D. One Thousand Nine Hundred and thirty-two, personally appeared before me Clerk of Circuit Court in and for the County and State aforesaid Sarah McKinney a resident of Kissimmee County Of Osceola State of Florida, who being duly sworn according to law, makes the following declaration in order to obtain a pension under the provisions of the General Pension Laws of Florida. That she is the lawful widow of Robert C. McKinney. For proof of husband's war service, refer to Pension No. 8811, filed in the Comptroller's Office, Tallahassee, Fla. That she was lawfully married to the said Robert C. McKinney under the name of Mrs. Sarah Webb in the County of Glades State Florida, on the 28th day of June, 1924, and that she was not divorced from him before nor has she remarried since his death, which occurred on the 21st day of March 1832, in the County of Osceola, State of Florida except as hereinafter stated. That she is a resident of Osceola County, Florida, and has continuously resided in the State of Florida since the ____ day of 20 years or more. That she was heretofore been granted a pension from the State of Florida under Certificate No. ____. That she is not a pensioner of any other State. Overstreet, Clerk Circuit Court, Kissimmee, Florida Dear Mr. Overstreet: I wish to acknowledge receipt of yours of the 2nd and 6th, respectively, enclosing application for pension of Mrs. Sarah McKinney. Same has been filed in the Pension Department for the consideration of the Pension Board. Upon examination of Mrs. McKinney's claim for pension I note that she was not married until the 26th day of June, 1924, and in order for a widow to be eligible to a pension under the General Pension Law she is required to have been married prior to June 1st, 1917. I am enclosing herewith copy of the pension law in convenient form and beg to call your attention to Sec. 1445, which provides in part as follows: "No pension will be allowed to any widow whose marriage was subsequent to June 1, 1917." I regret that I can be of no assistance to Mrs. McKinney in regard to her pension but the Law is explicit and leaves no discretion with the Board with reference to the date of marriage of an applicant for a pension. I regret to inform you that under the General Pension Law, a widow is not eligible to a pension whose marriage was not prior to June 1st, 1917, and as the records show that you were not married until June 24, 1924, you are not eligible to a pension under the General Pension Law. Yours very truly, Secretary, Pension Board /B ******************************************************************************************* House Bill No. 145 An Act Granting A Pension To Mrs. Sarah McKinney Of Kissimmee, Florida WHEREAS, Mrs. Sarah McKinney, widow of Robert C. McKinney, who is shown on the records in the Comptroller's office to have received a pension from the State of Florida until his death on the 21st day of March, 1932, upon his war service in Hendry's Independent Cavalry from about August 1863 to end of the War, and WHEREAS, Mrs. Sarah McKinney does not come within the provisions of the General Pension Law on account of her marriage to Mr. McKinney subsequent to June 1, 1917, as she was not married until June 28, 1924, and is not eligible to a pension under the General Law, but is in dire need of said pension for the reason that she is 64 years of age and a total invalid incapable of helping herself, and she has no children nor other relatives in a position to help her, and would become an object of charity unless relief is granted: THEREFORE, BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: SECTION 1. That the State Board of Pensions be, and it is, hereby authorized and directed to place the name of Mrs. Sarah McKinney upon the pension roll of the State of Florida, to be paid a pension in the same manner and at the same rate that other pensioners of the State are paid. SECTION 1-A. Provided that nothing in this Act shall be construed to prohibit the right of the State Pension Board under the General Law of 1925 to remove the name of the pensioner from the pension roll if after investigation such Board shall find that the alleged soldier upon whose service the pension is based did not render service during the war between the States such as would entitled him to receive a pension or that he deserted the service. SECTION 2. That this Act shall take effect immediately upon its becoming a law.
