D. One Thousand Nine Hundred and Twenty-nine personally appeared before me, a notary public in and for the county and State aforesaid, W. Nealon, who being duly sworn according to law, declares that he is 87 years of age, having been born on the 26th day of June 1842, in the county of Sumpter, in the State of Georgia. That he is a bona fide citizen of the county of Glades, State of Florida. That he has resided in the State of Florida continuously since the 2nd day of December, 1908. That he is the identical person who enlisted at Americus, Georgia, under the name of W. Nealon, on the 20th day of May, 1861, in Company A - Cobb Guards #22, of the State of Georgia in the service of the Confederate States and who was HONORABLY DISCHARGED at Greensboro, N. C., in the State of North Carolina, on the 5th day of May, 1865, on account of war being over. (Here state any other military service performed by applicant.) Served in the infantry That I served faithfully until HONORABLY DISCHARGED from the service of the Federal Government in the year 1865, and did not desert the service of the Confederate States nor take the oath of allegiance to the United States until after the surrender of the Confederate Armies. (Here state whereabouts at close of Civil War.) That I was Greensboro, N. C. That I have heretofore applied for a pension from the State of Florida and refer to Claim No. ____ for the proof contained therein. (Here state any wounds received, or loss of limbs and eyesight.) The name W. Nealon has not been found on the muster rolls of Co. A, Cobb's Guards, Ga. Inf., C.S.A., (also known as Capt. Cullen's Co., attached to the 22nd Battn. Ga. Arty.) which rolls cover in part the period from Sept. 1, 1863 to Oct. 31, 1864, nor has any record been found of his service, capture or parole as of that organization. (This Co. was attached to 1st Battn., Fla. Inf, for a while in Aug., and Sept., 1863, and then to 22nd Battn. Ga. Arty.) The records show that one William Nealon, Co. A, 19th Tenn. Inf., C.S.A., enlisted May 5, 1864, at Dalton, Ga. Muster roll May & June 1864, (latest on file) shows him deserted, date and place of desertion not shown, a Private. Capture, parole or later record not found. The name W. Nealon has not been found on the muster rolls of any organization, State of Georgia, C. S. Army. C. H. Nealon, Glades County, Florida WHEREAS, W. Nealon claims to have served in Co. A, Cobb Guards No. 22, a Georgia Battalion and he furnishes certified copy of his Discharge, which reads in parts as follows: "On the 26th day of April 1865 between General Joseph E. Johnson, Commanding the Confederate Army, and Major General W. T. Sherman, Commanding the U. S. Army in North Carolina, Sargent W. Nealon, Co. A. Cobb Guards #22, a Georgia Bat. has given his solemn obligation not to take up arms against the Government of the United States until properly released from the obligation," and also submits the affidavit of W. M. Register, certifying to the fact that he entered the said service in 1861, and that Mr. Nealon was in the service for four years, and Whereas, Mr. Nealon is 87 years of age and has a wife depending upon him for support and he has been a resident of this State for a number of years, and he is now unable to earn a livelihood due to his extreme age: Therefore, BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: SECTION 1. That the State Board of Pension be, and it is hereby directed to place the name of W. Nealon of Glades County, upon the Pension Roll of the State of Florida to be paid pension in the same manner and at the same rate as other pensioners of the State are paid. ******************************************************************************************* May the 5th, 1865 In accordance with the terms of the Military Convention entered into on the 26th day of April 1865 between General Joseph E. Yours very truly, Secretary, Pension Board ******************************************************************************************* In Re: In The Matter Of Pension For William Nealon State of Florida, County of Glades, Personally appeared before the undersigned authority, William Nealon, of Tasmania, Glades County, Florida, who is personally known to me, and after first being duly and legally sworn according to law, deposes, and says, that his full and correct name is William Nealon, that he was borned at Americus Georgia, in Sumpter County, on the 26th day of June 1842, that when he was 18 years of age, he inlisted [sic] in Company A, the 22nd Georgia Battallion of the Confederate Army some time in April or May of 1861 at Americus Georgia, and deponent further says, that he served until the close of the war, and at no time did he desert said service, and that on the 5th day of May 1865 he was finally discharged from said service with honor at Greensboro North Carolina. Deponent further says that he has no means of support whatever, but that he is financially embarrassed. Witness my hand and official seal at Moore Haven, Florida, this the 14th day of March A. Dear Sir: Replying to your letter of the 22nd, instant, I wish to advise that proof of your war service has not been received in this office and if mailed must have been lost en route. The Law requires proof be furnished by affidavits of parties serving with the soldier, or who had personal knowledge of your service, or by Official Transcript or Discharge of Parole papers, none of which have been submitted. Peeples, Citrus Center, Florida Dear Brother Peeples: After you left this morning I went back to the Pension Department to look after Mr. Nealon's claim. I am enclosing copy of the record sent up by the War Department at Washington as a result of our inquiry. From this you will see no service of Mr. Nealon has been established. However, I am trying the Georgia records to see if we can get something up there, though doubtless you have already tried all of these places. With kind regards, I am, Yours very truly, Comptroller a/f *******************************************************************************(((((((((((( Bell & Bell Attorneys and Counselors At Law Arcadia, Florida November 27th, 1931 State Board of Pensions, Tallahassee, Florida Gentlemen: In 1929 the Legislature passed a law directing the State Board of Pensions to place the name of W. Nealon of Glades County upon the pension roll of the State of Florida to be paid pension in the same manner and at the same rate as other State pensioners are paid. This law is Chapter 14537, Acts of 1929. Mr. Nealon has exhibited to me a letter under date of November 13th, 1931, from your Secretary saying that he is charged with having deserted from Company A, 19th Tenn. Inf., C.S.A., by official record obtained from Washington. Mr. Nealon was never a member of the Tennessee Company referred to, and his identity has doubtless become confused by the Board with that of some other person. Evidence of his honorable discharge upon surrender was before the Committee. His discharge was after the surrender of Johnson to Sherman on the 26th day of April, 1865, and was dated May 5th, 1865. I am unable to obtain the original now, but I am enclosing herewith a copy, which you may fully check. I know of no authority to keep the name of Mr. Nealon off the pension roll. Chapter 9206, Acts of 1923, the State Pension Board is directed to strike the name of certain soldiers from the Pension roll, but I am informed that he was never placed upon the roll as directed by the statute, and therefore could not be stricken from it. Owing to the great age of Mr. Nealon I am requesting that his name be placed upon the roll as of the date when the law became effective, and that he be paid his pension from that date. If, after placing his name upon the roll, the Board will give him the notice as required by the Act of 1923, he will answer fully. Bell, Arcadia, Florida Dear Mr. Bell: Your letter of the twenty-seventh is acknowledge. I have held up reply, hoping there would be a Pension Board Meeting at which your letter could be considered, however, up to the present there has been no full Board meeting, but just as soon as there is one your letter will be presented for consideration. I am enclosing herewith some copies of some of the correspondence the Pension Board had with Mr. Nealon and if he had the original of the Discharge you furnished copy of, it should have been furnished the Pension Board when proof of service was called for. You will note that the Georgia Company in which Mr. Nealon claims service was attached to 1st Battn., Fla. Inf., for a while and it may have been that it was later attached to a Tenn. Co. At any rate the Mr. Nealon referred to enlisted from Georgia and when I wrote to Mr. Nealon and sent him copy of this record he did not furnish a statement, stating that he was not the William Nealon referred to in the records. You will be advised promptly when action is taken on your letter in connection with Mr. Nealon's claim for pension.
