Hubbard of Mobile, Alabama, being of sound and disposing mind, memory and under- standing do hereby make, publish and declare this my last Will and Testament hereby revoking any other wills made by me. I hereby will and bequeath unto my wife Delia E. Hubbard any and all property which I may own at my death, whether real, personal or mixed, to be her own absolutely and in fee simple. I hereby appoint my wife Delia E. Hubbard sole executrix of this my last will, and it is my desire, and I so request that no bond be required from her as executrix. In Witness Whereof, I have hereunto set my hand and seal this 24th day of February A. D. 1904. (Signed) John Q. Hubbard Signed and published as his last will by the said John Q. Hubbard in our presence, and we in his presence and in the presence of each other have hereunto subscribed our names as witnesses on this 24th day of February A. D. 1904 on the day of the date of said will. (Signed) Chas. L. Cooper Palmer Pillans State of Alabama Mobile County Probate Court of Said County. In the matter of the proate of the last will and testament of John Q. Hubbard, deceased. Before me, Price William Jr., Judge of the probate court in and for said County and state personally appeared in open court Chas. L. Cooper and Palmer Pillans who having been by me first duly sworn and examined did and do depose and say on oath that they are the subscribing witnesses to the instrument of writing now shown to them and which purports to be the last Will and Testament of John Q. Hubbard deceased, late inhabitant of this County, and that John Q. Hubbard since deceased signed and executed said instrument on the day the same bears date, in the presence of the subscribing witnesses, and declared the same to be his last will and testament. Affients further state that they signed the said instrument on the day the same bears date at the request and in the presence of said testator an in the presence of each other as the subscribing witnesses thereunto, that said testator was on the day of the date of said will of the full age of twenty-one years and upward and in the opinion of deponents fully capable of making his will at the time the same was so made as aforesaid. I, Price William Jr. Judge of the Probate Court in and for said state and county hereby certify that the within instrument of writing has this day in said court and before me as the judge thereof been duly proven by the proper testimony to be the genuine last will and testament of John Q Hubbard deceased, and said will together with said proof thereof have been recorded in book of wills No. 9 and on pages 322-323.
