D. One Thousand Nine Hundred and thirty-one, personally appeared before me a Clerk Circuit Court in and for the County and State aforesaid Tempie Calton Ward, a resident of Old Town, County of Dixie State of Florida, who being duly sworn according to law, makes the following declaration in order to obtain a pension under the provisions of the General Pension Laws of Florida. That she is the lawful widow of James Calton, who enlisted under the name of James Calton, on the ____ day of ____, 186_, in Company ____ Regiment of the State of Alabama and who was honorably discharged in State of Virginia, 186_, on account of war ended. (Here give complete statement of other service, if any.) That he also served no other service. State here if husband drew a pension, and when.) Husband did not draw pension. That she was lawfully married to the said James Calton under the name of Tempie Fuquay in the County of LaFayette State of Florida, on the 7th day of August, 1898, and that she was not divorced from him before his death, which occurred on the 3rd day of February, 1911, in the County of Duval, State of Florida, at hospital in Jacksonville. Wife has remarried since death of James Calton, but husband is also dead, and she is forty-eight years of age. That she is a resident of Dixie County, Florida, and has continuously resided in the State of Florida since the 5th day of May, 1898, or every since birth. I hereby certify that the above declaration, etc., was made known and fully explained to the applicant before swearing, and that I have no interest, direct or indirect, in the prosecution of this claim. Winburn, County Judge, of LaFayette County, Florida, hereby certify that the records in this office show that a marriage license was issued to James Calton and Tempie Fuquay on the 5th day of August, A. D. 1898. The records further show that the above named parties were married on the 7th day of August, A. D. 1898, and that the ceremony was performed by Rev. Dave Ward, Baptist Minister. E. S. Fuquay, who, being duly sworn according to law, deposes and says each for himself that he was present at the marriage of James Calton and Tempie Fuquay which occurred at Mallory, Fla. on the 7th day of August, A. D. 1898, in the County of LaFayette, now Dixie, State of Florida, and that the ceremony was performed by Rev. Dave Ward, Baptist Minister. R. J. Barber Clerk Circuit Court *********************************************************************************** Report of County Commissioners We, the undersigned, County Commissioners in and for the County of Dixie, Florida, do hereby report that at a meeting of the Board of County Commissioners held this day, the foregoing application of Mrs. Tempie Calton Ward for a pension under the Laws of Florida, was investigated by us; that we are satisfied that the applicant has been a bona fide citizen of the State of Florida for eight years just preceding the date of this application, and that the representations made in the petition and affidavits are true, and that a pension should be granted the applicant. Gentlemen: I wish to acknowledge receipt of your letter of the 13th inst. enclosing application for pension of Mrs. Tempie Calton Ward. The Law requires an applicant for pension to furnish proof of the soldier's war service upon which the claim is based, by affidavits of comrades serving with him the affidavit of commissioned officer under whom he served, or transcript from Washington. If you will advise the Company and Regiment in which Mr. Calton served I will be glad to try to obtain an official record of his service from Washington. You did not give the Company and Regiment in which he served, in the application for pension nor give the date of his enlistment, which is very necessary. Dear Madam: With reference to your application for pension, I regret to inform you that same was denied by the Pension Board yesterday afternoon, on account of the fact that you have submitted no proof of your husband's war service. The Pension Law requires specific proof of service, and the Board does not have the authority to grant a pension unless proof of service is established by affidavits of comrades serving with the soldier, by official record of his service or his honorable discharge.
