All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/fl/flfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jim Powell, http://www.genrecords.net/emailregistry/vols/00030.html#0007445 April 1999 "Transcribed by Jim Powell Jr from Records provided by Buddy Irby, Alachua County Clerk of the Court's Office" Page 398-401 Whereas Gad Humphreys of the City of St. Augustine County of St. Johns East Florida Stands indebted to the Southern Life Insurance and Trust Company, in the following sums of Money, that is to say, in the sum of five hundred Dollars agreeable to the tenor of his certain promissory Note to one George Center, and endorsed by him and David Dunham bearing date the twenty Sixth day of August in the year of our Lord One thousand Eight hundred & thirty nine with interest from the date thereof, And in the further sum of Five Hundred and forty nine Dollars and seventy five Cents being the amount of a Judgment rendered in favour of the said Southern Life Insurance and Trust Company in the Superior Court at St. Augustine, East Florida Aforesaid, on the twentieth day of November in the year of our Lord One thousand eight hundred and forty with interest thereon from the date thereof ____ Now this Indenture made this twenty third day of April in the year of our Lord One thousand eight hundred and forty one at the City of St. Augustine Aforesaid between the said gad Humphreys Aforesaid of the first part, and George Field President of the said Southern Life Insurance and Trust Company of the second part. Witnesseth that the said Gad Humphreys for and in consideration of the premises and the better securing to the said George Field President as aforesaid of the Southern Life Insurance and Trust Company and to his Successors in Office and assigns, the payment of the said several Sums of money above mentioned with the interest thereon Accrued and to Accrue, and of the sum of Ten Dollars to him in hand paid by the said George Field President Aforesaid at and before the sealing and delivery of these presents, the receipt thereof is hereby Acknowledged, hath granted, bargained, Sold Aliened and conveyed, and by these presents, doth grant bargain, Sell, Alien and convey, unto the said George Field his Successors in Office and assigns, All that tract of Land being an undivided moity of a certain tract of land containing fifteen hundred Acres, Situated in a place called the Big swamp or Hammock in the County of Alachua Originally granted to Antonio Alvarey by the Spanish Governor Don Sost Cappinger on the seventh day of December in the year of our Lord One thousand eight hundred and seventeen and which said undivided moity is the same that was conveyed by the said Antonio Alvarey to the said Gad Humphreys on the thirteenth day of August in the year of our Lord One thousand eight hundred and twenty five by Deed bearing date the day and year last aforesaid, which said Deed was recorded in the Office of Record of the County of St. John on the first day of September in the year of our Lord One thousand eight hundred and twenty five And Afterwards in the Office of record in the County of Alachua, Together with all and Singular the tenements hereditaments and Appurtenances whatsoever to the same belonging, or in any wise Appertaining and the reversion and reversions, remainder and remainders, rents, issue and profits thereof, To have and to hold the above bargained and described premises unto him the said George Field and to his Successors in Office and Assigns forever Provided Nonetheless and these presents are upon this express Condition, that if the said Gad Humphreys shall well and truly pay or cause to be paid unto the said George Field President Aforesaid of the said Southern Life Insurance and Trust Company or to his Successors in Office or Assigns the said several sums of Money hereinbefore mentioned and the interest thereon Accrued and to accrue the twenty fourth day of October next ensuing the date of these presents, then these presents and every matter and thing herein contained shall cease determine and become void, Otherwise to remain in full force and effect __ ___ In Witness whereof the said Gad Humphreys hath hereunto set his hand and seal this said twenty third day of April in the year of our Lord One thousand eight hundred and forty one Signed Sealed & delivered G. Phillips B.A. Putnam Know all men by these presents that I Mary Humphreys wife of the said Gad Humphreys party of the first part to the foregoing Deed of Mortgage conveyed in consideration of the sum of Ten Dollars to me in hand paid by the said George Field President Aforesaid of the said Southern Life Insurance and Trust Company, party of the second part, to said Deed, at and before the Sealing and delivery of these presents, the receipt whereof I hereby Acknowledge have remised released, renounced and relinquished and forever quit claim and by these presents, do remise, release, renounce & relinquish and forever quit claim, unto the said George Field President Aforesaid of the said Southern Life Insurance and Trust Company and to his Successors in Office and assigns, Subject Nevertheless to the Proviso in said foregoing Mortgage conveyance all my Dower & right and title of Dower, which I may at any time hereafter have claim or demand, of in to or out of all and Singular the said premises in said Mortgage conveyance mentioned and described ___ In Witness whereof I have hereunto set my hand & seal this twentieth day of June in the year of our Lord One thousand eight hundred and forty one Signed Sealed & delivered in presence Mary S. Boutair City of St. Augustine County of St. John I Mary Humphreys wife of said gad Humphreys do hereby Acknowledge and declare that I executed the said foregoing relinquishment and renunciation of Dower freely and Voluntarily, and without any constraint, compulsion Apprehension, or fear of or from my said Husband ____ In Witness whereof I have hereunto set my hand & Seal this 12th day of June in the year of our Lord One thousand eight hundred and forty one ___ Mary S. Boutair a Justice of the Peace in and for the County of St. John East Florida at St. Augustine Aforesaid well known to me as the wife of said Gad Humphreys, and as the person who executed the said foregoing relinquishment and renunciation of Dower Mary Humphreys and being examined separate and apart from her said Husband, Acknowledge that she did execute said relinquishment and renunciation of Dower, freely & Voluntarily and without any Compulsion, Constraint Apprehension or fear of or from her said Husband __ __ Witness my hand at the City of St. Augustine this twelve day of June in the year of our Lord One thousand eight hundred and forty one Peter B. Boutair Jus. Of Peace City of St. Augustine County of St. John Personally appeared before me Justice of the Peace in and for the County of St. John, Col. Gad Humphreys known to me as the person, whose signature is affixed to the annexed Deed of Mortgage & Conveyance, and Acknowledged that he Signed Sealed and delivered said Mortgage and Conveyance for the purposes therein stated, Witness my hand at St. Augustine E.
