All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/fl/flfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jim Powell, http://www.genrecords.net/emailregistry/vols/00030.html#0007445 April 1999 "Transcribed by Jim Powell Jr from Records provided by Buddy Irby, Alachua County Clerk of the Court's Office" Page 338-341 This Indenture made the third day of July in the year of our Lord one thousand eight hundred and twenty one Between Nathaniel Wells of the City and State of New York Merchant of the first part and Elisha Huntington of the same place Merchant of the second part __ Witnesseth that the said party of the first part for and in consideration of the sum of one thousand dollars lawful money of the United States of America to me in hand paid by the party of the second part at or before the ensealing and delivery of these presents the receipt whereof is hereby Acknowledge and the said party of the second part his heirs executors and Administrators forever released and discharged from the same by these Presents Hath granted bargained sold aliened remised released enfeoffed Conveyed and Confirmed and by these presents Doth grant bargain sell alien remise release enfeoff Convey and confirm unto the said party of the second part his heirs and assigns forever, all that two thousand acres of land being part of thirty thousand acres of land which said thirty thousand acres of land is an undivided part of a certain grant tract of land containing two hundred and eighty nine thousand six hundred and forty five acres and five sevenths of an acre, or there about situated lying and being in the Alachua territory East Florida ***** of St. Augustine heretofore granted by the Spanish Government to Don Fernando de la Maza Arredondo and son by grant being dated at Havana *** before the twenty eighth day of December in the year one thousand eight hundred and seventeen the said large tract of two hundred and eighty nine thousand six hundred and forty five acres and five sevenths of an acre being hereafter to be divided in to twelve parts and these parts to be ballotted for by the parties interested therein and division to be made which said thirty thousand acres of lands out of which the said two thousand is to be taken was heretofore conveyed by the said Do Fernando de la Maza Arredondo and Son by Bu** H. Betts their Attorney to the said Nathaniel Wells by virtue of a power of attorney bearing date the six day of June in the year of our Lord One thousand Eight hundred and twenty one and recorded in the office of Register in and for the City and County of New York in Led 1 of Power of Attorney and page 229 the thirtieth day of June 1821 reference being had to the said power of attorney as the register thereof will more fully appear ___ Together with all and singular the tenements hereditaments rights members privileges and Appurtenances unto the above mentioned and described premises belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and proffits thereof and also all the estate right title interes property possession claim and demand whatsoever as well at law as in equity of the said party of the first part of in and to the above mentioned and discribed premises and every part and parcel thereof with the hereditaments and Appurtenance to have and to hold the above granted bargained and discribed Premises and every part and parcel thereof with the hereditaments and Appurtenance unto the said party of the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever And the said Nathaniel Wells his executors and Administrators, Doth Covenant and agree to and with the said party of the second part his heirs and assigns, by these Presents in manner and form following that is to say that the said Nathaniel Wells, hath not at any time heretofore made done or committed or wittingly or willfully suffered any act matter or thing whatsoever whereby or by means whereof the said premises mentioned to be hereby granted and released as aforesaid or any part or parcel thereof are is or can or may be in any wise impeached or incumbered in title charge estate or otherwise howsoever And also that the said party of the second part his heirs and assigns shall and may at all times hereafter peaceably and quietly have hold use occupy possess and enjoy the above granted bargained and discribed Premises and every part and parcel thereof with the hereditaments and Appurtenances without any let suit trouble molestation eviction or disturbance of the said Nathaniel Wells his heirs or assigns or of any other person or persons whomsoever lawfully claiming or to claim any estate right title or interest of in or to same by from or under him in witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the day and year firs above written Signed Sealed and delivered in presence of Nathaniel Wells D.M. Wickham Jasper Ward On this thirteenth day of August one thousand eight hundred and twenty three personally appeared before me William P. Vanhess district Judge of the United States for the southern district of New York Jasper Ward to me well known who being duly sworn deposed that Nathaniel Wells the grantor named in the within deeds is personally known to him that he was present and saw the said Nathaniel Wells execute and deliver the same as his voluntary act for the use and purposes therein mentioned and that he the said Jasper Ward at the same time of the execution thereof subscribed his name thereto as a witness which being satisfactory evidence to me of the due execution of said deed and having examined the same and finding there is no material reason or interlineation I allow it to be recorded W.P. Vanhess Territory of Florida County of Alachua On this 17th day of February A.D. 1824 this instrument of writing was presented to me in my Office with the certificate thereon endorsed whereupon I have recorded the same witness my name as clerk of the County Court for the County and Territory Aforesaid the date above written James C.
