Hanson of the same place of the second part. Whereas the said Gad Humphreys was on the twenty second day of January One thousand Eight hundred and thirty one indebted unto the following persons in the following sums of money that is to say unto Lieu't F.D. Newcomb of the United States Army in the sum of four hundred and fourteen dollars on the draft of the said Gad Humphreys with interest from the time the same became due; to Abraham Bellamy by the Note of the said Gad Humphreys in the sum of two hundred dollars with interest from the time it became due; to the above named John M. Hanson by Book Account in the sum of sixty on dollars and ninety six cents; to Isaiah J. Hart of Jacksonville in the sum of Eighty dollars and unto James baker in the sum of two hundred dollars with interest; and whereas the said Gad Humphreys did on the twenty second day of January one thousand Eight hundred & thirty one for the purpose of paying the said debts assign to the said John M. Hanson the wages of certain Negroes then recently hired to Dan'l S. Griswald by the said Gad Humphreys and whereas although a part only of the said wages of the said Negroes have been received by the said John M. Hanson , he may have rendered himself responsible to the above named creditors of the said Gad Humphreys so far as their respective claims remain unsatisfied; and whereas the said John M. Hanson hath at the request of the said Gad Humphreys relinquished his right under the aforesaid assignment to receive the balance of the wages owing by the said Daniel S. Griswald for the said Negroes; and whereas it is reasonable and proper not only that the said John M. Hanson should be secured against all claims on the part of the above named creditors of the said Gad Humphreys growing out of the aforesaid assignment , but that the said Creditors of the said gad Humphreys should be secured in their just demands against him. Now therefore this Indenture Witnesseth that the said Gad Humphreys for and in consideration of the premises and in consideration also of the sum of Ten dollars by the said John M. Hanson to him in hand well and truly paid at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged Hath granted bargained sold, transferred, and delivered and by these presents doth grant bargain, sell transfer, and deliver unto the said John M. Hanson, his executors Administrators and assigns forever his certain Negro Slaves, following that is to say Sampson aged about twenty four years Katy aged about Eighteen years and Bob aged about ten years with the future issue and increase of the said female Slave. To have and to hold the said Slaves and future increase and issue of the female Slave unto the said John M. Hanson his executors administrators and assigns forever, in trust nevertheless and to and for the special uses purposes and intents, hereinafter mentioned, that is to say, that the said John M. Hanson his executors or administrators shall cause the said Negro Slaves to be sold in front of the court house in the City of St. Augustine to the highest bidder for cash at Public Auction on any day he may think proper in the month of January One thousand Eight hundred and thirty three after the tenth day of said month provided the said Gad Humphreys or his executors or administrators shall not have paid and satisfied in full the debts owing by him as herein above specified and shall not have produced to the said John M. Hanson his executors or administrators satisfactory evidence of the payment of said debts on or before the first day of January One thousand Eight hundred and thirty three and provided also that public notice posted at the aforesaid court house or published in the newspaper of St. Augustine of the time and place of the sale of the said negroes, shall have been given for at least one week previous to the said sale, and that first from the proceeds of the sale of the said Negroes the said John M. Hanson his executors or administrators shall reimburse to himself or themselves all such costs charges & damages as he or they may or shall have been put to or have received by reason of the aforementioned assignment and the and the relinquishment thereof by the said John M. Hanson and that secondly from the proceeds of the sale of the said Negroes the said John M. Hanson shall immediately pay and discharge the aforesaid debts or such part thereof as shall be unpaid or owing as aforesaid by the said Gad Humphreys together with the expenses occurred in carrying into effect the provision of this indenture so far as the said proceeds will extend and that the said John M. Hanson or his executors or administrators shall pay over the residue of said proceeds if any there shall be to the said Gad Humphreys his executors administrators or assigns and the said John M. Hanson doth by these presents covenant promise and agree to allow and pay to the said gad Humphreys his executors administrators or assigns ten dollars per month for the Labor of the said three Slaves for such time as they shall actually work for him and to find them in provisions the said Gad Humphreys hereby agreeing to be at the expense of clothing the said Negroes and in case of sickness of such medical aid as the said John M. Hanson shall think they require and shall furnish. In witness whereof the parties of to these presents have hereunto set their hands and seals the day and year first above written _ Signed Sealed and delivered in presence of us Witnesses G. Hanson for himself his executors and administrators doth hereby further covenant and agree to and with the said Gad Humphreys his executors and administrators that if the said Gad Humphreys shall and do pay and discharge the aforesaid debts and furnish to the said John M. Hanson or his executors or administrators satisfactory proof thereof on or before the first day of January One thousand Eight hundred and thirty three so that a sale of said Negroes shall not take place in virtue of these presents he the said John M. Hanson or his executors or administrators shall and will reconvey and deliver the said Negroes to the said Gad Humphreys or to his executors administrators or assigns so soon as the said John M. Hanson or his executors or administrators shall be repaid and reimbursed from the labor of said Slaves or otherwise all such damages Costs expenses and charges as the said John M. Hanson or his executors or administrators shall have been put to or have suffered by reason of the aforesaid assignment and the relinquishment thereof as aforesaid or which may have arisen from the making of these presents or the carrying the provisions of the same into effect and it is hereby agreed between the said parties that this clause and the covenants and agreements therein contained shall be considered and taken as a part of the foregoing indenture precisely as if the same had been inserted therein. In witness thereof the said parties of have hereto set their hands and seals the ninth day of January One thousand Eight hundred and thirty three Sealed and Delivered G. Hanson (Seal) John Ker Territory of Florida St. Johns County On the first day of February 1832 John Ker the subscribing witness to the within instrument of writing came before me the subscribe clerk of the county court for the County and Territory aforesaid and made oath that Gad Humphreys and John M.
