Putnam as Executor of the last Will and Testament of the late Peter Mitchel deceased of the first part and John Macpherson Berrien of the State of Georgia of the second part, Witnesseth; Whereas Peter Michel did in his life time by an agreement in Writing under his hand, agree and contract for Valuable consideration received by him from the said party of the second part in fee Simple Absolute that certain parcel of Land hereinafter particularly described, and whereas the said Peter Mitchel, departed this life without having carried the Contract into Effect, and having first duly made & published his last Will and Testament in Writing whereby he appointed the said party of the first part to be Executor thereof; And whereas the said party of the first part hath been in due course of Law Qualified as such executor, and hath taken upon himself the burden of the Execution of the said Will, And whereas the said party of the second part did recently exhibit his Bill of Complaint, against the said party of the first part, before the Honorable Judge of the Superior Court for the Eastern District of Florida, in the Exercise of his Chancery Jurisdiction praying the said party of the first part might by the Decree of said Court be directed to Convey to the said party of the second his heirs & Assigns in fee Simple Absolute, According to the terms of said Agreement and Contract between the said party of the second part and the said Peter Mitchel deceased the land herein after particularly described, upon which such proceedings were had, that the Said Court at the March Term thereof in the present year One thousand eight hundred and forty two, in and by its decree, did order, Adjudge and decree that the said party of the first part, as executor of the last Will and Testament of the said Peter Mitchel should in pursuance of the Statute in that case made and provided execute a Conveyance in fee Simple Absolute to the said party of the second part his heirs and Assigns forever, to the use benefit and behoof of the said party of the Second part his heirs and Assigns forever of One thousand Acres of land part and parcel of that certain grant of Land Commonly called the Alachua Grant, made by the Spanish Government on the twenty Second day of December in the year of our Lord One thousand eight hundred & Seventeen to Fernand Delamara Arredondo and Son then of the City of Havanna in the Island of Cuba, the said Grant being the same grant, which was confirmed by the Decree of the Supreme Court of the United States in January Term One thousand eight hundred and thirty two of the said Court, a Report of which Decree reference being thereto had being to be found in the Sixth Volume of Peters Reports of the decisions of the said Court at page Six hundred and ninety One __ The said One thousand Acres of Land to be selected by the said party of the second part or his heirs or Assigns, and located in One Tract of One thousand Acres or two tracts of Five hundred Acres each in the form of a Square at the election of the said party of the second part his heirs and Assigns, not interfering with Towns, Canals, or prior locations And further that the said decree and Conveyance thereby directed should be without predjucies to the Rights and interest set upon & Aledged in the Answer of the said Party of the first part ___ Now Therefore this Indenture Witnesseth, that the said party of the first part, for and Consideration of the premises and Ten Dollars by the said party of the second part well and truly paid to the said party of the first part, at and before the Sealing and delivery of these presents the receipt whereof is hereby Acknowledged in pursuance of the Afore cited decree and for the further purposes of carrying the same into effect, hath granted bargained Sold, Aliened, remised, released, and confirmed, and by these presents doth grant bargain, Sell, Alien, remise, release & confirm unto the said party of the second part and to his heirs & Assigns the Aforementioned One thousand Acres of land part & parcel of the Aforesaid grant to the said Fernando De La Maza Arredondo and Son to be selected by the said party of the second part or his heirs or Assigns and to be located in one tract of One thousand Acres or in two tracts of Five hundred Acres each in the form of a square at the election of the said party of the second part, his heirs and Assigns not interfering with Towns, Canals or prior loactions, and without predjudice to the Right and interest set up and Allidged in the answer Aforesaid of the said party of the second part __ Together with all and Singular the hereditaments and Appurtenances to said One thousand Acres of Land belonging or in any wise Appertaining, & the reversion and reversions, remainder and remainders, rents, issues, and profits thereof and all the Estate. Right, title, interest, property, claim and demands of every kind both in law and in Equity of the said Peter Mitchel deceased of in and upon the said land and premises and every part thereof To have and to hold the said Land and premises and every part and parcel thereof to the said party of the second part his heirs and Assigns forever In Witness whereof the said party of the first part, hath hereunto set his hand seal, the day and year first above written Signed sealed & delivered Benjamin A.
