Know all men by these presents, That I Sam'l H. Leathe of St. Louis, Missouri, being of sound and disposing mind and memory, do make, ordain, publish and declare this my last Will and Testament hereby revoking all other wills by me heretofore made. First: I desire that all of my debts and funeral expenses be paid. Second: I give, divise and bequeath the following property to my wife Grace *. Leathe and the St. Louis Union Trust Company to be held by them in trust however for the following purposes, the net income of said property after paying all the expenses connected with the management of the same shall be paid by my said trustees to my son Samuel Leathe during his lifetime, and should he die before his wife, then one half of the net income from said propery shall be paid to her during her lifetime and the remaining half to my wife Grace *. Leathe and upon the death of my son Samuel Leathe and his wife, said property shall vest and become the absolute property of my wife Grace *. Leathe or her heirs. Said property is described as follows: 1st the old homestead consisting of a lot on the North side of Locust Street just West of Fourteenth and house thereon known as 1413 Locust Street; 2nd. the lot on the South side of Locust Street between Fourteenth and fifteenth Streets and the house thereon known as 1420 Locust Street; 3rd the lot on the South side of Locust Street between Twenty second and Twenty third streets and house thereon known as 2812 Locust Street; 4th the old Stannard property on the North side of Lindell Boulevard just West of Grand Avenue fronting 100 feet on the North line of Lindell Boulevard and extending North to an alley and house thereon known as 3629 Lindell Boulevard; all the above property in St. Louis Missouri; 5th also the farm now owned by me in St Louis County Missouri fronting along the Missouri River. containing 150 acres more or less, and known as the Belle-fountaine farm; 6th Also all the land now owned by me in Kinloch Park St. Louis County Missouri; 7th also the farm now owned by me and situated near Riverside Jefferson County Missouri containing about 400 acres; 8th also all the land owned by me at St. Andrew Bay, State of Florida. I invest the above named trustees with full power to sell said property or any part thereof and reinvest the proceeds thereof in other property and again sell and reinvest without limit. My purpose is to create a life estate in said property for my son Samuel which I desire to leave in trust as above indicated. I have super abundant reasons for this which I forbear to particularize here, as I think it to his best interest to place the property absolutely and entirely beyond his control. Third: I give, devise and bequeath to Euola Augusta-Sims and Lucile Wilson, daughters of my wife one thousand Dollars each. Fourth: I give, devise and bequeath to my faithful attorney Judge Geo. *. L**** $4000.00 Fifth: I give devise and bequeath to my faithful employe Walter J. Carney (Garney?) $**00.00 Sixth: All the rest, residues and remainder of my estate whether real, personal or mixed of every kind and character, and whereever situated, and whether in possession, expectency, revision or remainder. I give, devise and bequeath to my faithful and devoted wife Grace *. Leathe absolutely and forever. Seventh: In the event my son Samuel should in any wise contest or aid in contesting this will or any of the provisions thereof, either directly or indirectly, then and in that event I annul the bequest herein made for his benefit and give him One Dollar and no more, and direct that the property set forth in the second clause hereof shall pass directly and rest absolutely in my wife Grace *. Leathe. Eighth: I hereby nominate constitute and appoint my wife Grace A. Leathe sole executrix of this my last will and testament and as each request that no bond be required of her. In Testimony whereof I have hereunto set my hand and seal this the 17th day of January 1907. Sam'l H. D. 1907, before me, the undersigned Clerk of the Probate Court of the City of St. Louis; personally came Xenophon P. Wilfley and J. D. Wilfley who being both, by me duly sworn on their oath say, "We saw Samuel H. Leathe the testator subscribe his name to the annexed instrument, in writing, bearing date the 17th day of January 1907, and heard him declare the same to be his last Will and Testament, we subscribed our names thereto as witnesses in the presence and at the request of the said testator and at the time of the execution of said instrument as aforesaid, and of our subscribing the same as such witnesses he the said testator was of sound and disposing mind to the best of our knowledge and belief." D. 1907, it being one of the days of the March term of the Probate Court of the City of St. Louis, for said year, an instrument in writing, purporting to be the last Will and Testament of Samuel H. Leathe, deceased, is produced in and exhibited to said Court, upon examination whereof, and of the testimony of Xenophen P. Wilfley and J. D. Wilfley the subscribing witnesses thereto, it is considered by the Court that said instrument in writing is duly proved to be the last Will and Testament of said Samuel H. Leathe deceased.
