Youells, aged 57 years, by occupation a farmer who, being duly sworn according to law, declares that he is the identical person who was on the 31st day of July, 1861, enrolled in Captain John C. Nichols Company D of Wayne county, State of Georgia and that while serving as a Private in D Company, 26th Regiment, Fourth Georgia Brigade and in the line of duty at ____ in the State of Virginia, on or about the ____ day of July 1864, I contracted chronic diarrhea such which times piles have resulted & have had both for over 19 years and chronic diarrhea for over 30 years and that by reason of said service and as a direct result of said injuries I am now unable to earn a livelihood; and that I am a citizen of said county and State, and have been a bona fide citizen of the State of Florida continuously since January 1st, 1875; that neither I nor my wife owns property to the value of fifteen hundred dollars, and that I am not "otherwise enabled or in a position to earn a livelihood;" that I am not receiving a pension from the United States, or any other State; that I never deserted the Confederate service, and make this declaration for the purpose of being placed upon the invalid pension roll of the State of Florida, as provided by act of the Legislature, approved June 8, 1889, as amended June 2, 1893. Youells, ever since the year 1875, & that he was a bona fide citizen of Florida, on the first day of Jany. 1875 & has constantly resided in this State since that time. Youells is disabled as claimed, by reason of said injuries, that he and wife combined do not own $1500 in value & that he is not physically, or otherwise, able to make a living. Lewis W. Youells who is to us well known as the applicant for pension above described, and find that he is & has been suffering from chronic diarrhea & piles during my acquaintance with him excluding from sixteen (16) years ago - & that he has been at various times under my care resulting directly in the loss of ability to earn his living by manual labor. James Knox of said state and county who being duly sworn deposes and says that Walter R. Youells served as a private in Company "D" Fourth Georgia Brigade, 26th Regiment Confederate Army said Company "D" originally Captain John C. Nichol's Company and subsequently his company, and that to the best of his knowledge and belief said Walter R. Youells, never deserted the Confederate service. Deponent further says that to the best of his recollection said Walter R. Youells was taken sick while in service in Virginia and sent to hospital and from which he never returned to his company. Deponent knows nothing of the financial condition of said Walter R. Youells or of that of his wife. James Knox Capt. Co. D 26th Ga. Regt. P. ******************************************************************************************* State of Florida Executive Department Tallahassee April 24 1895 Mr. Walter R. Youells, Lawtey, Fla. Dear Sir: Your pension claim herewith returned, lacks very much of showing such proofs as the law authorizes the Governor to allow a pension for having been a Ga. soldier, you must prove that you were a bona fide citizen of Fla. on Jany. 1st 1875, see typewritten note at bottom of form. You must show that you had chronic diarrhea when the war ended. Capt. Knox's affaidavit [sic] don't show that. You must show that you are now by reason of such diarrhea rendered *PRACTICALLY INCOMPETENT TO PERFORM ORDINARY MANUAL VOCATIONS OF LIFE." TWO physicians must make such affidavit. You have only sent affidavit of one. Yours truly, D. Norris who being duly sworn deposes and says that her brother W. R. Youells of the South's army who fought against me, in Va. and who was in the Reb Rifle ? at Suffolk, where & with my Reg. occupied the Yankey [sic] ? against him, has just handed me your letter of Oct 29 notifying him that he had not come within the ? of the Pension Law and requested me to write you and ask wherein he failed. When I came here 18 years ago I found this old Confederate soldier suffering from chronic diarrhea, and could not work 1/2 the time, since that time he has constantly gone down hill until now he is not able to support himself and if ever Florida gave a worthy pension it belongs to this old soldier.
