Witnesseth that the said party of the first part for and in consideration of the sum of two thousand eight hundred and sixty three dollars lawful money of the United States to be paid by the said party of the second part to Thomas Gibbon of the City of New York And in Consideration of the further sum of nine thousand dollars of like money to them in hand paid at or before the ensealing of and delivery of these presents by the said party of the second part the receipt whereof is hereby Acknowledged and the said parties of the first part therewith fully satisfyed Contented and paid have remised released and quit claimed and by these Presents do remise release and quit claim unto the said party of the second part and to his heirs and assigns forever Twelve thousand acres of land being an undivided part of thirty thousand acres, which thirty thousand acres of land is an undivided part of a large tract of Land containing two hundred and eighty nine thousand six hundred and forty five acres & five sevenths of an acre situated lying and being in the Alachua Territory in East Florida West of St. Augustine as by reference to the grant made to Don Fernando de la Maza Arredondo & Son of the said tract by the Spanish Government which Grant is dated Havanna on the twenty second day of December in the year of our Lord one thousand eight hundred and seventeen will more fully appear the said large tract of two hundred and eighty nine thousand six hundred and forty five acres and five sevenths of an acre is to be divided into twelve parts and these parts to be balloted for by the parties interested in the division to be made Together with all and singular the hereditaments and Appurtenances thereunto belonging or in any wise appertaining and the remision and remisions remainder and remainders rents issues and proffits thereof and also all the estate right title interest *** dower and right of dower property possession claim and demand whatsoever as well in law as in Equity of the said parties of the first part of in or to the above released remised and bargained premises and every part and parcel thereof with the Appurtenances to have and to hold all and singular the premises above discribed and released together with the Appurtenances unto the said party of the second part his heirs and assigns forever subject nevertheless to the payment of the said sum of two thousand eight hundred and sixty three dollars to the said Thomas Gibbons as aforesaid and the said Elisha Huntington for himself his heirs executors and administrators and for each and every of them doth covenant promise and agree to and with the said party of the second part his heirs and assigns by these presents that he hath not made done committed executed or suffered any act or acts thing or things whatsoever whereby or by means whereof the said above mentioned premises or any part or parcel thereof now or at any time hereafter is or shall be impeached charged and incumbered in any manner whatsoever except as to the said sum of two thousand eight hundred and sixty three dollars as aforesaid In Witness whereof the said party of the first part have hereunto set their hands and seals the day and year first above written sealed and delivered Elisha Huntington L in presence of Edward Vanhess Maria E. Huntington his wife satisfactorily proven to me to be the persons mentioned in and who subscribed the foregoing instrument of writing and the said Elisha Huntington did Acknowledge that he had executed the same as his voluntary act and deed for the use and purposes therein mentioned and the said Maria E. Huntington having been by me examined privately and apart from her said husband she did Acknowledge that she had executed the same without any fear threats or compulsion on the part of her said husband as her voluntary act and deed for the use and purposes therein mentioned In testimony whereof I have hereunto subscribed my name and have caused the seal of Mayoralty of said City to be affixed the day and year above written (L.
