All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/fl/flfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jim Powell, http://www.genrecords.net/emailregistry/vols/00030.html#0007445 April 1999 "Transcribed by Jim Powell Jr from Records provided by Buddy Irby, Alachua County Clerk of the Court's Office" Page 230-236 To all to whom these presents shall come be seen or made known I Thomas Napier of Charleston in the State of South Carolina Send Greeting Whereas I the said Thomas Napier am indebted to James Hibben Junior Trustee of Rebeckah Napier in the sum of Twenty thousand one hundred and thirty four dollars and nineteen cents in and by my certain promissory note bearing date the twenty first day of July in the year of our Lord One thousand eight hundred and thirty four and payable on demand as in and by said the said promissory note references being there unto made will more fully appear Now Know all men that I the said Thomas Napier in consideration of the said debt and sum of money and for the better securing the payment thereof to the said James Hibben Junior Trustee as aforesaid and also in consideration of the sum of five dollars to me the said Thomas Napier in hand well and truly paid by the said James Hibben Junior as aforesaid and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged Have granted bargained sold and released and by these presents do grant bargain sell and release unto the said James Hibben Junior Trustee as aforesaid all that piece parcel or tract of land situate lying and being in the Territory of East Florida on the west side of the Hillsborough River otherwise called Mosquito South lagoon containing One thousand Acres granted by the Spanish Government to George I. F. Clarke on the third day of May in the year of Lord one thousand eight hundred and sixteen and ******* is lade out and limited by the following lines that is to say by a line commencing near an old path or crossway and running along the East edge of Mr. Dougalls alias Turnbulls Swamp to another line corse North thirty five west and distance one hundred and eleven chains to a live oak, South sixty five degrees west, ninety and a half chains, thence by another line running parallel to the first from the said live oak to a line South thirty five degrees East one hundred and eleven chains, thence by an other line running parallel to the second line from the said line to the line of commencement North sixty five degrees East ninety and a half chains Bulling and Bounding to the North on lands of William Hale to the South on lands of Robert Mae Hardy and to the east & west on Vacant lands having suc such shape form and marks corners and distances as are discribebed in a plat of the said said tract made by Don Andrew Busginin Surveyor on the twenty day of April in the year of our Lord One thousand eight hundred and nineteen and recorded in the Office of the secretary of government at St. Augustine on the eighth day of May in the year of our Lord one thousand eight hundred and nineteen a copy of which is annexed to the conveyance of the said tract of land by the said George I.F. Clarke tome the said Thomas Napier. Also all that other piece parcel or tract of land situate lying and being in the Territory aforesaid On the West side of the Lagoon of the river by otherwise called Indian River at a place called Flounder Creek lying to the northwest of the ***** over or crossing over place from the Hillsborough River to the Indian River containing one thousand acres which said tract of land was purchased by the said George I.F. Clarke from William Garvin on the eighth day of January in the year of our Lord one thousand eight hundred and twenty one Southernmost mority or half part of a tract of two thousand acres granted by the Spanish Government to the said William Garvin on the twenty sixth day of November in the year of our Lord one thousand eight hundred and seventeen and which is set out and limited by lines following that is to say by a line commencing and ending at a cabage tree corse North twenty five five degrees west and distance fifty chains and thence by another line beginning at the East cabbage Tree & running south sixty nine degrees West two hundred chains to a pine tree thence by another line to an other line South twenty four degrees East fifty chains, thence by an other line to the cabbage tree at the beginning, commencement, north sixty nine degrees East Two hundred chains Bulling and Bounding to the north on lands of William Garvin to the south on lands of Charles Clarke to the east by the marshes of the Indian river and on the west by vacant pine land having such shape form marks corners and distances as are designated in a plat of the said tract made by the said George I.F. Clarke Surveyor General of the said province on the sixteenth day of December in the year of our Lord one thousand eight hundred and seventeen and recorded among the public records thereof a copy of which is annexed to the conveyance of the said tract of land by the said George I.F. Clarke to me the said Thomas Napier ___ Also all that peace parcel or tract of land situate lying and being in the said Territory of East Florida in Alachua