shall and may at all times hereafter peaceably and quietly, have hold use occupy, possess and enjoy the above granted premises and every part and parcel thereof with the Appurtenances Without any let, sait trouble molestation eviction or disturbance of the said parties of the first part, their heirs or assigns or any other person or persons lawfully claiming or to claim the same And that the same now are free clear discharged, and unencumbered of and from all former and other grants titles, charges, estates, Judgments, Taxes, Assessments and incumbrances of what nature or kind soever, And Also that the said parties of the first part and their heirs and all and every person or persons whomsoever lawfully or equitably, deriving any estate right title or interest of in or to the herein before granted premises by from under or in interest from them shall and will at any time or times hereafter upon the reasonable request and at the proper Cost and charge in the Law of the said parties of the second part their heirs and Assigns make do and execute or cause to be made done and executed all and every Such further and other lawful and reasonable Acts conveyances and assurances in the Law, for the better and more effectually vesting and confirming the premises hereby granted or so intended to be in and to the said parties of the second part their heirs and Assigns forever as by the said parties of the second part their heirs and assigns or their Counsel learned in the Law shall be reasonably Advised or required And the said Bennet M. Dell his heirs the above described premises and every part and parcel thereof with the Appurtenances unto the said parties of the second part their heirs and assigns, Against the said parties of the first part and their heirs and against all and every person and persons, whomsoever lawfully claiming or to claim the same, Shall and will Warrant and forever defend. ___ In Witness whereof the parties to these presents have hereunto set their hands and seals the day & year first above written Signed Sealed & delivered Bennett M. Dell within named do hereby release relinquish and renounce unto Isaac June and Henry H. Holden within named all my Dower and right of dower of in and to the within mentioned and described premises, And I hereby Acknowledge that such relinquishment and renunciation of Dower is made freely and voluntarily and without any Compulsion Constraint Apprehension or fear of or from my husband Witness my hand and seal at Newnansville Alachua County this eighth day of December AD 1840 Witness S. Dell (seal) Philip Dell Alachua County On the twelfth day of December One thousand eight hundred and forty, before me one of the Justices of the peace of said County personally came and appeared Bennett M. Dell and Elira D. Dell to me personally known and known to me to be the persons mentioned & described in and who executed the foregoing instrument and they severally Acknowledged they executed the same, for the uses and purposes therein mentioned And the said Elira D.Dell was examined by me privately, Separate & apart from her said Husband and on such examination she Acknowledged that she executed the within instrument and the foregoing renunciation freely and voluntarily without any Compulsion Constraint Apprehension or fear of or from her said Husband S.
