Underwood and after being duly sworn says that he held a promissory note given by John E. Tucker to the deponent for twenty dollars dated some time about the tenth of March last and made payable twenty days thereafter which examinat says he has lost or mislaid and that it cannot be had but if found shall be delivered without defalcation to the said John E.
