State of Florida} Hamilton County} On this 3rd day of April, 1902, personally appeared before me, Clerk of the Circuit Court in and for said county and State, Henry Averitt who being by me duly sworn, declares he is the identical person who enlisted on or about the ………day of June, 1861, in Captain John Frink Company, county of Hamilton, in the State of Florida and that while in actual service in said company, 5th Fla Regiment, of the State of Florida on or about the 6th day of April, 1865, was honorably discharged at the expiration of [my service in] the War on the 6 day of April in …………..county, State of Virginia. I (Here state fully and clearly all the facts, showing the injury, its character, and especially the extent of the injury and disability resulting therefrom). I am over the age of sixty five years of age & unable to perform manual labor sufficient to support myself. And that as the direct result of said injuries, thus received in line of duty during the war, I am now unable to gain a livelihood by manual labor; that I have continuously since January 1st, 1885, been a citizen of Florida; that neither I nor my wife, nor both combined, own real and personal property to the value of $800 in this or any other State, and have not purposely disposed of our property for the purpose of availing ourselves of the provisions of the pension laws of Florida; that I am not otherwise enabled, or in a position to earn, and have no income from any source sufficient for a livelihood by manual labor, and that I never deserted the Confederate service, and that I receive a pension from no other source. D. 1885, and have continuously resided in this State since that date; that I do not own property, real or person, or real and personal, to the value of eight hundred dollars ($800), and that I am by reason of age incapable of providing a living by manual labor for myself. The children of parents who are unable to support themselves, shall be required to make provisions for their support. 2078. On information filed before the Justice of the Peace of the proper district by any person whomsoever, stating that certain persons have made no adequate provisions for their father and mother, or either of them, the Justice shall cause a summons to be issued to said parties, and evidence to be taken as to the truth of the facts stated in the information, and if the same shall be found true, after a fair trial in which the defendants shall have the right to be heard by counsel, the Justice shall issue an order making an assessment on the said children for such amount as shall be necessary for the support of their parents. 2079. Said order shall carry with it the right of enforcement, and shall have the force and effect of a writ of garnishment on the wages of such children, and shall further provide for the person to whom and the manner in which the money assessed therein shall be paid. C.” 1416 War Department, 1493984 The Adjutant General’s Office Washington, March 1, 1909. Respectfully returned to the Comptroller, State of Florida, Tallahassee. The records show that Henry Averett (name not borne on the rolls as Henry Avriett), private and corporal, Company F, 5th Florida Infantry, Confederate States Army, was enrolled March 14, 1862. On the company muster roll for September and October, 1864 (the last roll on file), he is reported present, with remark, “Deserted Nov. 16, 1864.” No later record of this man has been found. The name Henry Everett is borne on a register of oaths and deserters, (office) Provost Marshal General, Washington, D. C., which shows that he was a private, Company -, 5th Florida - -, Confederate States Army, and bears remarks showing him sent from Army of Potomac, and received November 25, 1864, and that he had taken the oath of allegiance and remained in Washington. The name Henry Everett has not been found on the rolls, on file in this office, of Company F, 5th Florida Infantry, Confederate States Army. F. C. Dear Sir:- I have to advise you that your name has been stricken from the pension roll of this state because it is clearly shown that you deserted from your command and never were entitled to a pension from this state. Dear Mr Goodbread:- I have your letter of the 23rd and thank you for your prompt reply. Please give me the name of the Mrs Smith you refer to. She probably applied in her own name and we have a great number of Smiths on the roll and it is not easy to locate here without her name. Tell me who to write to about Henry Avriett (sic). Feb. 23rd, 1909 Dear Miss Jefferson, Yours of the 20th rec and in reply will say That I don’t know the gentleman mentioned, if you can find out who was Captain of Co. H and in what county his company was raised, then it would be an easy task to find all about him, would to God I was clothed with the authority to hunt up such cases, I think I could strike off a many one, I have just been told that Henry Averitt and the widow of John F. Smith of this county (Hamilton) are drawing pensions and am told that Smith & Averitt were both deserters. And there are plenty in every county. Would be glad to serve you at any time.
