D. One Thousand Nine Hundred and two [sic], personally appeared before me, a notary public in and for the County and State aforesaid Mrs. Mary E. Fitzgerald a resident of Punta Gorda County of Charlotte State of Florida, who being duly sworn according to law, makes the following declaration in order to obtain a pension under the provisions of the General Pension Laws of Florida as amended by Chapter 8400, Acts of 1921. That she is the lawful widow of S. H. Fitzgerald who enlisted under the name of S. H. Fitzgerald on the 5th day of July, 1862, in Company "K" 11th Regiment of the State of Georgia and who was honorably discharged at Appomattox, Va., 1865, on account of surrender. That he also served in Co. "K" 11th Regiment Georgia Vol. Infantry, was severely wounded in action which had always been a source of great trouble and annoyance to him during balance of his life. That she was lawfully married to the said S. H. Fitzgerald under the name of Mary E. Brown in the County of Campbell State of Georgia on the 20th day of December, 1870, and that she was not divorced from him before nor has she remarried since his death, which occurred on the 3rd day of August, 1886, in the County of Pulaski, State of Georgia except as hereinafter stated. That she is a resident of Charlotte County, Florida, and has continuously resided in the State of Florida since the 6th day of August 1902. That she was heretofore granted a pension from the State of Florida under Certificate No. ____. That she is not a pensioner of any other State. D. 1922, I hereby certify that the above declaration, etc., was made known and fully explained to the applicant before swearing, and that I have no interest, direct or indirect, in the prosecution of this claim. Brown on the 19th day of December, A. D. 1870. The records further show that the above named parties were married on the 20th day of December, A. D. 1870, and that the ceremony was performed by A. B. Fears, M. G. W. S. McLarin, Ordinary Campbell, Georgia State of Georgia,} Campbell County} To any Minister of the Gospel, Judge of Superior Court, Justice of Inferior Court, or Justice of the Peace, - To celebrate: You are hereby authorized and permitted to join in the honorable state of matrimony Samuel H. Fitzgerald and Mary E. Brown, according to the Rites of your Church, provided there be no lawful cause to obstruct the same, according to the Constitution and Laws of this State, and for so doing, this shall be your sufficient license. Fitzgerald for a pension under the Laws of Florida, was investigated by us; that we are satisfied that the applicant has been a bona fide citizen of the State of Florida for eight years just preceding the date of this application, and that the representation made in the petition and affidavits are true, and that a pension should be granted the applicant. Volunteer Infantry and who remained in service until the surrender at Appomattox. I do not know of any living members of his company, but I believe the pension commission of Florida will accept this certificate in lieu of witnesses.
