Smith stands justly indebted to Moses E. Levy in the sum of six thousand Dollars according to the terms of his certain bond or writing Obligatory bearing even date hereunto that being the consideration money for a certain tract of Land purchased by said Peter S. Smith from said Moses E. Levy called Water Pens and described in a deed of conveyance thereof bearing even date herewith. Now this Indenture made this first day of April in the year of our Lord one thousand eight hundred and thirty nine between the said Peter S. Smith of the City of St. Augustine East Florida party of the first part and the said Moses E. Levy of the same place party of the second part Witnesseth that the said party of the first part assuring for the better securing the said party of the second part the payment of the said sum of six thousand eight hundred and seventy five dollars and the interest thereon to accrue according to the terms of said bond or writing Obligatory or in consideration of the sum of ten dollars to him in hand paid by the party of the second part at and before the sealing and delivery of these presents the receipt whereof is hereby Acknowledged Hath granted bargained, sold aliened and conveyed and by these presents doth grant bargain sell alien and convey unto the said party of the second part and to his heirs and assigns forever All that certain Land herein after discribed that is to say All that certain tract Originally granted to Don Juan Entralgo on the fifteenth day of November in the year of our Lord one thousand eight hundred and seventeen discribed by said grant as being situated about thirty six miles West of the (then) Port at buena Vista upon the River St. Johns at the place known as the "Water Pen" and more perticular discribed in a survey thereof made by Don Andrews Busquine on the ninth day of September in the year of our Lord one thousand eight hundred and nineteen All which will more fully appear by reference to the Documents on file in the Office of the Public Archives at St. Augustine aforesaid Which said Land is situate in the County of Alachua and according to said survey is imbraced in Township ten Range twenty three south and East and is supposed to be in section three ten fifteen and sixteen as appears by reference to the Surveys of the Public Land, but which precise location the said party of the first part does not Warrant as the said tract of land above mentioned containing one thousand Acres may be located in part in other section, also all the following Land that is to say, Lots four five six and seven section eight Township ten Range twenty three South and East One hundred and ninety 50/100 Acres Lots one, two, six and seven section seventeen Township ten Range twenty three South and East one hundred and seventy five 21/100 Acres Together with all and singular the tenements hereditaments and Appurtenances whatsoever to the same belonging or in any wise appertaining , and the reversion and reversions remainder and remainders, rents issues and proffits thereof. To have and to hold the said Lands tenements hereditaments and Appurtenances above mentioned and described unto the said party of the second part and to his heirs and assigns forever Provided nonetheless **** these presents are upon this express condition that if the said party of the first part doth well and truly pay or cause to be paid unto the said party of the second part his executors, Administrators or Assigns the full Sum of six thousand Eight hundred and seventy five Dollars, principal money on or before the expiration of ten years from the date hereof and interest thereon at the Rate of seven per cent per Annum payable semi Annually according to the Terms Conditions and tenor of said Bond or writing Obligatory.
