That she is the widow of William D. Valentine who was enlisted under the name of William D. Valentine on the ……day of ……….., 186…, in Company………………….. That she is a resident of Hernando County, Florida, and has continuously resided in the State of Florida since the 9th day of January 1853. State of Florida} Citrus County} On this second day of October, 1903 personally appeared before me a Justice of the Peace in and for said county and State, Mrs. Mary E. Valentine, aged 67 years, who being by me duly sworn according to law, makes the following declaration in order to obtain the pension provided by Act of the Legislature, approved June 6, 1903, for indigent widows of deceased Confederate soldiers and sailors: That she is the lawful widow of Wm. D. Valentine who enlisted ………..day of…………., 1862, in Captain …………..Company, ……………Regiment of the State of South Caroline and who was on the ……………day of …………….., 1865, at ………………….in the State of Virginia [killed in battle or] honorably discharged from said service, and died on the 21 day of October, 1878, at his home in Hernando County, Florida. She further states that she was previously married to William Smith, who enlisted in the Company Commanded by Capt. W. I. Saxon, from Hernando County, Florida, and that the said William Smith died of a [wound received in battle] congestion chill in camp, in Tennessee while serving in said Company; that afterward she was married to R. E. Nicks of Hernando County, Florida, who died soon afterward of chronic dysentery contacted in the service of the Confederate States; that afterwards was married to the said Valentine who had served the Confederacy from South Caroline, and who died on the date aforesaid, but she does not know in whose company he served. That she was legally married to said soldier prior to the first day of January, 1885, at Spring Lake in the State of Florida; that she has been a bona fide resident of the State of Florida continuously since the first day of January, A. D. 1890; that she does not own property, real and personal, to the value of $800 in this or any other State, and is not otherwise enabled or in a position to earn a livelihood, and has no income from any source sufficient for a livelihood; and that she has not purposely disposed of any property for the purpose of availing herself of the provisions of this act. REVISED STATUTES OF FLORIDA, CHAPTER II, ARTICLE I. 2077. The children of parents who are unable to support themselves, shall be required to make provisions for their support. 2078. On information filed before the Justice of the Peace of the proper district by any person whomsoever, stating that certain persons have made no adequate provisions for their father and mother, or either of them, the Justice shall cause a summons to be issued to said parties, and evidence to be taken as to the truth of the facts stated in the information, and if the same shall be found true, after a fair trial in which the defendants shall have the right to be heard by counsel, the Justice shall issue an order making an assessment on the said children for such amount as shall be necessary for the support of their parents. 2079. Said order shall carry with it the right of enforcement, and shall have the force and effect of a writ of garnishment on the wages of such children, and shall further provide for the person to whom and the manner in which the money assessed therein shall be paid. Page 010 State of Florida,} Hernando County.} Personally came before the undersigned Notary Public, Frank E. Saxon, who being duly sworn says that he is well acquainted with Mary E. Vallentine who is an applicant for pension under the laws of Florida; that he served with William H. Smith, the first husband of the said Mary E. Vallentine, in the Army of the Confederacy, in the Company of Capt. [William] Walter T. Saxon, from Hernando County, Florida; that while in service in said Company, in the State of Tenn. the said Wm. H. Smith was captured by the Union Forces and affiant heard at the time and fully believes that the said Wm. H. Smith died while in prison, during the War. Affiant further states that he was well acquainted with Benj. F. Nicks, the second husband of the said Mary E. Vallentine, and served with him in the said Company of William T. Saxon, (Co. “C” 3RD.Fla Regt.); that while in service in the said Company the said Benj. F. Nicks contracted chronic Dysentery and died from that complaint (as he has been reliably informed) soon after the close of the war; that the said Nicks was an invalid from the close of the War until he died, from the said complaint. Affiant further states that he knew of the marriage of the said Mary E. Vallentine to her last husband, Wm. D. Vallentine, who died in Hernando County many years ago; that he knows nothing as to the service (if any) of the said Vallentine, but he knows that the said Mary E. Vallentine lost two husbands as a result of the said War and believes she is entitled to and ought to have granted to her a pension on the service of the first and second husbands. Frank E. Nevitt, who being duly sworn says that he is will acquainted with Mary E. Vallentine who is an applicant for pension under the laws of Florida; that William H. Smith the first husband of the said Mary E. Vallentine served with affiant in the Army of the Confederacy, in the company of Captain Walter T. Saxon, 3rd Florida Regiment, from Hernando County Florida; that he has been reliably informed that while in service in said company, in the State of Tennessee, the said William H. Smith was captured by the Union Forces and died while in prison in the said state of Tennessee. Affiant further states that he also served in the said company with Benj. F. Nicks, the second husband of the said Mary E. Vallentine; that the said Benj. F. Nicks while in service in said company contracted chronic Dysentery which rendered him an invalid and from which he died soon after the close of the war. Affiant further states that after the death of the said Benj. F. Nicks the said Mary E. Vallentine was married to William D. Vallentine who died in Hernando County Florida a few years afterwards; that the said William D. Vallentine is supposed to have served in the State of South Carolina, but affiant knows nothing of the service, if any was rendered by him. That he knows that the said Mary E. Vallentine lost two husbands as the result of the said service and believes she is entitled to and ought to have granted to her a pension by the State of Florida for the service rendered by her first and second husbands. Saxon Clerk of the Circuit Court Brooksville, Fla., 22nd March 1904 Hon. William S. Jennings, Governor, Tallahassee, Fla. Dear Governor: Mr. C. H. Dickinson, Secretary of the Pension Board advised me sometime ago that the claim of Mary E. Vallentine had been, or probably would be rejected by reason of the fact that Mrs. Vallentine failed to state the name of the Captain and Company in which her husband served. Before sending in her application, I wrote you that she could not rely upon any service rendered by the last husband, Vallentine, but that she had lost two previous husbands as a result of the war, viz: William H. Smith who was captured and died in prison and B. J. Nicks who died from disease contracted in the service. You replied that you had consulted with the Attorney Gen’l and he was of opinion that the claimant should apply as widow of Vallentine but intermating that the service of the said Smith & Nicks could be used as a basis for the claim. I enclose testimony of Mr. Saxon and C. Q. Nevitt, who served with the said Smith and Nicks and trust it will serve. I (sic) consideration of the circumstances I address this to you personally and trust you will do what you can for Mrs. V. as she is one of our County poor.
