In the fear of God and in the Name of the Lord Jesus Christ be it known that I Flavius Josephus Gosling of Cincinnati Ohio do hereby make and publish this my last will and testament as follows:' Item I: I direct that my executor first pay out of my estate my funeral expenses doctor bills and hospital bill and all other expenses if any of my burial and last sickness. Item II: I desire and direct that all my other debts be paid in full by my executor whether bound or not by any statute of limitations. Item III: I give and bequeath to my friend Lewis Wallace Standler (or Standlen), the sum of Two Hundred ($200.00) Dollars. Item IV: I give and devise to my son TW Gosling all my real estate in the State of Florida if it has not been sold or disposed of by me prior to my death. Item V: I will and direct that my executor convert all the residue and remainder of my estate after the payment and satisfaction of my debts and this above bequest to Louis Wallace Standly? and devise to my son into money including my One Hundred and Sixty (160) acres of land in Section Twenty-eight (28) North Dakota near the town of Van Hook as soon as can be done after my death with out loss to my estate and I give to my said executor free power and authority without order of court to make sale of my personal and real estate for such price and upon such times as he deem best and I hereby authorize and empower him to execute any and all deeds and instruments of writing necessary to transfer and convey said property to purchasers and purchasers from said executioner hereby relieved from any and all liability as to the application of the proceeds of sale. Item VI: I will and direct that my executor divide the proceeds of such sales, less the expenses incurred in selling my estate into five equal parts and I give and bequeath two of such parts to my son TM (or T W) Gosling and one of said parts to my brother the Rev. Benjamin F. Gosling one of such parts to my sister Emily Norman of Wichita Kansas and the remaining one of such parts to my sister Eliza J Bacon. I hereby nominate and appoint my friend Charles L. Doughty of Cincinnati Ohio as executor of this my last will and testament and I give him full power and authority without order of Court therefor to execute and carry out the provisions of this will. In witness whereof I Flavius Josephus Gosling have hereunto subscribed my name this 27th day of July A. D. 1917. Flavius Josephus Gosling Subscribed and acknowledged by the said Flavius Josephus Gosling as and for his last will and testament in our presence and signed by us as witnesses at his request in his presence and in the presence of each other. Shanks I Flavius Josephus Gosling of Cincinnati Ohio since making my last will on July 27 1917 have sold my One Hundred and sixty (160) acres of land in Section Twenty-eight (28) North Dakota and for this and other reasons I now revoke and annul Items III, V and VI of said will and do make and publish this first codicil to my said will as follows: Item I: It is my will and I direct that my funeral expenses be held at God's Bible School Tabernacle and that Rev. L. W. Standley shall preach the funeral sermon and that George A. Wil*ace? shall act as funeral director and that my nephews act as pall bearers including my nephews Arthur and Walter Wi** and David and John Gosling. I have given my friend and executor Charles L Doughty full and explicit instructions and directions concerning my funeral as above stated and it is my will and I request and direct that he take change of my funeral as above and see that my wishes in that respect are fully carried out. Item II: I will and direct that my executor *** of **** collect and convert all the residue and remainder of my estate after the payment and satisfaction of my debts and the device to my son of my Florida real estate into money and that my said executor divide said money less the expenses incurred in selling my estate into Five (5) equal parts and I give and bequeath two of such parts to my son T W Gosling and one of said parts to my sister Emily Norman of Wichita Kansas and the remaining two fifths I give and devise share and share alike to my grand children the children of my said son T W Gosling including ***** any that may be here after born said remainder to be kept by my executor and inverted in some safe interest paying bonds until each of my said grandchildren attain the age of majority at which time its pro rata share together with the accumulations thereon shall be paid to such grandchild. In the event of the death of any of said grand children before attaining the age of majority then its share shall be paid to the surviving grand children on their attaining majority and in the event of the death of all of said grandchildren before attaining the age of majority then said remainder shall be paid to their father my son T. W. Gosling In testimony whereof I have hereunto subscribed my name this 22nd day of October A D 1917 F. J. Gosling. Subscribed and acknowledged by the said Flavius Josephus Gosling as and for this first codicil to his will and signed by us as witnesses at his request in his presence and in the presence of each other. W. A. Hicks Ray Hicks ___________ Hamiton Probate Court In re last will and testament and codicil there to of Flavius Josephus Gosling, deceased. The Last Will and Testament and codicil thereto of Flavius Josephus Gosling deceased late of this County were on the the 8th day of November 1917 executed to the court for probate and record. And it appearing to this court that deceased died leaving no widow and that all the next of kin of said deceased resident of Ohio have waived notice and consent to the probate of said will and codicil thereto. Thereupon on the 15th day of November A. D. 1917 came into open Court W. A. Hicks one of the subscribing witnesses to said will and also to the codicil thereto Nellie D. Shanks the other subscribing witness to said will and Ray Hicks the other subscribing witness to said Codicil to said will and were duly sworn and examined and their testimony was reduced to writing and filed. And it appearing to the Court from the testimony so taken that said will and codicil thereto were duly executed and attested and that at the executing came the testator was of legal age sound mind and memory and not under any restraint the Court now admits the said will and codicil thereto of Flavius Josephus Gosling deceased to probate and ordered the same together with the testimony so taken to be recorded according to law. On Application made as provided by statute the court grants unto Charles L Doughtey **** testamentary under said will him being named executor therein. Whereupon the said Charles L Daughty in open court accepted said appointment and filed an estimate of the whole estate together with a statement that he is not indebted to this decedent. At the same time applicant also presented his bond as such executor in the sum of Nine thousand dollars with the Aetna Casualty and Surety Company as surety which bond is now approved by the court. Publication of the above named appointment is hereby ordered made in the Court Index and newspaper of general circulation in this county. And the Court hereby appoints Chas. W. Paver, Ray Hicks and Adolph Gruber to appraise the personal property of said decedent. Letter Issued. Entered November 15th 1917. William H. Luedens Sole Judge and Ex Office Clerk of the Probate Court within and for the County aforesaid do hereby certify the foregoing to be a true and correct copy of the last will and testament and codicil thereto of Flavius Josephus Gosling deceased, late of this County also *** of November 15th 1917 admitting said will to probate and record and I further certify that said will and codicil thereto were duly executed and proved agreeably to the laws and usages of the State Of Ohio in which the same was executed as the same appear from the Records and files of said Court.
