McNeill is justly indebted to the said party of the second part, in the sum of Three thousand One Hundred and Eighty two Dollars Current money of the United States of America, Secured to be paid in and by a certain Bond or Writing Obligatory bearing even date herewith executed by the party of the first part, as by said Bond or Writing Obligatory, reference being thereto had will more fully appear ____ Now this indenture Witnesseth that the said party of the first part, for the more perfect security of the payment of the said money, according to the true interest and meaning thereof, and in consideration of one Dollar in hand paid, at and before the ensealing and delivery of these presents, hath granted, bargained, sold, Aliened , released, conveyed and confirmed, and by these presents, do grant Bargain, Sell, alien, release, convey and Confirm, unto the said party of the second part, and to his successors in office and assigns forever, all those certain Slaves of him the said Archibald McNeill following to wit, George, a male aged thirty five years, Ebenarzer, a male aged Twelve years, Sampson, a male aged Five years, Philida, a female aged Twenty eight years, Beck, a female aged three years, Ann, a female Twenty Seven years, Peggy, a female aged Eighteen years, Dorcas, a female aged thirty years, Rose, a female aged fourteen years, and Lydia, a female aged Twenty years ____ Together with all and Singular the future increase of said female Slaves. ___ __ Together with all and Singular the tenements, heritaments and appurtenances, thereunto belonging and the reversion and reversions remainder and remainders, rents, issues and profits thereof, and the Estate, right, title, interest, dower and right of dower, property claim and demand in law or equity, of the party of the first part. To have and to hold the above bargained premises unto the party of the second part, his successors and assigns, to the sole and only use of the party of the second part his successors and assigns forever____ Provided always, and these presents are upon this express condition, that if the party of the first part, his Executors or Administrators shall and do well and fully pay or cause to be paid unto the said party of the second part, his successors or assigns the said sum of money mentioned and specified in the said Bond or Writing Obligatory and the interest thereof according to the ten or and effect, true intent and meaning of the said Bond or writing Obligatory and According to the covenants and agreements herein after contained then and from thenceforth, these presents and the estate hereby granted Shall cease determine, and be utterly null and void. And the said parties of the first part, covenant__ grant__ promise and agree to and with the party of the second part , and his successors and assigns, the said sum of money with lawful interest there on, as the time and or the manner Specified, that is to say, The said principal Sum of Three Thousand One hundred and eighty two Dollars, on or before the Expiration of Three years from the date hereof, with the interest to grow due there on. Time == Annually on the first days of January & July in each and every year, shall and will well and truly pay or cause to be paid to the party of the second part, his successors in office or Assigns. _______ And it is hereby mutually covenanted and agreed by & between the parties of these presents, that if default shall be made in the payment of the aforesaid sum, or the interest or any part or parts thereof, at the time, and or in the manner specified__ That then it shall be lawful for the party of the second part, or his Successors or Assigns, to enter unto and upon the premises, and take possession of the whole or any part of the same, and grant, sell and bargain the same, and all of the benefits, and equity of redemption of the of the party of the first part his heirs or assigns, or any person claiming by through or under them at public auction, to the highest bidder, according to the manner prescribed by the Act of the Legislative Council of Florida, entitled, An Act to incorporate the Southern Life Insurance and Trust Company And as the Attorney of the party of the first part, for that purpose by these presents, duly authorized to make, seal execute and deliver, to the purchaser or purchasers thereof, a good and valid deed or deeds of conveyance in law, in fee simple for the same to retain the principal and interest of the moneys then in arrear and unpaid and all the cost of charges and of advertisements. Sale and other expenses in the premises, rendering the Overplus (if any) to the party of the first part, or his legal representative on demand, Which sale so to be made shall be a perpetual bar both in law and equity, against the party of the first part, and all persons claiming by through or under him, And the party of the first part hereby Covenant and agree, to and with the party of the second part, his Successors in Office and Assigns, that the said party of the first lawfully is Seized, of a perfect, Absolute, indefeasible estate of inheritance, in fee simple of in and unto said premises ___ ___ ___ In Witness Whereof the party of the first Sealed and delivered part has hereunto set his hand & Seal the day and year In presence of first above mentioned S.L. Reed Territory of Florida Duval County Be it remembered that on this third day of October, in this year of our Lord One thousand eight hundred & forty, Before me Harrison R. Blanchard a Justice of the Peace in and for said County duly Commissioned and Qualified, personally came Samuel L. Burritt one of the subscribing Witnesses to the foregoing Deed of Mortgage who being duly sworn, declares and says, that he saw Archibald McNeill The Mortgager in the said Dedd, Sign, Seal and deliver the same for the purposes in the said Deed mentioned, and that he the said Samuel L. Burritt & A.M. Reed Witnessed the same and Subscribed their names as Witnesses thereto, in the presence of the said Arch. McNeill and in presence of each other, at the time of the execution thereof. __ Sworn to & Subscribed S.L. Burritt Before me, the day & year Above written H.R.
