Fernandez on the one part, and Thomas Ledwith on the other part, both of the above County and territory Witnesseth That the said Stephen D. Fernandez party of the first part for and in consideration of the sum of Two hundred and Fifty Dollars, lawful money of the United States to him in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged hath granted, bargained, and Sold, and by these presents do grant, bargain, sell and convey unto the said Thomas Ledwith party of the second part, All his right, claim, Interest and title, in and to, One half of a certain Tract of Land ( purchased by said Fernandez, from John L. Villalonga, heired by Villalonga in the right of his wife Jane C. Villalonga, formerly Jane C. Fernandez) Situated lying and being on the St. Johns River, and in the County of Alachua, containing One thousand One hundred & twenty five Acres, and discribed by the Deed given by John L. Villalonga to Stephen D. Fernandez, and recorded in the County Court of Alachua County as follows, Three hundred and Seventy five Acres on Coolys Hammock, on the Trail running from the Natural Bridge of the Santaffee River to the Town in Alachua County called Hog Town, and Trail known as Rays Trail, Three hundred and seventy five Acres on Moodys Hammock, on the road running from Paynes Town to the Oclawaha Creek, and Three hundred and Seventy five Acres on the West side of the St. Johns River above Bernards ferry, and at a place called Simefelokey crossing place. To have and to hold, said One thousand One hundred and twenty five Acres of Land, unto the said Thomas Ledwith his heirs and Successors, together with all and Singular the rights to members and Appurtenances to the same in any manner belonging, to his and their proper use and behoof forever, And the said Stephen D. Fernandez for himself his heirs Executors, Administrators and assigns the said bargained premises unto the said Thomas Ledwith, his heirs Executors Administrators and assigns, Will Warrant and forever defend the rights and title thereof Against himself his heirs, Executors, Administrators and assigns, and against John L. Villalonga his heirs, executors, Administrators & assigns, But not Against the claim or claims of any other person or persons not herein mentioned, this being altogether a quit claim Sale For Testimony whereof the said Stephen D. Fernandez, hath hereunto set his hand and Seal the day and year aforewritten _ Signed sealed and Stephen D. Fernandez (L. S.) delivered in presence of M.S. Evans Moses Drury Territory of Florida Duval County Know all men by these presents that Eliza Fernandez, wife of Stephen D. Fernandez freely grantor to the foregoing Deed of conveyance of real Estate to Thomas Ledwith, Do hereby renounce relinquish and release all my right of Dower, in and to the Land tenements etc in said conveyance unto Thomas Ledwith freely Granted ___ In Witness whereof I have hereunto set my hand and seal this fifth day of September A.D. 1839 Witness E.L. Evans Mosses Drury Duval County Be it remembered that on this the fifth day of September A.D. 1839, personally appeared before me the Subscriber, the Judge of the County Court in and for the said County, Stephen D. Fernandez, who Acknowledged that he had Signed, Sealed and delivered the foregoing Deed, as and for his act and deed for the purposes therein mentioned, and the Lands Tenements etc therein Conveyed to the right and property of the said Thomas Ledwith party grantee __ And also at the same time appeared Eliza Fernandez Wife of aforesaid Stephen D. Fernandez Who being by me examined by me privately and apart from her said Husband, she did then and there Acknowledge that she had signed, Sealed and delivered the foregoing renunciation, relinquishment and release of Dower, and that she had done the same freely Voluntarily, and without any compulsion Constraint, Apprehension, or fear of or from her said Husband and that she wished not to retract it __ Given under my hand and seal this fifth day of September in the year of our Lord One thousand eight hundred and Thirty nine _ P.L.
