Levy of the City of St. Augustine, in said Territory, of the first part and John M. Hanson, also of the said City and Territory of the second part _ Whereas the said Moses E. Levy is justly indebted to the said party of the second part, in the sum of twelve Hundred Dollars, Lawful money of the United States, secured to be paid by a bond or Obligation, bearing even date herewith in the penal sum of Three Thousand Dollars lawful money aforesaid, conditions for the payment of the said first mentioned sum of Twelve Hundred Dollars payable on the first day of May in the year of our Lord one Thousand eight hundred and Thirty three with the lawful interest thereon, as in the said Bond or Obligation is specified, and will fully appear. Now this Indenture, Witnesseth That the said party of the first part, for the better securing of the said sum of money according to the condition of the said bond or Obligation, and in consideration of One Dollar to him in hand paid, by the said party of the second part, the receipt whereof is hereby acknowledged, hath bargained, sold, aliened, released, conveyed and confirmed and by these presents, do grant, bargain, sell, alien, release, convey, and confirm unto the said party of the second part, his heirs and assigns forever: All that certain tract or parcel of land consisting of Two Thousand acres, situated and being in the Great Hammock or Ensimal Grande on the Okeloka Creek in that part of the Territory Known by the Spanish Government as the Alachua County, and since called St. Johns County but now Known to be within the county of in the district of east Florida, which said tract or parcel of land was granted to one Donna Catalina de Jesus de los Flijuelos by the Spanish Government by Royal title or absolute grant, bearing date o**** seventh day of December One thousand eight hundred and seventeen; and by the said Donna Catalina de Jesus de los Flijuelos conveyed to said party of the first part by ***** bearing date on the tenth day of February in the year one thousand eight hundred and twenty five, and recorded ** the office of the clerk of the County of St. Johns in Book E page 315: and all the woods, underwoods, trees ***** watercourses, profits, commodities, advantages, hereditaments, rights, members, and appurtenances whatsoever **** land belonging, or in any wise appertaining; and reversion and reversions, rents, issues and profits of ***** and every part and parcel thereof; And also all **** , right, title, interest, claim and demand whatsoever and ****** Kind, both in law and in equity of him the said party of the first part, of, in and to the same; and the reversion and reversions, remainder and remainders, rents, issues and profits thereof ____ To have and to hold all and singular the **** before granted and released premises, with the appurtenances unto the said party of the second part, his heirs and assigns *** only proper use, benefit and behoof forever. ****** always, and these presents are upon this condition nevertheless, that if the said party of the first part, his heirs executors or administrators, or any of them, shall well and truly **** to the said party of the second part, his heirs executors administrators or assigns, the said sum of money mentioned in the condition of the aforesaid Bond or Obligation *** the time and in the manner therein specified accord***** true interest and meaning thereof, that their and *** thenceforth these presents, and the estate hereby granted **** every thing herein contained, shall cease d***** and be absolutely void to all intents and purposes And the said Moses E. Levy for himself, his heirs executors and administrators, doth covenant grant promise and agree to and with the said Party of the second part, his executors, administrators and assigns, that he the said Moses E. Levy shall and will well and truly pay to the said party of the second part, his executors, administrators or assigns, the said sum of money, and the lawful interest accruing, at the time and in the manner herein before mentioned, according to the condition of the said Bond or Obligation In Witnesseth whereof, the parties to these presents have hereunto set there hands and seals the day and year aforesaid Sealed and delivered Moses E. Levy (Seal) in the presence of J.M. Hanson (Seal) E.B. Gould John Ker Territory of Florida County of St. Johns Be it remembered that on the twenty sixth day of October 1832, the above named Moses E. Levy and John M. Hanson came before me, to whom they are personally Known and acknowledged that they respectively signed and sealed and Delivered the above instrument of writing to which their signatures are affixed, for the uses and purposes therein expressed.
