Underwood and after being duly sworn deponth and says that James M. Bates placed in his hand a promissory note from collection on Thomas Smith for one likely young cow and calf made payable the first day of April 1836 said note was given to Samuel B. Fitzpatrick or bearer and that the said promissory note aforesaid is lost or mislaid so that it cannot be found.
