All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/fl/flfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jim Powell, http://www.genrecords.net/emailregistry/vols/00030.html#0007445 April 1999 "Transcribed by Jim Powell Jr from Records provided by Buddy Irby, Alachua County Clerk of the Court's Office" Page 411-413 This Indenture made the fourth day of March in the year of our Lord One thousand eight hundred and forty two Between James Stephens of the Town of Newnansville County of Alachua and Elender his wife of the first part & Selpha Standly of Newnansville of the second part Witnesseth that the said partys of the first part for and in consideration of the Sum of Three hundred and fifty Dollars lawful money of the United states of America the receipt whereof is hereby Acknowledged, Have granted bargained, sold, aliened, remised released, conveyed and confirmed, and by these presents Do grant, bargain Sell, Alien, remise, release, confirm and convey unto the said party of the second part and to her heirs and Assigns forever, All those certain Lots, pieces or parcels of ground situate lying and being in the Town of Newnansville, County of Alachua territory of Florida and known on a certain Map or plot of the City of Newnansville on file in the Office of the Clerk of the County of Alachua as Lots Number Five (N 5) and number Six (No. 6) on Block number four (No. 4) of range number two (No. 2) and Lots number five (No. 5) and number eight (No. 8) and block number five (No. 5) of range number Two (No. 2) being the same premises which were conveyed to the said James Stephens by Light Townsend and Phebe his wife of the Town of Newnansville by indenture bearing date the twenty fourth December One thousand eight hundred and forty Together with all and Singular the tenements hereditaments and Appurtenances thereunto belonging or in any wise Appertaining and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof, Also all the estate in right title, interest, dower and right of dower property possession claim and demand whatsoever as well in law as in equity of the said parties of the first part of in and to the same and every part and parcel thereof with the Appurtenances, To have & to hold the above granted bargained and described premises with the Appurtenances unto the said party of the second part her heirs and Assigns to her and their proper use, benefit and behoof forever. And the said James Stephens for himself his heirs Executors and Administrators, do covenant grant and agree to and with the said party of the second part her heirs & Assigns that the said parties of the first part at the time of Sealing and delivery of these presents, were lawfully Seized in their own right of a good absolute & indefeasible estate of inheritance in fee simple of and in all and singular the above granted and described premises with the Appurtenances and have good right full power and lawful Authority to grant bargain sell and convey the same in manner Aforesaid, And that the same now are free clear discharged and unincumbered of and from all former titles grants, charges, Estates, judgments taxes Assessments and incumberances of what nature or kind soever__ And Also that the said parties of the first and their heirs and all and every person or persons whatsoever lawfully or equitably deriving any estate right title or interest of in or to the hereinbefore granted premises from or in trust from them, shall and will any time or times hereafter upon the reasonable request and at the proper cost and charges in the law of the said party of the second part her heirs and Assigns make do and execute or cause to be made done and executed all and every such further and lawful and reasonable Acts conveyances and assurances in the law, shall be reasonably advised or required __ And the said James Stephens his heirs the above described and hereby granted and released premises and every part and parcel thereof with the Appurtenances unto the said party of the second part his heirs and Assigns against the parties of the first part and their heirs and Against all and every person or persons whatsoever, lawfully claiming the same shall and will Warrant and by these presents for ever defend ___ In Witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written__ Signed Sealed & delivered in presence of James Stephens (seal) J.W. Prevatt Elender X Stephens Mark County of Alachua Territory of Florida Be it remembered that on this twelfth day of March One thousand eight hundred and forty two personally came before me the subscriber a Justice of the Peace for the County of Alachua the above named James Stephens and Elender Stephens his wife, both personally known to me to be the same persons mentioned and described in and who executed the foregoing instrument and they Severally Acknowledge to me that they executed the same for the use and purposes therein mentioned, And the said Elender being by me examined privately, separately and apart from her said husband and on such examination Acknowledged that she made the foregoing relinquishment and renunciation of Dower freely and Voluntarily & without any Compulsion, Constraint, Apprehension or fear of or from her said Husband Tho's J.
