All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/fl/flfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jim Powell, http://www.genrecords.net/emailregistry/vols/00030.html#0007445 April 1999 "Transcribed by Jim Powell Jr from Records provided by Buddy Irby, Alachua County Clerk of the Court's Office" Page 387-389 This Indenture Made the third day of July in the year of our Lord One thousand eight hundred twenty one Between Nathaniel Wells of the City and State of New York Merchant of the first part, and Shivers Parker of the same place of the second part, Witnesseth, That the said party of the first part for and in consideration of the sum of Five hundred Dollars lawful money of the United States of America to me in hand paid by the said party of the second part at or before the ensealing and delivery of these presents, the receipt whereof is hereby Acknowledged by the said party of the first part his heirs, executors, Administrators forever released and discharged by these presents, hath granted bargained, sold, aliened, remised, released, enfeoffed, conveyed & confirmed and by these presents, Doth grant, bargain, sell, Alien, remise release, enfeoff, convey and confirm, unto the said party of the second part his heirs and Assigns forever. All that One thousand Acres of Land being parcel of thirty thousand Acres of Land, which thirty thousand Acres is an undivided part of a certain greater tract of Land containing Two hundred and eighty nine thousand six hundred and forty five Acres and five sevenths of an Acre or thereabouts situate lying and being in the Alachua Territory East Florida West of St. Augustine, heretofore granted by the Spanish Government to Don Fernando da la Mara Arredondo and son by grant bearing date at Havanna on or about the twenty eight day of December in the year One thousand eight hundred and seventeen, the said larger tract of Two hundred & eighty nine thousand six hundred & forty five Acres and five sevenths of an Acre, being hereafter to be divided unto twelve parts, and those parts to be balloted for by the parties interested therein on a division to be made, which said thirty thousand Acres of Land out of which the said One thousand is to be taken was heretofore Conveyed by the said Don Fernando da la Mara Arredondo and son by Burret Betts their Attorney, to the said Nathaniel Wells by a virtue of a Power of Attorney bearing date the sixth day of June in the year of our Lord One thousand eight hundred & Twenty One, and recorded in the Office of the Register in and for the City and County of New York in Lib? Of Powers of Attorney and page 229 the thirteenth day of June 1821 Refference being had to the said power of Attorney or the Registry thereof will more fully appear.___ Together with all and Singular the tenements, hereditaments, rights members, privileges, and Appurtenances, unto the above mentioned and described premises, belonging or in any wise appertaining And the reversion and reversions, remainder and remainders, rents, issues and profits thereof, And also all the Estate, right title interest, property possession claim and demand whatsoever, as well at Law as in Equity, of the said party of the first part, of, in, and to the above mentioned and described premises, and every part and parcel thereof, with the hereditaments and Appurtenances, To have and to hold the above granted bargained and described premises, and every part and parcel thereof with the hereitaments and Appurtenances, to the said party of the second part his heirs and Assigns, to the sole and only proper use, benefit and behoof of the said party of the second part, his heirs and Assigns forever, And the said Nathaniel Wells his heirs Executors and Administrators. Doth covenant and agree to and with the said party of the second part his heirs and assigns, by these presents, in manner and form following, that is to say, that the said Nathaniel Wells hath not at any time heretofore made, don or committed, or witingly or willfully suffered, any act matter or thing whatsoever, whereby or by means whereof the said Premises mentioned to be hereby granted and released as aforesaid, or any part or parcel thereof, are, is, or can, or may be, in any wise impeached or incumbered, in title, charge, estate, or otherwise howsoever. And Also that the said party of the second part his heirs and assigns, shall and may at all times hereinafter peaceably and quietly, have, hold, use and Occupy, possess and enjoy the above granted bargained and described premises and every part and parcel thereof with the hereditaments and Appurtenances, with any let, suit, trouble, molestation, eviction or disturbance of the said Nathaniel Wells his heirs or Assigns, or any other person or persons whomsoever lawfully claiming or to claim any estate, right, title or interest of, in, or to the same, by from or under them ____ In Witness whereof , the parties to these presents have hereunto set their hands and seals the day and year first above written____ Nathaniel Wells ( L.S.) Wells known to me to be the Subscribing Witness, to the foregoing Indenture who being by me duly sworn did depose and say that he resides in the first Ward of the City of New York, that he was present and saw Nathaniel Wells, known to him to be the same person described in who executed the foregoing Indenture, duly executed & Acknowledged the same as his Act and Deed, and that the deponent Subscribed his name as Witness to such execution thereof which being to me Satisfactory proof of the dew execution of the said Indenture, I allow it to be recorded Charles W.
