I am unable on account of the disabilities shown below and by attached affidavit of a reputable physician, to earn a livelihood by manual labor. McKinstry Jr, who being duly sworn, deposes and says, that he is a physician, that he is a resident of the State and County aforesaid, that he personally knows Henry Polk the applicant named in the foregoing application for a pension. This deponent further says that he has carefully examined the said applicant’s physical condition and finds: (Here state nature, character and extent of wounds, disease or disability. REVISED STATUTES OF FLORIDA, CHAPTER II, ARTICLE I. 2077. The children of parents who are unable to support themselves, shall be required to make provision for their support. 2078. On information filed before the Justice of the Peace of the proper district by any person whomsoever, stating that certain persons have made no adequate provisions for their father and mother, or either of them, the Justice shall cause a summons to be issued to said parties, and evidence to be taken as to the truth of the facts stated in the information, and if the same shall be found true, after a fair trial in which the defendants shall have the right to be heard by counsel, the Justice shall issue an order making an assessment on the said children for such amount as shall be necessary for the support of their parents. 2079. I find no respiratory murmur on the affected side and know of him having repeated attacks of pneumonia, and he complains of a constant dull pain, and he has copious and offensive expectorations. J. Fleming Iit (sic) that Henry Polk of Alachua County Fla did make application for Soldiers pension wich (sic) application was examined and rejected on or about the 5th or 6th of June 1888 it appearing from statements set forth in the inclosed (sic) letter that his certifficate (sic) claimed a defect alone in his head and eyes when the main trouble is in his side caused from a wound in his lung not withstanding his head and eyes is affected and the doctor that signed his certifficate (sic) claimed it was caused from the wound but I if (sic) that certifficate (sic) does not give sattisfaction (sic) I am fully sattisfied (sic) he can get one from a board of Doctors if necessary according to my understanding of the law he is intitled (sic) to a pension as I am personally acquainted with Mr. Polk. I think he is intitled (sic) and I as one of the County Commissioners of Alachua County, ask your honor to reconsider his papers he is no relation to me but simply ask (sic) me to look in to the matter for him as he is unable to perform manuel (sic) labor from said wound.