Hammock on the west side of Paynes Savannah Alachua Territory containing one thousand Acres being the mority or half part of a tract of two thousand acres granted by the Spanish Government to Charles Clarke on the tenth day of June in the year of our Lord One thousand & twenty which said mority is set out and limited by the lines following to wit, by a line commencing at a hickory and running to a stake North ten degrees west seventy chains and seventy and seventy chain links thence by an other line running from said stake to a live oak South fifty degrees west One hundred and forty one chains forty five links thence by an other line running from the said live oak to and south ten degrees east seventy chains seventy one links ***** to the first first line thence thine by and other line from the said oak to the hickory at the commencement Bulling and Bounding to the north on lands of Charles W. Clarke to the East Paynes savannah to the South on lands of George I.F. Clarke and to the west on vacant land having such shape form marks crses and distances as are discribed in a plat of the said tract made by the said George I.F. Clarke Surveyor general of the said Province on the first day of November in the year of our Lord one thousand eight hundred and seventeen and recorded among the Public Documents of the Province a copy of which is annexed to the conveyance of the said tract of land by the said George I.F. Clarke to me the said Thomas Napier Also all the Estate right where and interest which I the said Thomas Napier in and to all and singular One thousand six hundred and sixty four acres of land situate lying and being in the tract of country known by the name of Alachua in the county of Alachua in the Territory of Florida bounding and measuring according to a survey and plat made by Joshua A. Coffee Surveyor dated the eighth day of October in the year of our Lord one thousand eight hundred and twenty four as follows The first line beginning at a dry live oak tree marked XIIII and runs north two hundred and eighty chains to a water oak with the same mark, thence runs west eighty chains to a live oak tree with the same mark thence runs South Two hundred and eighty chains to the place of beginning being part of and included in a large tract of land granted to Fernando ** Arredondo and son on the twenty second day of December in the year of our Lord One thousand eight hundred and seventeen at Havanna by the Spanish Authorities Together with all and singular the rights members hereditaments and appurtenances to the said several tracts of land belonging or in any wise incident or appertaining To have and to hold all and singular the said premises unto the said James Hibben Junior Trustee as aforesaid his heirs and assigns forever. And I the said Thomas Napier do hereby bind myself my heirs executors and administrators to warrant and forever defend all and singular from and against me my heirs executors administrators and assigns and all other persons whomsoever lawfully claiming or to claim the same or any part thereof Provided always nevertheless and it is the true intent of and meaning of these presents, that if I the said Thomas Napier shall and do well and truly pay and satisfy to the said James Hibben Junior Trustee as aforesaid or his heirs or assigns the debt of sum of miney aforesaid with the interest thereon as confirmed in the promissory note aforesaid then this deed of bargain and sale shall cease determine and be utterly null and ____ void otherwise it shall remain in full force and virtue In witness whereof I the said Thomas Napier have hereunto set my hand and Seal at Charleston aforesaid the twenty fourth day of January in the year of our Lord one thousand eight hundred and thirty eight Signed sealed & delivered In presence of John T. Owen of Charleston in the District and State aforesaid, being duly sworn make oath and say that they were present and did see Thomas Napier of Charleston aforesaid sign seal and and as his act and deed deliver the within written Deed. Sworn to before me this twenty fourth John T. Reed Of January one thousand eight & thirty eight Allen F. Owen Sworn to before me Charles C. Strohieker C.C.P. I Charles C. Strohieker Clerk of the Court of Common Pleas for the District and State aforesaid do hereby certify that on the day of the date hereof Thomas Napier of Charleston aforesaid did personally appear before me and acknowledged the Execution of the within Deed by him And further Certify that John T. Reed and Allen F. Owen of Charleston aforesaid did also personally appear appear before me and being duly sworn did dispose and say that they were present and did see the said Thomas napier sign seal and as his act and deed deliver the within written deed. Richardson one of the Judges of the Court of Common Pleas of the State aforesaid send greeting Know ** That Charles C. Strohieker who hath subscribed the above Certificate is a Clerk of the Court of Common Pleas for the District of Charleston in the State aforesaid and duly authorized to administer Oaths and that all due faith and credit are and ought to be given to his attestations and that the above attestation is in due form of Law (L.
