Levy of the City of St. Augustine, East Florida party of the first part and Peter S. Smith of the same place, party of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of six thousand Eight hundred and seventy five Dollars to him in hand paid by the said party of the second part at and before the sealing and delivery of these presents the receipt whereof is hereby Acknowledged hath granted bargained, sold Aliened and Conveyed and by these presents doth grant bargain, sell, Alien and Convey unto the said party of the second part and to his heirs and assigns forever, All that certain Land herein after mentioned and more particular described, that is to say, All that certain tract of land which was originally granted by Governor Coppinger to Don Duan De Entralgo by grant bearing date the fifteenth day of November in the year of our Lord One thousand eight hundred and seventeen And described in and by said grant as being situated about thirty miles west of the (then) Port at Buena Vista upon the River St. Johns at the place known as the Water Pen its Measurement commencing on the **** of a Large Pond which is found at said place bounded on all sides by Royal or Public Land containing one thousand Acres and situate in the County of Alachua, said tract of land was after wards , to wit, on the ninth day of September in the year of Our Lord one thousand eight hundred and nineteen in virtue of a previous special order for that purpose given, surveyed by Don Andrews Busquine And a plat thereof made and certified by him A claim to which was duly submitted to the Commissioners of land Claims and confirmed by them all which documents and proceedings will be seen by References to the Office of the Public Archives in the City of St. Augustine aforesaid and which said tract of land was among others, sold and conveyed to the said party of the first part by one Don Duan De Entralgo by deed bearing date the sixth day of August in the year of our Lord one thousand eight hundred and four Recorded in the Office of Clerk of the County Court of St. Johns County on the ninth day of August 1824 in Book E, page seventy six and by a written Deed of Conveyance made and dated the seventh day of December (1825) in the year of our Lord One thousand eight hundred and twenty five Recorded by the said Don Duan De Entralgo and his wife Fideltas de Almauzar Recorded in the aforesaid Office of the County Clerks of St. Johns County in Book G page (50) which said tract of land according to the said Survey is entered in Township ten, Range twenty three South and East and supposed to be in section three ten fifteen and sixteen as appears by Reference to the Survey of the Public land, but which the said part of the first part does not warrant as said Lands may be located in part in other sections And also the following - Said to wit, lots from section eight township ten Range twenty three south and east one hundred and ninety 52/100 acres Also lots one two six & seven section seventeen Township ten Range twenty three south and east One hundred and seventy five 21/100 acres purchased by the said party of the first part from the Register and Receiver of the Land Office at St. Augustine aforesaid on the twenty first day of March in the year of our Lord one thousand eight hundred and twenty nine as appears by the Official Receipts of that date Together with all and singular the tenements, hereditaments and Appurtenances whatsoever to the same belonging or in any wise appertaining. And the reversion & reversions remainder and remainders And the rents issues and profits thereof and of every part and parcel thereof and also all the estate, right, title interest, profits Claims and Demands whatsoever both at Law and in equity of the said party of the first part in, to or out of the said Lands tenements and hereditaments and premises - To have and to hold the said Land tenements and hereditaments and all and singular the premises before mentioned With the appurtenances unto the said party of the second part and to his heirs and assigns forever And the said party of the first part doth hereby for himself his heirs executors and Administrators Covenant promise and agree to and with said party of the second part his heirs executors Administrators and assigns in manner and form following, that is to say that the said party of the second part his heirs and assigns, shall and may peaceably and quietly have hold and enjoy the said Land premises and every part and parcel thereof with the let suit trouble, eviction, disturbance of the said party of the first part his heirs or assigns or of or by any other person or persons lawfully claiming or to claim the same from, and that he the said party of the first part will as soon as practible ****** council and in due form of Law __ Discharge all and every incumberance whatsoever of and from said first of One thousand Acres and will take immediate steps to have the same done and Effected. And the said party of the first part And his heirs and all and every person or persons having or lawfully claiming any estate right title or interest of in or to the said Lands tenements hereditaments and premises or any part or parcel thereof by from or under him shall and will from time to time and at all times hereafter upon the reasonable request And at the proper costs and charges of the said party of the second part his heirs or assigns make do or acknowledge and execute or cause and *** *** to be done acknowledged and executed all and singular any such written and other act and acts thing and things Conveyance and assurances in law whatsoever for the further and better and more effectively conveying securing and and better assuring of all and singular the premises herein before mentioned or intended ded to be herein conveyed with and every of their rights members and appurtenances to the only proper use and behoof of the said party of the second part his heirs and assigns forever as by the said party of the second part his heirs and assigns or his or their Council Learned in the Law shall be reasonable devised advised or required And the said party of the first part and his heirs and assigns all and singular the aforesaid Lands tenements hereditaments and premises and every part and parcel thereof unto the said party of the second part his heirs and assigns against him the said party of the first part his heirs and assigns shall and will warrant and forever defend by these presents.
